WHEREAS, it is deemed and is hereby declared to be a necessity
that the driveway on 11th Street from the South property line of
Tennessee Street to the South property line of Cladle-11 Street
in the City of Paducah, Kentucky, be constructed and reconstructed
of improved pavin; material under the provisions of law applicable
to cities of the second class,- Now, 'MEREFORE,
BE IT RESOLVED BY THE BOARD OF COLI;:ISSIONERS OF TY_E CITY OF
PADUCAH, KENTUCKY:
SECTION 1.
That the driveway on 11th Street from the South property line of

TennesseeStree t to the South property line of Caldwell Street,
in the City of Paducah, Kentucky, be constructed and reconstructed
of a concrete or such other improved paving material as may be
approved by the Board of Commissioners oi' the City of Paducah, with;
all necessary curbs,gutters, driveways, manholes, intakes, catch
basins, sewer and drain
pipes and all necessary en_,ineerin;, equip-
ment, advertising and legal and clerical services in connection Lhere-
:cith, and all to be done under and pursuant to statute authorizing
such improvements, and pursuant thereto that said improvements of
such public tray shall be made by the :7ork Projects Administration of,
other a;oncies of the Federal of State Government at *he exclusive

cost of the owners of the real estate abutting on said improvemont
to be apportioned among and assessed upon the lots or �a reels of
real estate abutting on such improvement accordim�; to the number of
front or abutting feet, and a tax shall be levied upon said lots
and parcels of real estate for the payment of the cost assessed
thereon, which cost shall be the difference between the total cost '
of completin6 said improvement and the total amount of the
contribution of said Federal or State Agencies engaged in making

said improvements, and which tax shall be due and payable at the
office of the City Treasurer, one-half thereof when the work of
construction begins and the remainder thereof or one-half of said
cost when one-half of said improvement shall have teen completed,
and which time shall be determined by the 3oard of Commissioners of
said city with the advice of the Cite En^ineer, and no prop=rty i

shall be exempt from such improvement tar., provided, however, that
any assessment for any such improvements as provided for- herein
i
which exceeds one-half of the value of the lots or parcels of real
estate upon which the assessment is made shall be void as to such
excess but the improvements shall be taken into consideration in
fixing the value of such real estate, and the Board of Commissioners
shall provide for the payment of any such excess, if any, out of the
general funds.
SECTION 2.
This resolution, after its adoption shall be published
in at least one (1) issue of the official news -paper of the
City of Paducah at least seven (7) days before any ordinance
ordering said imtr ovement shall have its final passage.
SECTION 3.

Tris resolution shall be in full force and e ffect from
Land after its adoption by the Board of Commissioners and upon
its publication as herein provided.
