AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH
SIDES OF CLAY STREET FROM THE WEST PROPERTY LINE OF 10TH STREET
TO THE EAST PROPERTY LINE OF 21ST STREET, ENCLUDING INTERSECTIONS
AT 13th, 16th & 17th STREETS IN THE CITY OF PADUCAH, I;ICCRACKEN
COUNTY, KENTUCKY, FOR THE PORTION OF THE COST OF CONSTRUCTION OF
SAID STREET AND IMPROVEMENT THEREOF, BY THE PLACING THEREIN AND
THEREON OF A CONCRETE SURFACE TOGETHER WITH ALL NECESSARY MANHOLES,
INTAKES, CATCH BASINS, SEWER AND DRAIN PIPES AND ALL NECESSARY
ENGINEERING, ADVERTISING AND LEGAL AND CLERICAL SERVICES IN
CONNECTION THEREWITH UIZER THE PROVISIONS OF AN ACT OF THE
GENERAL ASSE14BLY OF THE C014YONl EALTH OF KENTUCKY ADOPTED AS ITS
REGULAR SESSION IN 1938, PROVIDING FOR THE IMPROVEMENT OF PUBLIC
WAYS IN CITIES OF THE SECOND CLASS BY AID OF THE WORK PROJECTS
ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE
GOVERNMENT, AND AT THE EXCLUSIVE COST OF THE OWNERS OF REAL
ESTATE ABUTTING ON SUCH IMPROVEMENT ACCORDING TO THE NUMBER OF
FRONT OR ABUTTING FEET, AND PROVIDING THAT A TAX SHALL BE LEVIED
UPON SAID LOTS OR 1ARCELS OF REAL ESTATE FOR THE PAYMENT OF THE
COST ASSESSED THEREON, WHICH COST SHALL BE THE DIFFERENCE BETWEEN
THE TOTAL COST OF COMPLETING SAID IMFR OVEMENT AND THE TOTAL
AMOUNT OF THE CONTRIBUTION OF THE WORK PROJECTS ADMINISTRATION
OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNMENT ENGAGED IN
MAKING SAID IMPROVEMENT, AND WHICH TAXES SHALL BE DUE AND PAYABLE
AT THE OFFICE OF THE CITY TREASURER IN TRE CITY HALL IN PADUCAH,
ONE-HALF THEREOF WHEN THE WORK OF CONSTRUCTION BEGINS AND THE
REMAINDER THEREOF WHEN ONE-HP.LF OF SAID IMPROVEMENTS SHALL HAVE
BEEN COMPLETED, WHICH TIME SHALL BE DETERMINED BY THE BOARD OF
COMMISSIONERS WITH THE ADVICE OF THE CITY ENGINEER; AND ALL THE
ENGINEERING WORK HAVING BEEN COMPLETED AND THE ESTIMATED COST AS-
CERTAINED, AND IT BEING DETERMINED FROM SAID ESTIMATES AFTER
DEDUCTING THE AMOUNT TO BE CONTRIBUTED BY THE WORK PROJECTS
ADMINISTRATION OF THE UNITED STATES THAT THE AMOUNT REQUIRED
TO BE CONTRIBUTED BY THE ABUTTING PROPERTY OWNERS ON CLAY STREET
BETWEEN 10th AND 16th STREETS IS $2.15 PER ABUTTING FOOT; AND
BETWEEN 161hh AND 21st STREETS IS $2.05 PER ABUTTING FOOT, AND

THE CITY OF PADUCAH BEING NOVI READY TO COMMENCE WORK ON SAID
IMPROVEMENT AS OF THE DATE OF THE ADOPTION OF THIS ORDINANCE,
WHEREAS, the Board of Commissioners has heretofore
adopted an ordinance providing for the construction and
reconstruction of said driveway under the terms of said Act
aforesaid, and pursuant to its provisions; and,

. WHERIdAS, work is now ready to be gin on said construction
and one-half of the estimated cost thereof is now due to be paid to
the City Treasurer,
NOVI, THEREFORE, BE IT ORDAIIā¢:ED BY THE BOARD OF C0131ISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That all of the property on both sides of Clay Street from
the West property line of 10th Street to the East property line of
21st street, excluding intersections at 13th, 16th & 17th Streets
in the City of Paducah, McCracken County, Kentucky, as shown by
estimates on file in the Engineers office in the City Hall in the
City of Paducah, Kentucky, be and the same is hereby assessed for
the cost of construction of said paved street with all necessary
manholes, intakes, catch basins, serer and drain pipes and all
necessary engineering, advertising and legal and clerical
services in connection therewith, the portion of said cost of
improvement required to be paid by said property owners shall be
the following amount per front foot, to -wit:
Total cost against the property owners between 10th and 16th Streets
is $2.15 p r abutting foot; between 16th and 21st Streets is $2.05
per abutting foot; that all of said estimates are on file in the
office of the Engineering Department in the City Hall, and are
referred to and made a part hereof.
SECTION 2.
That one-half of said assessment as against each lot as shown
by said assessment and estimate of said engineer is now due and
unless paid within ten (10) days after the adoption of this
ordinance there shall be added thereto a penalty of 6o and a lien
is declared to exist upon said lots and parcels of real estate
for the portion of cost of said improvement so assessed as herein
provided,and the amount of said assessment shall bear interest upon
any part thereof that remains unpaid for ten (10) days after same
is due to be paid at the rate of 6% per annum in addition to the
penalties aforesaid, which lien shall be superior to all other
liens except the lien for State, County and City taxes.
SECTION 3.
The publication of this ordinance shall be notice to all
persons interested and due to pay said assessment, of the time and,

place to pay the same. Said assessment will be paid one-half
within ten (10) days from the publication of this ordinance, and
the other one-half will be paid when the Board of Commissioners
shall declare, by ordinance or resolution, that said work and
said improvement has been one-half completed.
SECTION 4.
This ordinance shall be in full force and effect from and
after its adoption.
