HomeMy WebLinkAboutOrdinances Book 10, Page 1231, No Resolution Number■ 1- 1. 1 1231 A RESOLUTION AMENDING SECTION 1 OF A RESOLUTION ENTITLED "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AND EXECUTE FOR AND ON BEHALF OF THE CITY OF PADUCAH, A CONTRACT FOR THE EMPLOYMENT OF AN ATTORNEY FOR RECOVERY OF TAXES UPON OMITTED PROPERTY, AND PRESCRIBING THE TERMS AND CONDITIONS TO BE CONTAINED IN SAID CONTRACT", WHICH YJAS ADOPTED BY THE BOARD OF COMIrISSIONERS ON THE 25TH DAY OF MAY, 1943, BY REPEALING, AMENDING, REVISING AND RE-ENACTING SECTION 1 THEREOF BE IT RESOLVED BY THE BOARD OF COLMISSIONERS OF THE CITY OF PADUCAH, IiENTUCKY: SECTION 1. That Section 1 of a resolution entitled: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AND EXECUTE FOR AND ON BEHALF OF THE CITY OF PADUCAH, A CONTRACT FOR THE EMPLOYMENT r OF AN ATTORNEY FOR RECOVERY OF TAXES UPON OMITTED PROPERTY, AND PRESCRIBING THE TERI'::S AND CONDITIONS TO BE Q'ONTAINED IN SAID CONTRACT", Be and the same is hereby amended and re-enacted so that the same as so amended and re-enacted shall read as follows: "Section 1. That the City Manager be and he is hereby authorized to enter into and execute for and on behalf of the City of Paducah a contract with an Attorney for the collection and recovery of any taxes which may be due the City of Paducah upon omitted property. Said Attorney shall institute and prosecute any and all motions, proceedings and actions before any and all Courts or assessing bodies as may be necessary to collect taxes upon property omitted from taxes due the City of Paducah for any year or years. The compensation for his services shall be an amount equal to one-third of whatever taxes, penalties and interest are actually recovered by him or through proceedings instituted or prosecuted by him for the City of Paducah; but the rate of compensa shall attach only to the taxes, interest and penalties and that part of same which belongs to the City and farm a part of its revenue and income, but s1hall not attach to any taxes, penalties and interest recovered for, the benefit of the Board of Education or the Sinking Funds, or for any other independent or separate purposes where the city itself is required to collect and pay over such taxes for such independent agencies or purposes." SECTION 2. All resolutions and parts of resolutions in conflict herewith are to the extent of such conflict hereby repealed. SECTION 3.
