VIHEREAS, it is deemed and is hereby declared to be a necessity
that the driveway on South 7th Street from the South property line
of Clark Street to the idorth property line of Jackson Street in the
-;City of Paducah, Kentucky, be constructed and reconstructed of
improved pavin material under the provisions of law applicable to
cities of the second class,- NOW, THEREFORE,
BE IT RESOLVED BY 71E BOARD OF COLi.:ISSIONL_.IPS OF THE CI'Ff OF

PADUCAH, N'PUCKY:
SECTION 1.
Pkat the driveway on South 7th Street from the South property
line of Clark Street to the North property line of Jackson Street
in the City of Paducah, Kentucky, be constructed and reconstructed
.'of a concrete or such other improved pavin.,c material as may be

approved by the Board of Commissioners of the City of Paducah, Y.,ith
all necessary manholes, intakes, catch basins, sewer and drain pipes
• and all necessary enP;ineerinl, equipment, advertising and le Tal and
pclerical services in connection therewith, and all to be done under•
and purst:ant to statute authorizing such improvements, and pursuant
thereto that said improvement of' such public way shall be made by the
'York Projects Administration or other agencies of the Federal

or State Government at the exclusive cost of the owners of real

estate abutting on said improvement to be apportioned among and
I
assessed upon the lots or parcels of real estate abutting on such
improvement according to the number of front or abutting feet, and
a tax shall be levied upon said lots and parcels of real estate for
I
the payment of the cost assessed thereon, which cost shall be the
difference between the total cost of completing said improvement

Band the total amount of the contribution of said Federal or State
i
Agencies en,,,, -ed in making said 'improvements, and which tax shall
jbe due and payable at the office of the City Treasurer, one-half �
I
thereof when the work of construction be�hns and the remainder
i
thereof or one-half of said cost when one-half of said improvement
i
shall have been completed, and wh_ch time shall be determined by
the Board of Commissioners of said city with the advice of the
i
City Engincer, and no property shall be exempt from such improve-
ment tax, provided, however, that any assessment for any such
iimprovements as provided for herein which exceeds one-half of the
i
value of the lots or parcels of real estate upon which the
assessment is made shall be void as to such excess, but the
improvements sha'l be taken into consideration in fixing the
i
value of such real estate, and the Board of Commissioners shall
provide for the payment of any such excess, if any, out of the
;eneral funds, i

This resolution, after its adoption shall be published
in at least one (1) issue of the official news -paper of the
I
City of Paducah at least seven (7) days before any ordinance i
ordering said improvement shall have its final passes, -e.
SECTION 3. J
'anis resolution shall be in full force and effect from
and after its adoption by the Board of Commissioners and upon
its publication as herein provided.
