AN ORDINANCE AGREEING TO A FORM OF CO-OPERATION
AGREEMENT BETNEE:< THE CITY OF PADUCAH, KENTUCKY; COUNTY OF
iMCC3ACKEN, STATE OF KENTUCKY, AND THE FEDERAL SURPLUS COP`MODITIES
CORPORATION FOR THE INAUGURATION AND OPERATION OF THE FEDERAL FOOD
STAMP PLAN: AUTHORIZING, ET-;PO;'ERING AND DIRECTING THE MAYOR AND
CITY TREASURER TO BORROW UP TO THE SUPT OF THREE THOUSAND SEVEN
HUNDRED & FIFTY ($3750.00) DOLLARS FOR USE OF THE CITY OF PADUCAH
IN CARRYING SAID AGREEMENT INTO EFFECT, AND TO EXECUTE A NOTE
OR NOTES FOR SAID SUM! FOR AND ON BEHALF OF SAID CITY, AND TO
PLEDGE THE hEVENL•E OF THE CITY OF PADUCAH FOR THE FIRST ONE:,HALF
OF THE YEAR 1940 AS SECURITY THEREFOR; AND PROVIDING FOR THE
EPTPLOYMENT OF A FOOD STAMP ISSUING OFFICER TO AD."INISTER THE
PROVISIONS OF SAID AGREET'ENT, PRESCRIBING THE DUTIES OF SUCH
OFFICER AND FIXING THE AMOUNT OF COMPENSATION HE SHALL RECEIVE
FOR HIS SERVICES;
IMEREAS, the City of Paducah, Kentucky, and :the
County of McCracken, State of Kentucky, jointly and in
conjunction with the Federal Surplus Commodities Corporation,
propose to accept the benefits of the Federal Food stamp plan in
accordance with the "Regulations and Conditions Governin„ the
issuance of Food Order Stamps" issued by the Secretary of Agricult
on April 21st, 1939, as heretofore or hereafter amended;
NOW, THEREFORE, BE I"i' ORDAINED BY THE BOARD OF
COM_.-,ISSIONERS OF THE CITY OF PADUCAH:
SECTION 1.
That the City of Paducah, Kentucky, hereby accepts,
adopts and inaugurates the Regulations and Conditions Coverning
the Issuance of Food Order Stamps, Establishing the Eligibility of
the Holders Thereof to Receive Agricultural Commodities or the
Products Thereof and Providing for the Payment of Claims bade by
Retailers of such Commodities and Products, issued by the
Secretary of Agriculture on April 21st, 1939, as heretofore or
hereafter amended, and that the City tanager be, and he is hereby
authorized and empowered to si.-n and execute, for and on behalf of
the City of Paducah, the form of Co-operation a,;reement between tha
City of Paduca#, Kentucky, the County of McCracken, State of Kentue
and the Federal Surplus Commodities Corporation, and that one
copy of said agreement, after the same shall have been executed by
all bE the parties, be received and filed and made a part of the
official records of the City of Paducah to the same extent as if
wholly embraced herein.

That for the purpose of carryinS into effect the terms,
Provisions and stipulations of said agreement, the :iayor and the
City Treasurer are hereby authorized and empowered to borrow from
any bank or trust company up to the sum of $3750.00 for use in the
Purchase of food order stem s the same ame to be redeemed in the manner
and at the times as provided by the terms and conditions of said
agreement,and they shall xecute a note or notes as evidence of

said loan, the same to bear interest at not exceeding 6/ per annum
from date, and the income and revenue of the City of Paduceh for
the first Fiscal one-half of the year 1940 are hereby pledged as
security for said loan.

SECTION _ 3.
That the City ",:anager be, and he is hereby authorized
and empowered to employ, subject to the approval of the '^_cCracken I
it County Fiscal Court, a Food Stamp Issuing Officer, i,hcse duties

Commodities Corporation, or its duly appointed and designated
IIagent or a-ents, said officer shall, for and on behalf of the City
of Paducah, perform all of the acts, terms and provisions fully
set out in the aforesaid Co-operation Agreement. Said Food Stamp
Issuing Officer shall have power and he is hereby vested dth the

iauthority to deposit in his name as such Food Stamp Issuing Officer, I,

at either the Citizens Savings Bank at Paducah, Kentucky, or the
lPeoples National Bank at Paducah, Kentucky, and at no other place,
all funds that shall come into his possession ih connection with the
Performance of his duties as such "rood Stamp Issuing Officer. He

II set forth except by check or draft unto the Treasurer of the

Said _'-)od Stamp Issuin; Officer is hereby
authorized and empowered to eXecute and deliver all checks, drafts
and other instruments and to perform all acts necessary for the
consummation and completion of his duties as such under the terms
of the aCreement above referred to.

At no time and under no condition shall said
Officer deleSate to any other person or persons the duty of
selling or handling of any stamos, or no money used in connection
with the sale of handling of stamps shall be delivered to or held
by any other person or persons at any time without the consent
of said City and County.
SECTION 4.
The person employed as such Food Stamp Issuing
Officer shall hold his position by virtue of the appointive
power vested in the City Manager under Section 3235dd-35 of the
Kentucky Statutes, and he may be removed at any time without
notice. He shall receive from the City of Paducah for his
services as such Food Stamp Issuing Officer the sum of '50.00
per month, such salary to be paid at the same time and in the
same manner as other employees of said city are paid.
SECTION 5.
Said Food Stamp T_sauing Officer shall execute and
deliver to the City of Paducah and the County of McCracken,
State of "entucky, a fidelity bond, with corporate surety approves
by the City Manager, in the penal sum of Ten Thousand (1`10,000.00/
Dollars for the faithful performance of his duties, and the
faithful accounting of all fu -Ids and food order stamps coming
into his hands and under his control, the expense of which bond
shall be vourne equally by said city and county, and the person
so employed as such Food Stamp Issuing Officer shall not enter
upon his duties until this provision shall have been fully
complied *,ith to the satisfaction of the City 11,:ana.-er.
SECTION 6.
All ordinances, resolutions and motions, or
parts thereof, which are in conflict with the provisions of this
ordinance are, to the extent of such conflict, hereby repealed.
SECTION 7.
It being necessary to immediately inaugurate and
proceed with the operation of the plan for issuance of Food Stamps
in order to preserve and protect the public health, safety and
welfare of the city and its citizens who are eligible to

participate in said program, an emergency is hereby declared to
exist and this ordinance shall be in full force and effect from
and after its adoption.
