HomeMy WebLinkAboutOrdinances Book 9, Page 923, No Ordinance NumberPage 9"c l AN ORDINANCE REGULATING THE RUNNING AT LARGE OF DOGS, PROHIBITING OWNERS TI1EREOF FR0::1 ALLO!r;ING SUCH DOGS TO BE AT LARGE, PROVIDING FOR RESTRAINING AND DESTRUCTION OF SUCH DOGS '::HEN AT LARGE CONTRARY TO THE PROVISIONS OF THIS AND I::IPOSING PENALTIES ON 071NERS OR 7 FPERS THEREOF FOR VIOLATION OF THIS ORDINANCE. BE IT ORDAINED BY THE BOARD OF COMIISSIOHERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It shall be unlawful for any dog either licensed or unlicensed to be at large and not restrained or confined in an enclosure unless and until such dog shall first be inoculated for rabies. Any owner or keeper of any dog who has paid the city license tag thereon shall, upon producing receipt for such license tar, be entitled to have such dog inocluated for rabies by the City Veterinarian or Live Stoc1; Inspector ;ithout cost, and any such dog so _noculated shall be certified by a receipt or certificate from suc`: Veterinarian or Live Stoc._ Inspector of the City of Paducah which shall be delivered to suc'.a ovmer or eeper of such dog, and which.certificate or receipt shall be conclusive evidence for twelve (12) months from the date thereof that such dog has been immunized against rabies, and such dog will not be subject to the :enalties herein provided. Should the o:ner or keeper of such dog prefer to have the dog muzzled, such dog vill be perm -it -'.:d to wear a muzzle of a. kind v:hich must be examined -,nd.approved by the City Veterinarian or Live Stock Inspector and a certificate or recent or approval of such muzzle s`.all be first ;>rocured .by the owner or keeper of such dog before the dog shall be permitted to be at large or v.•ithout an enclosure, and no such dog shall be permitted at large or without an enclosure without wearing such muzzle securely fastened in such a way as to render it impo.sible for him to attack or bite any person or any animal. No dog either inoculated or muzzled and -hich is knor;n to be dangerous or vicious shall be permitted to run at large. SECTION 2. All dogs found at large contrary to the prov_s`:.ons of this Ordinance shall be subject to be seized and impounded by the City of Paducah, and such dogs not clai.::ed, and Waose release has not been procured shall be subject to be destroyed in such manner ac :hey be deterwined b,- the City Veter l.nar ian a Page 924 or Live Stock Inspector, and no such dogs shall be released until its license tax has been paid and it has been inocluated or irr_lunized against rabies or a muzzle procured as herein provided. All muzzles for dogs shall be procured at the expense of the owners or keepers thereof, and the City shall in no event be responsible or liable for the cost or expense of such muzzle. .For the purpose of carrying' this ordinance into effect, any police officer or any person especially employed or appointed for that :)urnose may seize and im?ound any do - found at large in violation of the 7rovisions of this ordinance. SECTION S. Any person being the os.ner or kk_ee;'er of any dog in violation of any of the provisions of this ordinance, and litho permits or allows the same to be at large in violation of the provisions of this ordinance, or fails to restrain or kee) confined any do in violation of the provis=ons of this ordinance shall upon conviction be fined not less than N 5.00 _.Or more than ti: 100.00. All fends derived from fines under the provisions of this ordinance shall be covered into the Tre-.sury of the City and shall be used in its General Fund for public purposes. Provided, however, any licensed Veterin^.rian may inoculate a dog as re,.;uired by this Ordinance and ':is certificate of successful inoculation shall entitle the owner or 'keeper of such do; to receive a tag as provided in Section 4 hereof. SECTION 4. When any oe:ner or ,eeper has had such dog inoculated as provided Zn Section 1 hereof, in addit'.on to the receipt o ' r certificate of such inoculation furn.isiied to such oi;-ner cr I keeper, the City Veterinarian or Live Stock Inspector shall � also furnish to such orner or '.ieeper of such dog a tag which shall be securely fastened to a collar and shall be worn by such dog continuously, and the failure to have such tag so I attached to such dog shall subject the o-:.ner or keeper thereof i to the penalties provided :in Section 5 hereof.
