BE IT ORDAINED BY THE BOARD OF COMMISSIONER" OF THE CITY
OF PADUCAIT, KENTUCKY:
SECTION 1.
That the driveway on 1,7ashington Street, from the '.Nest
property line of IIineteenth Street to the East curb line of
Twenty-first Street, in the City of Paducah, Kentucky, with all
necessary manholes, intakes, catch basins and server pipe connection:
and all necessary engineering, advertising and legal and'elerical
service in connection therewith, be and the same is hereby ordered
to be constructed and re -constructed with gravel, upon bids made
therefor, and all to be done in strict accordance with the plana,
specifications, grades, width, profiles and drawings of the
Commissioner of Public Works prepared by him for such purposes; all
of which are hereby adopted as a part of this ordinance as fully
as if embraced herein or attached hereto and made part hereof
and marked "A" for more specific identification.
SECTION 2.
That said r:ork shall be constructed under the direction
and supervision of the Commissioner of Public 'c']orks, and shall be
commenced at a time designated by contract for the performance of
said work, and completed on or before eight months after the
passage and recording of this ordinance.
SECTION 3.
That all the cost incident to said construction of said
street, as provided in Section 1 hereof, shall be paid for wholly
by the nroperty ovmers and property abutting or fronting thereon
on both sides of said street add to be apportioned to and assessed
against the property owners and property abutting thereon on both
sides of said street according to the numc'er of feet or abutting
feet thereon, except that the City of Paducah shall nay such
portion of cost of construction as reouibed by law.
SECTION A.
The contractor awarded the contract for the cork herein
provided for shall be paid only from the funds arising from the

Special Tax Bills and assessments against the property abutting the
improvement herein provided for, and in no other way, except that the
said contractor may be paid out of such bonds as may be issued, in
accordance r:ith the law of the City of Paducah and charter cities of the
second class of the State of Kentucky, and for the payment of which,
said tax bills and assessments may be pledged by the said City of
Paducah; and in no event shall the said city of Paducah be liable to the
contractor for the construction of any of the work herein provided for,
except the said City of Paducah shall be .liable to the said contractor
for the excess of fifty (50%) per cent of the value of any property
assessed for the construction of the work herein provided for.
SECTION 5.
The contractor ae:arded the contract herein provided for
shall be paid monthly by Improvement ''!aa -rants issued by the City of
Paducah upon estimates furnished by the Commissioner of Public llorks,
to the extent of (65/5) per cent of the value of the work done or
materials furnished by the contractor during the progress of the aotk,
and said Improvement ':larrants chzli bear interest at six (6`•,) per cent
from date of issual and shall be issued by the Commissioner of Public
Finance upon order of the Board of Commissioners. Said Improve^ient
'.'.arrants shall be negotiable, and shall constitute a lien upon the local
tares to be hereafter levied for such improvement, and shall be payable
at the office of the Commissioner of Public Finance, without notice to
the holder thereof, upon completion and acceptance of the work herein
provided for, out of the first collection of such local taxes, or out
of the proceeds of the sale of any Improvement Eonds issued in antic-
upation of such local taxes. The interest on such Improvement Flarrants
shall be estimated and asses:.ed as a part of the cost of the improvement
:herein urovided for.
SrCTIOH 6.
The ;:-avor• is hereby authorized and directed to execute
all eiritten contracts and bonds with the successful bidJer for the
construction of said improvement, es required by law.
2ECTION 7.
Bids shall be received for the construction of said work
according to the plans and specifications made and provided therefor
by the Commissioner of Pub'.ic .!orks and reported to the Board of Com-
missioners at the next regular or called meeting, and sward the contract
thereforq. to the lowest and best bi(''er, except that the right is ex-
pressly reserved to reject any and nll bids zaitbin the discretion of sal
Board of Commissioners.
