AN ORDINANCE APPROPRIATING THE FURTHER SUM OF $1200.00
TO THE ELECTRIC PLANT BOARD OF THE CITY OF PADUCAH TO PAY THE
EXPENSES INCURRED BY SAID BOARD FOR THE SERVICES OF AN ATTORNEY
REQUIRED IN CONNECTION WITH THE ACQUISITION CF THE ELECTRIC
UTILITY SYSTEM OF THE KENTUCKY UTILITIES COMPANY, AND PROVIDING
FOR THE REPAYMENT OF SAID SUM TO THE CITY OF PADUCAH FROM THE
PROCEEDS DERIVED FROM THE SALE OF BONDS ISSUED TO FINANCE THE
PURCHASE OF SAID SYSTEM;
WHEREAS, under an ordinance adopted by the Board of
Commissioners on March 20th, 1945, the sum of j1200.00 was
appropriated to the Electric Plant Board of the City of Paducah
fbr payment of the fees of its attorneys, WAller & Threlkeld,
for the prosecution of an action against the Kentucky Utilities
Company to require said company to comply with its electric utili
franchise by appointing an appraiser, as well as with all other
provisions of said franchise under which the City of Paducah
reserved the right and option to purchase said company's electric
properties in Paducah, Kentucky; and,
WHEREAS, said S14ctric Plant Board has paid to its
attorneys the sugi of $1200.00 for services rendered by them for
the period beginning March 23rd, 1945 and ending June 23rd, 1945;
and,
WHEREAS, said alectric Plant Board has requested a further
appropriation in the sum of $1200.00 to continue the employment of
said attorneys for a further period of three months, covering the
period from June 23rd to July 26rd, 1945, and from August 23rd to
October 23rd, 1945, no charge having been made by attorneys for
services rendered by them for the period from July 23rd to >iugust
23rd, 1945; and,
WHEREAS, said suit is now pending in the Countrof Appeals
and it is deemed advisable to comply with said boardIs request by
appropriating the additional sum of $1200.00 in order that said
board may continue the employment of its attorneys for a further
period of three (3) months.
NO'S"! THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSI
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That the additional sum of $1200.00 be, and the same
ds hereby appropriated to the Electric Plant Board of the City
of Paducah for the purpose of paying the expenses incurred by it
for the services of an attorney required in connection with the
acquisition of the electric utility system of the Kentucky
Utilities Company, and the amount so appropriated shall be

charged to the contingent fund. Said sum shall be considered
a temporary loan to the Electric Plant Board and shall be
repaid immediately upon the sale and delivery of bonds which are
to be issued for the purpose of purchasing said system.
SECTION 2.
This ordinance shall, after its introduction and before its
adoption, remain on file at least one week for public insoection n
the completed form in which it shall be put upon its final passag ,
and if adopted, it shall not go into effect until the expiration f
ten days from and after its adoption.
