AN ORDINANCE ASSESSING TIME ABUTTING PROPERTY ON PATH SIDES
OF KENTUCKY AVENUE FROM THE EAST PROPERTY LINE OF 10TH STREET TO THE
EAST PROPERTY LINE OF 28TH STREET, EXCLUDING INTERSECTIONS AT 19TH
AND 21ST STREET IN THE CITY OF PADUCAH, MCCRACKEN COUNTY, KENTUCKY,
FOR THE PORTION OF THE COST OF CONSTRUCTION OF SAID STREET AND
IMPROVEMENT THEREOF, BY THE PLACING THEREIN AND THEREON OF A CONCRETE
SURFACE TOGETHER WITH ALL NECESSARY CURBS, GUTTERS, DRIVEWAYS, MAN-,
HOLES, INTAKES, CATCH BASINS, SEWER AND DRAIN PIPES AND ALL NECESSARY
ENGINEERING, ADVERTISING AND IE GAL AND CLERICAL SERVICES IN CONNECTION
THEREWITH UNDER THE PROVISIONS OF AN ACT OF THE GENERAL ASSEMBLY
OF THE COMMONWEALTH OF KENTUCI,CY ADOPTED AT ITS REGULAR SESSION IN

1938, PROVIDING FOR THE IMPROVEME1NT OP PUBLIC WAYS IN CITIES OF THE
SECOND CLASS BY AID OF THE WORK PROJECTS ADMINISTRATION OR OTHER
AGENCIES OF THE FEDERAL OR STATE GOVERNMENT, AND AT THE EXCLUSIVE
COST OF THE OWNERS OF REAL ESTATE ABUTTING ON SUCH IMPROV9,1EN T
ACCORDING TO THE NUMBER OF FRONT OR ABUTTING FEET, AND PROVIDING
THAT A TAX SHALL BE LEVIED UPONSAID LOTS OR PARCELS OF REAL ESTATE
FOR THE PAYMENT OF THE COST ASSESSED THEREON, WHICH COST SHALL BE

THE DIFFERENCE BETWEEN THE TOTAL COST OF COMPLETING SAID IMPROVEMENT
AND THE TOTAL AMOUNT OF THE CONTRIBUTION OF THE WORK PROJECTS ADr
MINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNMENT
ENGAGED IN MAKING SAID IMPROVEMENT, AND WHICH TAX SHALL BE DUE AND
PAYABLE AT THE OFFICE OF THE CITY TREASURER IN THE CITY HALL IN
PADUCAH, ONE-HALF THEREOF WHEN THE WORK OF CONSTRUCTION BEGINS I

AND THE REMAINDER THEREOF WHEN ONE-HALF OF SAID IMPROVEMENTS SHALL
.HAVE BEEN COMPLETED, WHICH TIMiE SHALL BE DETERMINED BY THE BOARD
OF COMMISSIONERS WITH THE ADVICE OF THE CITY ENGINEER; AND ALL THE
ENGINEERING WORK HAVING BEEN C OMPLETED AND THE ESTIMIATED COST

ASCERTAINED, AND IT BEING DETERMINED FFO M SAID ESTIMATES
AFTER DEDUCTING THE AMOUNT TO BE CONTRIBUTED BY THE WORK PROJECTS
ADMINISTRATION OF THE UNITED STATES THAT THE AMOUNT REQUIRED TO
BE CONTRIBUTED BY THE ABUTTING PROPERTY OWNERS ON KENTUCKY AVENUE

FROM MURRELL BOULEVARD TO 127H STREET AND FROM 15TH STREET TO
28TH STREET IS $2.20 PER ABUTTING FOOT; ON KENTUCKY AVENUE FRO14 12TH
STREET TO 15^.TH STREET IS $2.10 PER ABUTTING FOOT; ALL DRIVEWAYS
TO BE ?0.12 PER SQUARE FOOT, ALL CURBS TO BE $0.36 PER LINEAL FOOT,:
ALL GUTTERS TO BE $0.20 PER LINEAL FOOT; AND THE CITY OF PADUCAH
BEING NOW READY TO C014MENCE WORK ON SAID IMPROVEMENT AS OF THE
• DATE OF THE ADOPTION OF Tri IS ORDINANCE
WHEREAS, the Board of Commissioners has heretofore adopted
an ordinance providing for the construction and reconstruction of
said driveway under the teretes of said Act aforesaid, and pursuant
to its provisions, and,

WHEREAS, work is now ready to begin on said construction
and one-half of the estimated cost thereof is now due to be paid to
the City Treasurer,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COM14ISSIONERS
OF THE CITY OF PADUCAH, I<_ENTUCKY:
SECTION 1.
That all of the property onboth sides of Kentucky Avenue
from the West property line of 10th Street to the East property
line of 28th Street, excluding intersections at 19th and 21st
Streets in the City of Paducah, McCracken County, KentuEky, as shown
by estimates on file in the Engineer's office in the City Hall in
the City of Paducah, Kentucky, be and the same is hereby assessed
for the cost of construction of said paved street with all necessary
curbs, gutters, driveways, manholes, intakes, catch basins, sewer
and drain pipes and all necessary engineering, advertising and legal
and clerical services in connection therewith, the portion of said
cost of improvement required to be paid by said property owners
shall be the following amounts, to -wit:
On Kentucky Avenue from Turrell Boulevard to 12th Street
and from 15th Street to 28th Street is :12.20 per abutting foot; on
Kentucky Avenue from 12th Street to 15th Street is y�'2.10 per
abutting foot; all driveways to be �'10.12 per square foot, all curbs
to be $0.30 per lineal foot, all gutters to be '0.20 per lineal
foot; that all of said estimates are on file in the office of the
Engineering Department in the City hall, and are referred to and
made a part hereof.
SEC TION 2.
That one-half of said assessment as against each lot as
shown by said assessment and estimate of said engineer is now due
and unless paid within ten (10) days after the adoption of this
ordinance there shall be added thereto a penalty of 6;1. and a lien
is declared to exist upon said lots and parcels of real estate for
the portion of cost of said improvement so assessed as herein
provided, and the amount of said assessment shall bear interest
upon any part thereof that remains unpaid for ten (10) days after
same is due to be paid at the rate of 6% per annum in addition
to the penalties aforesaid, which lien shall be superior to all
other liens except the lein for State, County and City taxes.
SECTION 3.
The publication of this oddlinance shall be notice to all
persons interested and due to pay said assessment, of the time and
place to pay the same. Said assessment will be paid one-half
within ten (10) days ffom the publication of this ordinance, and

the other one-half will be paid when the Board Of Commissioners
shall declare, by ordinance or resolution, that said work and
said improvement has been one-half completed.
SECTION 4.
This ordinance shall be in full force and effect from and
after its adoption.
