HomeMy WebLinkAboutOrdinances Book 10, Page 239, No Resolution NumberPage 239 A RESOLUTION PROVIDING FOR THE CONSTRUCTION AND RECONSTRUCTION OF CONCRETE SIDEWALKS, DRIVEWAYS WITH CURB RETURNS AND CROSS WALKSI ON BOTH SIDES OF HARAHAN BOULEVARD FROM THE NORTH PROPERTY LINE OF', JEFFERSON STREET TO THE SOUTH PROPERTY LINE OF CLAY STREET IN THE j CITY OF PADUCAIi, MCCRACKEN COUNTY, IENTUCKY, WITH ALL NECESSARY DRAIN PIPES, AND ALL NECESSARY ENGINEERING, ADVERTISING AND LEGAL AND CLERICAL SERVICES IN CONNECTION THEREWIPH AS PROVIDED BY LAW, AND WITH THE AID OF THE WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNMENT AND AT THE EXCLUSIVE COST OF THE OFINERS OF REAL ESTATE ABUTTING ON SAID STREET, SUCH IY.PROVEIIPENT TO BE APPORTIONED AMONG AND ASSESSED UPON THE LOTS OR PARCELS OF REAL ESTATE ABUTTING ON SUCH IMPROVEMENT ACCORDING TO THE NUMBER OF FRONT OR ABUTTING FEET, AND PROVIDING THAT A TAX SHALL BE LEVIED UPON SAID LOTS OR PARCELS OF REAL ESTATE FOR THE PAYMENT OF THE COST ASSESSED THEREON, AND WHICH COST SHALL BE THE DIFFERENCE BETWEEN THE TOTAL COST OF COMPLETING SAID IMPROVE- � HENT AND THE TOTAL AMOUNT OF THE CONTRIBUTION OF SAID FEDERAL OR STATE AGENCIES ENGAGED IN iffAKING SAID IMPROVEMENT, AND WHICH TAX SHALL BE DUE AND PAYABLE AT THE OFFICE OF THE CITY TREASURER, ONE- HALF THEREOF WHEN THE 410RK OF CONSTRUCTION BEGINS AND THE REMAINDER THEREOF WHEN ONE-HALF OF SAID IIsIPROVERIENTS SHALL HAVE BEEN COMPLETED, WHICH TIME SHALL BE DETERPriiNED BY THE BOARD OF COma- ISSIONERS OF SAID CITY WITH THE ADVICE OF THE CITY ENGINEER WHEREAS, it is deemed and is hereby declared to be a necessity that the sidewalks, driveways with curb returns and cross walks on both sides of Harahan Boulevard from the North property line of Jefferson Street to the South property line of Clay Street, be constructed and reconstructed of improved paving material under; i the law applicable to cities of the second class, - NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the sidewalks, driveways with curb returns and cross walks on both sides of Harahan Boulevard from the North property line of Jefferson Street to the South property line of Clay Street in the City of Paducdi, hentucky,b e constructed and reconstructed of concrete or such other improved paving material as may be approved' by the Board of Commissioners of the City of Paducah, with all necessary drain pipes and all necessary engineering, advertising and legal and clerical services in connection therewith, and all I Page 240 to be done under and pursuant to statute authorizing such improvements and pursuant thereto that said improvement of such public way shall be made by the 77ork Projects Administration or other agencies of the Federal or State Government at the e;;clusive cost of the owners of the real estate abutting on said improvement to be apportioned among andassessed upon the lots or parcels of real estate abutting on such improvement according to the number of front or abutting feet, -and a tax shall be levied upon said lots and parcels of real estate for the payment of the cost assessed thereon, which cost shall be the difference between the total cost of completing said improvement and the total amount of the contribution of said Federal or State Agencies engaged in making said inir-r ovements, and which taxes shall be due and payable at the office of the City Treasurer, one-half thereof when the work of construction begins and the remainder thereof or one-half of said cost when one-half of said improvement shall have been completed, and which time shall be determined by the Board of Commissioners of said city with the advice of the City En.-ineer, and no property shall be exempt from such improvement tax, provided, however, that any assessment for any such improvements as provided for herein which exceeds one-half of the value of the lots or parcels of real estate upon vLich the assessment is made shall be void as to such excess, but the improvements shall be taken into consideration in firing the value of such real estate, and the Board of Commissioners shall provide for the payment of any such excess, if any, out bf the general funds. SECTION 2. This resolution, after its adoption shall be published in at least one (1) issue of the official newspaper of the City of Paducah at least seven (7) days before any ordinance ordering said improvement shall have its final passage. SECTIOPd 3. This resolution shall be in full force and effect from and after its adoption by the Board of Commissioners and upon its publication as herein provided. r .
