HomeMy WebLinkAboutOrdinances Book 9, Page 842, No Ordinance Number'r Page 842 1 k l e Id -.9 -/' .S'a 4t/Pt-v- /4 �rvuu-b� W/e 6t? ...5/ 9 AN ORDINANCE CREATING A LEGAL DEPARTMENT AND PROVIDIIIG FOR THE APPOINTWI 11T OF A DIRECTOR THEREOF WHO SHALT, BE STYLED CORPORATION COUNSEL, AND FOR THE APPOINTMENT OF AN AS ISTAidT CORPORATION COUNSEL, AND PRESCRIBING THEIR DUTIES: AND REPEALING ALL ORDINANCES IN CONFLICT HERF'7ITH. BE IT :ORDAINED BY THE BOARD OF CWl ISSIONERS OF TIME CITY` OF PADUCAH, KENTUCKY. SECTION 1. There is hereby created and established a department to be known as the T,egal Department of the City of Paducah. The director of said department shall be styled Corporation Counsel, who shall be in charge of said Legal Department. There shall also be appointed an Assistant Corporation Counsel. Both the Corporation Counsel and the Assistant Corporation Counsel shall be regularly admitted and practicing Attorneys -at -Law. The Corporation Counsel shall appear for the City arV attend all cues in the Circuit Court:, the Court of Appeals of Kentucky, and the Federal Courts, wherein the City of Paducah may be a party complainant or defendant, or a party in interest; and he shall give advice to any and all city officials, and when requested by the City Manager or by any member of the Board of Commissioners, he shall attend the meetings of the Board of Commissioners, and he shall supervise and rmepare all contracts to which the City may be a party. The Assistant Corporation Counsel shall appear for the City in all cases in the Police Court, and shall prosecute or i defend on behalf of the City all appeals from the decisions of said court, in which the City may be a party, or is in any way interested. He shall have charge of all actions for the collection of delinquent taxes, and shall give all notices and make all demands required in the enforcement of delinquent tax claims, and shall promptly., as and when collected, immediately f turn into the treasury all funds and collections coming into his hands as such delinquent tax collector. The City Manager is authorized to appoint a Corporation Counsel and an Assistant Corporation Counsel, and to Drovide for such clerical assistance in the performance of the duties of said employees as may be found to be nece:,�-,ary to the efficient handling of said department. SECTION 2. All ordinances and parts of ordinances in conflict with the provisions of this ordinance hre hereby repealed. It is Page 843 the purpose of this ordinance to establish a department in which all legal matters and all legal services, for and on behalf of the City of Paducah, may be handled and controlled; and all legal services for and on behalf of said City shall be handled through said department, and by the director and assistant hereby established.
