CRACKEN COUNTY, KENTUCKY FOR THE PORTION OF THE COST OF CONSTRUCTI SAID STREET AND IMPROVEMENT THEREOF, BY THE PLACING THEREIN AND HEREON OF A CONCRETE SURFACE TOGETHER ."JITH ALL MANHOLES, INTAKES, ATCH BASINS, SEWER AND DRAIN PIPES AND ALL NECESSARY ENGINEERING, DVER'(�SING AND LEGAL AND CLERICAL SERVICES IN CONNECTION THERE';lITH NDER THE PROVISIONS OF AN ACT OF THE GENERAL ASSEI.'BLY OF THE COId— T401,1';VEALTH OF KENTUCKY ADOPTED AT ITS REGULAR SESSION IN 1939, PROVID— ING FOR THE II.'PROVELTENT OF PUBLIC iIrAYS IN CITIES OF THE SECOND CLASS BY AID OF THE WORKS PROGRESS ADMINISTRATION OR OTHER AGENCIES OF THE OR STATE GOVERIU NT, AND AT THE EXCLUSIVE COST OF THE 07NERS OF REAL ESTATE ABUTTING ON SUCH II,:PROVEMENT ACCORDING "'0 THE NMIBER FRONT OR ABUTTING FEET, AND PROVIDING THAT A TAX SHALL BE LEVIED SAID LOTS OR PARCELS OF REAL ESTATE FOR THE PAYMENT OF TIIE COST THEREON, WHICH COST SHALL BE THE DIFFERENCE BETE"TEEN THE AL CONT OF COMPLETING SAID IMPROVEMENTS AND THE TOTAL AMOUNT OF CONTRIBUTION OF THE 'sIORKS PROGRESS ADMINISTRATION OR OTHER AGEN— IES OF THE FEDERAL OR STATE GOVERNMENT ENGAGED IN MAKING SAID , AND WHICH TAXES SHALL BE DUE AND PAYABLE AT THE OFFICE �JOF THE CIRY TREASURER IN THE CITY OF PADUCAH, KENTUCKY: AND ALL WORK VING BEEN COMPLETED AND THE ESTIMATED COST ASCERTAINED, AND IT TEIU41NED FROM SAID ESTIMATES AFTER DEDUCTING THE AIJOUNT TO BE CON— BY THE WORKS PROGRESS ADMINISTRATION OF THE UNITED STATES THE AMOUNT REQUIRED TO BE CONTRIBUTED BY THE ABUTTING PROPERTY S IS 02.15 PER ABUTTING FOOT, and WHEREAS, the Board of Commissioners has heretofore adopted ordinance providing for the construction and reconstruction of said driveway under the terms of said Act aforesaid, and pursuant to its provisions, and WHEREAS, work of said improved street has been half com- eted, and hereby declared by the Board of Commissioners to have en half completed on and before this date, and the estimated cost thereof is now due to be paid to the City Treasurer, and the .first (half thereof having been assessed at the time of commencement of said . work and the last half is due to be assessed when the work is half completed, NOW, THEREFORE, BE IT ORDAINED SY THE BOARD OF COMI'IS3ION�i3 OF qHE ITY OF PADUCAH, KENTUCKY: Page 110 SECTION 1. That all of the property on both sides of Harrison Street from the East property line of 3rd street to the East property line of 4th j Street and from the west property line of Sth Street to the East property, i line of 21st Street, excluding intersections at 9th, 13th, 16th & 17th Streets in the City of Paducah, McCracken County, Ken tacky, as shown by estimates on file in the Engineers office in the City Hall in the City of Paducah, Kentucky be and the same is hereby assessed for the cost of con- struction of said paved street with all necessary manholes, intakes, catch basins, sewer and drain pipes and all necessary engineering, adver- tising and legal and clerical services in connection therewith, the por- tion of said cost of improvement required to be paid by said property owners the following amount per front foot, to -wit: Total cost against the property owners $2.15 per abutting foot; that all of said estimates are on file in the office of the Engineering Department in the City Hall, and are referred to and made a part hereof. SECTION 2. That one-half of said assessments as against each lot as shown by said assessment and estimate of said engineer was due at the commence- ment of said work and has heretofore been assessed, and the Board of Commissioners having by this ordinance determined that said work has been half completed, and the last half of said assessment is now due to be paid, said last half shall be paid within 10 days after the adoption of this ordinance and unless so paid there shall be added thereto a penalty of 6% and a lien is declared to exist upon said lots and parcels of real estate for the proportionate cost of said improvements so assessed as herein provided in addition to the assessment for the first half of the cost thereof as hereinbefore made; and the amount of said assessment shall bear interest upon any part thereof that remains unpaid for 10 days after the same is due to be paid as herein provided at the rate of 6% per annum in addition to the penalty aforesaid, which lien shall be superior to all other liens except the liens for State, County and City taxes. SECTION 3. The publication of this ordinance shall be notice to all persons interested and due to pay said assessment, of the time and place to pay the same. Said assessment will be paid within ten (10) days from the publication of this ordinance. SECTION 4. This ordinance shall be in full force and effect from and after its adoption. - —Mayo pro t- — R.
