HomeMy WebLinkAboutOrdinances Book 9, Page 947, No Ordinance Numberi - Page 947 `J AN ORDINANCE REGULATING THE SALE OF BEER AND LIGHT 1' WINES IN THE CITY OF PADUCAH, KENTUCKY AND PROVIDING A LICEFSE TBEREFOR, AND PROVIDING FOR REVOCATION OF SUCH LICENSE UNDER CERTAIN CONDITIONS, AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE BOARD OF COLP'ISSIONERS OF THE CI^1Y OF PADUCAH, KENTUCKY: SECTION 1. Every person, firm or corporation desiring to dispense or sell at retail, beer or light urines within the City of Paducah, �a�1$ � 1 Kentucky, as the same is defined and described in an Act A' entitled, "AN ACT TO PROVIDE REVENUE BY THE TAXATION OF CERTAIN U NON -INTOXICATING LIQUOR AND FOR OTHER PURPOSES", which was A adopted by the 73rd Congress of the United States and duly signed by the President on the 22nd day of March, 1933, shall make application to the Board of Commissioners of the City of Paducah, designating the name of the applicant and the place where said business is to be conducted; and unless it shall appear to the Board of Commissioners that said applicant is not conducting a decent and orderly place of business, or has I within twelve months prior thereto been convicted of a violation of any criminal or penal laws within the City of Paducah, said apDlication shall be granted, and thereupon the applicant may II procure from the City Treasurer a license authorizing the carrying on of such business, and for vrhich license he shall pay the sum of $ 30.00 per year, payable in semi-annual install- ments of $ 15.00 each on the 1st day of January and the 1st day of July. For any license issued for a less period of time than six (6) months, there shall be paid the sum of yr 15.00, and no person shall engage in such business as herein contemplated, until he shall have first procured his license as herein Drovided. Said .license may be revoked for a violation of any of the provisions of this' Ordinance. i SECTION 2. it Every person, firm or corporation desiring to sell, dispense'or distribute at r:holesale; beer or light wines, as defined in Section 1, hereof, to Retail Dealers, shall make application to the Board of Commissioners for a distributors .license, designating the name of the applicant and the place where or from which said business is to be conducted, and unless it shall appear to the satisfaction of the Board of Commissioners j that said applicant has not conducted his business in a decent and orderly manner, or has within helve mo' prior thereto 0 Pane 948 been convicted of a violation of any criminal or Penal laws wfithir the City of Paducah, then said application shall be granted, and thereupon said applicant may procure a license upon payment to the City Treasurer of an annual license fee of �'' 150.00, payable in semi-annual installments of � 75.00 each on the lst day of January and the 1st day of July. For -any license issued under this section for a period of less than six (G) months, there shall be paid a fee of � 75.00. No person shall engage in business under the provisions of this Section until he has first Procured the license as herein provided; said license may be revoked for any violation of the provisions of this ordLnance. SECTION 3. It appearing to the satisfaction of the Board of Commissioners that in many instances, persons conducting the business of selling beer and light wines, permit -or allow disorderly conduct in andkabout said place of business to be carried on by persons visiting, patronizing or being in or around such place of business, and to thus disturb and violate the good order of the community ,%here said businesses are conducted, it is deemed and hereby declared by the Board of Commissioners to be to the interest of the public welfare, that licenses should not be granted to persons known to be disorderly, or known to conduct disorderly places of business, or who are known to promote, encourage or engage in disorderly conduct in or around their places of business; and it is in the interest of the public welfare that no licenses should be granted to such persons known to be disorderly or to conduct indecent or disorderly places of business, or whose criminal records are such J as to make it unsafe or undesirable for them to engage in the business of selling beer and light wines as contemplated in this ordinance. SECTION 4. No dispenser shall sell be,r or light wines behind blinds or screens but the business of dispensing and selling within zhe meaning of this ordinance shall be conducted openly without any attempt to hide or screen it from public view. SECTION 5. Every person, firm or corporation procuring a license to dispense or sell beer or .light wines under this ordinance shall) be reruired to conduct said business in a decent and orderly manner and the right is reserved by the Board of Commissioners of II the City of Paducah, Kentucky to revolve the license of any licensee upon violation of this section. Page 949 SECTION 6. All ordinances or parts of ordinances now in effect which conflict with this ordinance are hereby repealed but only insofar as they conflict with this ordinance, but this ordinance shall not be construed as repealing any part of the General License Ordinance which seas adopted by the Board of Commissioners on December 24th, 1934, but this shall be treated as additional and supplemental thereto, and this ordinance shall automotically repeal an ordinance approved by the Board of Commissioners on the 3rd day of April, 1933, bearing a title in the terms of the title of this ordinance, and which repeal shall be effective as of the 1st day of July, 1935. SECTION 7. Any person, firm or corporation who shall violate any provision of this ordinance shall upon conviction in the police court of the City of Paducah, Kentucky, be fined not less than 25.00 nor more than y 100.00 for each offense, and all license fees collected hereunder shall inure to the benefit of the General Funds of the City of Paducah, to be appropriated and used for General Public Purposes.
