WHCREAS, pursuant to a res-lution adopted bj the Loard
of Commissioners on ?,:arch 12th, 1946, the Acting City T._,anager
advertised for bids for the purchase of all ?i: C 1-2-3 Liquid
Asphalt required by the city during the remainder of the year,
1946: and,
17HEREAS, the Actin, City [,,anager Navin., advertised for
bids as required by the provisions of said resolution and having
received the bids of the Talco Asphalt and P,efinin.- Division
and the Ohio Oil Company: and,
WHEREAS, the Actin,,'ity ::anager having recommended the
acceptance of the bid of The Ohio Oil Company,

SEC TION 1.
That the bid of the Ohio Oil Company for the sale to the
City of laducah of all C 1-2-3 Liquid Asphalt required by the
city during the year 1946 be accepted, and the P.ctinR City iulanager
is hereby authorized to enter into and execute a contract for the
purchase upon the order of the city of all asphalt to be used in 1 46,
said contract to contain the following terms, conditions and cogen nts:-
"The Company hereby agrees to sell a d deliver to the City un n its
order the .,, C 1-2-3 Liquid Asphalt required in all repairs and
construction work durin.r the remainder of the year 1946, at the
prices and upon the terms set forth in said Company's bid as
follows:
"MC 1-2-3 Liquid Asphalts ;0.0645 per mallon in carload
quantities .o.b. tank cars citd track, Sixth and Campbell
Streets, Ia ducah, Kentucky. Tank cars will be
equipped with steam heater coils and are available in
o,500, 8,000 or 10,000 ,,allon gross capacity. If in-
sulated tank cars are reouired there will be an additional
charve of •;;6.00 per car per trip.
Ashpalts sve propose to furnish will meet requirements of
7-ntucky State Highway.Specifications for respective grades.
Terms: Tlet thirty days."
Payment shall be made by the City not .later than the tenth of
each month for the amount of products sold and delivered Burin-,
the n eeedin.- month.
In consideration of the A_,reement of the City to purchase fron
the Company a'1 of the aforesaid grades of asphalt req;mired
Ourin�7 the rernain"er of the year 1946, the Company agroes that in

the event of a gencral advance in the retail price of asphalt duri
the aforesaid period, the Companyls obli^ation to sell and deliver
asphalt at said price shall remain and continue in full force and
effect, but in the event of a decline in the price of said product
the City shall be given the benefit Of the reduction in price.
SECTION 2.
This ordinance shall be introduced at a regular meeting of
the board of Commissioners and remain on file at least one (1) weel
for public inspection in the completed form in which it shall be pL
upon Its final passage, and if adopted, it shall be in full force a
effect ten (10) days thereafter.
