AN ORDINANCE PROVIDING FOR THE CLOSING OF A CERTAIN PORTION
OF MONROE STREET EAST OF THE INTERSECTION OF SECOND AND MONROE
STREETS IN THE CITY OF PADUCAH, KENTUCKY, DESCRIBING THE EXACT AREA
OF SAID STREET WHICH IS TO BE CLOSED HEREBY, AND AUTHORIZING THE
CORPORATION COUNSEL OF THE CITY OF PADUCAH TO INSTITUTE IN qHE
SAID
MCCRACKEN CIRCUIT COURT A SUIT FOR ME PURPOSE OF HAVING/STREET
LEGALLY CLOSED
WHEREAS, the City of Paducah by accepting the agreement
of the Federal Materials.Company to pay the sum of $1500.00 for the
use of that portion of the street proposed to be closed, has
agreed to adopt an ordinance providing for the closing of said street;
and,
WHEREAS, under the terms of said agreement, the City of Paducah
befomes obligated to take appropriate letislative action for the
closing of said street, the same to be closed subject to any
existing easements and to all rights and privileges retained by the
city under said agreement; and,
WHEREAS, by reason of the construction of a sea wall or flood
protection wall which extends over and across Monroe Street between
Second Street and the River, it is necessary that said street be
closed; and,
WHEREAS, the closing of said street shall not operate to divest
the city of the property conveyed to it for use as a flood wall right
of way by deed from the Federal Materials Company, et al, by T. A. Miller
Master Commissioner dated June, 22 1940 and of record in Deed Book
page _ in the McCracken County Court Clerkts Office; and,
WHEREAS,inorder to promote the public health, safety and
general welfare of the City of Paducah and its citizens, it is deemed
advisable to close said street,—
NO17 THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That a certain portion of Monroe Street, the same lying
and being East of the intersection of Second and Monroe Streets
in the City of Paducah, Kentucky, and being more particularly
described as follows:
"Beginning at a point on the downstream line of Monroe
street 64.66 feet riverward of the riverside line of
North 2nd Street; thence riverward on the downstream
line of Monroe Street a distance of 200.00 feet to
its intersection with the landside right of way line
of the I.C.R.R.; thence upstream across Monroe St.
a distance of 66.00 feet more or less to a point d)n
the upstream line of Monroe Street,which point is
267.32 feet riverward from the riverside line of North
2nd Street; thence landward on the upstream line of
Monroe Street a distance of 200.00 feet to a point
67.32 feet riverward from the riverside line of Vim ir-m r

a distance of 66.00 feet more or less to the place
of beginning."
be and the same is hereby vacated and closed; and the Corporation
Counsel of the City of Paducah is ordered and directed to
institute in the McCracken Cffircuit Court a suit for the purpose of
carrying into effect the provisions of this ordinance and closing
said street for the purposes herein set forth.
SECTION 2.
All ordinances and parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
SECTION 3.
This ordinance shall be in full force and effect
from and after its adoption.
