AN ORDINANCE REGULATING THE USE OI'' STREETS, ALLEYS,
I AND OTHER PUBLIC WAYS FOR THE PURPOSE OF T„OVIi!G BUILDINGS AND OTHER
STRUCTURES THEREON, AND PROVIDING FOR THE PUNISHI:-'E:T FOR THE

VIOLATION OF THE PROVISIONS THEREOF
BE IT ORDAINED BY THE BOARD OF C013=SIONERS OF THE
i
CITY OF PADUCAH, KENTUCKY:
SECTION 1.
No person, firm, company or corporation shall move
I
a building or structure of any kind over, through or across any
street, alley, or public Tay of the city unless he shall first
I
procure and have issued to him a permit under the provisions of
this ordinance.

SECTION 2.
Any person, firm, company or corporation desiring
to use t6mporarily the streets, alleys or public ways for the
purpose of moving a building or other structure shall make
application to the Building Inspector for such privilege, w hick
application shall state the name and residence of the applicant,
the type and size of the strusture to be moved, the route and

distance which the same shall be moved, and the estimated
period of time required for moving said building or structure.
hereupon, if in the judgment of the Building Inspector the use

i of said streets, alleys or public ways for such purpose shall
I
not materially interfere with the rights of the traveling
,;,public or create a traffic hazard of any kind, said permit
may be issued to the applicant when he has complied with the
I other provisions of this ordinance.
SECTION 3.
�! Before a permit shall be issued to any person, firm
I
Ilcompany or corporation to use any street, alley, or public way
l
for the purpose of moving a building 6r other structure from
one location to another, there shall be executed to the City of
Paducah, Kentucky, a bond with surety approved by the City
Ir,anager, to covet the cost of any and all damages or injuries

to its streets, alleys or public says caused by or resulting
from the moving of such structure, said bond to be in the penal
sum of ?270.00. The condition of said obligation shall be such
that if said applicant will immediately upon demand pay to the
City of Paducah the amount of damages to said streets, alleys
or public ways occasioned by the moving of said building or
structure over the same or any part thereof, or the surface
of same, said bond shall be null and void.
SECTION 4.
No permit shall be issued to any person, firm
company or corporation: for the use of any street, alley or
public way for the moving of a building or structure, over,
through or across the same unless tha applicant therefor shall �b 7
also execute to the City of Paducah, Kentucky, an Indemnity
Agreement approved by the Cita; Manager, and under the terms
of which said a-)plicant and his surety shall agree to protect
the City of Paducah, Kentucky, against any and all liability
imposed upon it either directly or indirectly, as a result
of the -moving of said building or structure by said applicant,
his agents, servants or employees, or by any person, firm
company or corporation who undertakes said work under
contract with said applicant, and to indemnify the City of
Paducah against any loss, costs, attorneys fees and all damages
of whatever noture which it may be required to pay in consequence
of an accidental injury received by the person or daa^nage to
the property of any person resulting from such moving operations
or the use of streets, alleys or other public ways for such
purpose, including any loss or damage which, in the
discretion of the Board of Commissioners, said City may pad- in
settlement by compromise, either prior to or after the filing
of suit, or any claim resulting from the use of the streets,
alleys or public ways for such purposes.
SECTION 5.
Any person, firm, company or corporation who s hall
use the streets, alleys, or public wqys, or any pary thereof for
the purpose of moving a building or other structure of any kind
without first complying with all of the terms of this ordinance
shall be fined not less than: "10.00 nor more than "'50.00,

or confined in the City Jail not less than ten (10) days nor more
i than thirty (30) days, or both sof ined and imprisoned.

SECTION G.
All ordinances and parts of ordinances in conflict
hereyvith are to the extent of such conflict hereby repealed.
SECTION 7.
This ordinance shall be in full force and effect
from and after its adoption.
