HomeMy WebLinkAboutOrdinances Book 9, Page 885, No Ordinance NumberPage 885 AN ORDINANCE CORRECTING AN ASSESSMENT AGAINST LOTS #27 AND YF28 OF HARRIS, FLOURNOY, NORTON AND TRIT:IBLE ADDITIONS TO THE CITY OF PADUCAH, FOR THE COST OF HARD -SURFACE I-_4PROVEiiENT OF SAID STREET, UNDER AN ORDINANCE ASSESSING THE COST THEREOF AT 5.120066 PER LINEAR FOOT ON EACH SIDE OF SAID STREET, WHICH WAS ADOPTED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, SEPTEMBER 16, 1927, AND APPROVED BY THE ILPLYOR AND PUBLISHED AS IN ALL RESPECTS REQUIRED BY LAWn WHEREAS, the Engineer's estimate of the cost of hard - surface on Bernheim Avenue from Twelfth Street to Thirteenth Street in the year'1927, provided that the total cost of said construction against lots #27 and #28 abutting upon said improved street on the North side thereof amounted to $ 902.00. and WHEREAS, the amount of said improved street abutting upon lot ##27 was 102.58 feet and the cost thereof was $ 525.24, and the number of abutting feet of lot r28 was 73.58 feet, and the cost thereof was 40376,76, and WHEREAS, the owners thereof, to wit, A.E. Russell and wife Maie Russell elected to take and pay said improvement upon the ten year plan and signed their agreement in the office of the Treasurer of said City for said purpose, and the owners of said lots having now discovered that said assessment was made jointly against said two lots and they desire that the amount thereof'be separated so that the amount of said assessment as originally made against lot #V27 should be $ 525.24 and the amount against lot x-`28 should be $376.76. I NOW, THEREFORE, BE IT ORDAINED BY TIM BOARD OF COTZIISSIONERS OF THE CITY OF PADUCAH, KENTUCKY. SECTION 1. That the City Treasurer be, and is hereby authorized, v empowered and directed to correct and separate the improvement tax bills against lots x'27 and #28 abutting on Bernheim Avenue on the North side thereof for Street Improvements made in the year 1927, so that the amount of said 'tax bills as so corrected will be separated as against each of said lots, and that said two bills shall respectively be as follows: The amount assessed against lot #r27 $ 525.24, the amount assessed against lot #.28 $376.76, provided however, that all payments heretofore made on principal and interest of said tax bills as originally made I shall be ratably and proportionably apportioned to two said .lots I ' in apportion to the amount of said two separate assessments, and Page 886 the balance shall be the correct amount remaining unpaid under said Assessment Ordinance against said respective lots and protected in all respects by the provisions of said Assessment Ordinance and by the Statute .laws in such case made and. provided, and for the purpose of carrying into effect the object of this Ordinance the City Treasurer is authorized and empowered to make all corrections and changes required hereby in said tax bills.
