HomeMy WebLinkAboutOrdinances Book 10, Page 1525, No Ordinance NumberAN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT WITH BLACK AND VEATCH, CONSULTING ENGINEERS, FOR THE PREPARATION Of PLANS FOR STORM RELIEF SEWERS IN THE CITY OF PADUCAH, KENTUCKY, AND APPROPRIATING THE SUM OF NOT EXCEEDING $14,000.00 FOR THE SERVICES TO BE RENDERED BY THEM IN THE PREPARATION OF SAID PLANS WHEREAS, the Federal Vtorks Agency has approved an advance- ment to the City of Paducah in the sum of $14,000.00 for the purpose of plan preparation for construction of storm relief sewers; and, WHCREAS, it will be necessary for the City of Paducah to em- ploy consulting engineers for the preparation of said plans; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION ONE That Black and Veatch, consulting engineers, of Kansas City, Missouri, be employed by the City of Paducah to prepare the plans for the construction of storm relief sewers in said city, and the mayo and the city clerk are hereby authorized, for and on behalf of the City of Paducah, to enter into a contract of employment with the said Black and Veatch, said contract to contain the following terms, con- ditions and covenants: "That in consideration of the mutual covenants herein contained, the City hereby agrees to employ the engineers to perform the services hereinafter mentioned, and agrees to pay them for such services according to the schedule of fees herein contained. A. The services which the Engineers hereby agree to perform are: 1. To made all field investigations, surveys, test borings, studies and do all work necessary to determine the proper size, construction and lo- cation of storm water relief sewers as described more fully in the application of the City to the Federal works Agency, Bureau of Community Facil- ities and approved by them under Docket Ky-15-P-142, Storm Relief Sewers. 2. To prepare all detailed construction dvawings, contract documents, bid forms, etc., as necessary for the City to receive public bids for the construction of the proposed improvements and to furnish the City with ten (10) copies thereof and with all needed copies at the time of receiv- ing of construction bids. 3. To submit the plans, etc., to any governmental agency hav- ing jurisdiction or int5rest in the project and to recei,e their approval thereto. 4. To formally deliver the plans, specifications, etc., to the City and to explain in detail, the proposed con- struction, design basis, etc. 5. To present with the plans, a detailed construction cost estimate that has been checked lay the City Engineer and mutually agreed to as a just and proper estimate of cost) at the construction prices prevailing at the time of sub- mission of the detailed construction drawings. 6. To assist the City in any way possible in determining the most equitable method of financing the proposed im- I provements and to be present when construction bids are received, to tabulate the same and to advise the City as to award of construction contracts. 1526 7. The services to be performed by the Engineers under items A-1 through A-6 shall be fully rendered and the final drawings, specifications, and all other documents required to be prepared thereunder shall be completed and filed with the Board of Commissioners within a period of ten months from the date on which the City shall give to the Engineers notice provided for in Section 3 of Paragraph "B". 8. To execute and deliver to the City of Paducah a bond in the penal sum of $14,000.00, conditioned upon the faithful performance of its duties under this contract, said bond to be in form and substance satisfactory to the City. B. The City agrees - 1. To cooperate fully with the engineers in the preparation of those plans, etc., by furnishing prints of all con- struction drawings, etc., of the present sewers, to al- low the engineers to use space in the City Engineer's office as a field office and to assist the engineers in securing correct descriptions of property for right of way, platit site, etc., and to review the contract docu- ments as to legal items. 2. To pay the Engineers for the services outlined in Para - gra h A-1 through A-6 above, a sum equal to two percent (2,.' of the agreed estimated construction cost as de- termined in Paragraph A-5 above provided that the total sum paid the Engineers by the City for this work shall in no case exceed fourteen thousand dollars ($14,000.00), and provided further that this sum shall be paid by the City solely from advanced planning funds received for this purpose from the Federal Works Agency Bureau of Community Facilities for such purposes, and said sum shall be payable at the rate of fifteen hundred dol- lars (;1500.00) per month for four (4) months after start of the work on this project and the balance to be due and payable upon the delivery of the plans, etc. to the City. 3. To notify the Engineers when to start work on this project and to advise them prior to any change or m6dific tion of the agreement between the City and the Federal Works Agency as to financing of this engineering contract C. It is mutually agreed and understood that payments for services under this contract shall be made by the City to the Engineers solely from funds received by the Citfrom the Federal Works Agency, Bureau of Community facilities under Docket Ky-15-P-142 Storm Relief Sewers for this purpose and the City shall be in no way obligated for any expenditure of its own funds to fulfill the provisions of this contract. SECTION 'A11O That the sum of not exceeding $14,000.00 be, and the same is hereby appropriated for payment of the fees which will become du and payable to the said Black and Veatch under the aforesaid employ ment contract, but said fees shall be payable solely from the funds received by the City from the Federal Works Agency. SECTION THREE This ordinance shall be introduced at a regular meeting of the Board of Commissioners and remain on file for public inspection one week in the completed form in which it shall be put upon its fii nal passage, and if adopted it shall be in full force and effect ten (10) days thereafter.
