BE IT ORDAINED BY THP' BOARD OF CMH,1ISSIONERS OF THE CITY OF PADUCAH, K)NTUCKY; SECTION 1. That on and after the first day of January 1933, and on the same day in each succeeding year hereafter, it shall be unlawful for any person, firm, co*npany or corporation to engage in any business, occupation, profession, trade or call- ing hereinafter mentioned, in the City of Paducah, Kentucky, until such person, firm, company or corporation have first paid the amount of license tax to the Commissioner of Public Finance and have obtained from him .license as hereinafter specified and required; if any such license tax be not so paid and the license procured on or before the first day of February in each year hereafter, there shall be added to such license tax a panelty of Ten (10) per centum thereof, and any and all such persons, firms, companies or corporations paying, or offering to pay such license taxes after same have been delinquent, shall also pay said Ten (10) per cent penalty thereon; provided, that such penalty shall not be added to any such license tax where the perons, firm, company or corporation, so liable for same, shall not be engaged in business, occupation, profession, trade or calling in said City until after the first day of February in the year in which said license tax shall be due and payable. Said license taxes and penalties may be recovered as other delinquent taxes. I All such licenses shall have printed or stamped on the face of s -me, in large figures, the year for .^ihich same are issued,- and it shall be the duty of the persons procuring or having such license to keep same posted or otherwise exposed I in some conspicuous place in his or their place of business, where the same shall at all times, be within the public vievi. i Page 746 No person, firm, company or corporation to whom any license is issued as herein provided for, shall be authorized. to do any business thereunder, other than that specified in such license. SECTION 2. Each license shall state the name of the person, firm, eomoany or corporation to whom it is issued, and no such license shall be assignable or transferable, nor shall any' such license authorize any person, firm, company or corporation, other than the one mentioned in the .license, to do any business, or to follow any occupation, profession, trade or calling other than that provided in such license. SECTIN,T 3. All licenses granted under this ordinance, except as otherwise herein provided shall expire on the 31st day- of December of each and every ,year, and no license, except as otherwise herein provided, shall be issued for a .less period of time than one month nor for a fractional part of a month, nor for a less fee than One 0:1.00) Dollars. No porti^n of any license tax shall be refunded to any person, firm company or corporation, or to anyone else for their use or benefit. SECTION 4. An advertisement of any kind by any person, firm, company or corporation, that he, they or it, is engaged in any calling, occupation, trade, business or profession, for the carrying on of which a license is required under this ordinance, shall be conclusive evidence of the liability of such person, firm, company or corporation for such license tax as provided by this ordinance. SECTION 5. Every person, firm, company or corporation desiring to procure a license, as herein provided, shall when required, make application in writing to the Commissioner of Public Finance, giving and disclosing the information necessary to enable the Commissioner of Public Finance to determine the amount of license tax to be paid, the character of business to be conducted, and such other facts as may be necessary or proper to determine whether the applicant for such .license shall be granted the license aoolied for, and in order to ascertain any facts necessary to detcrmine the amount of license tax to be paid the Commissioner of Public Finance may renuire each applicant, 80 applying to furnish such information, under Page 747 oath, as may be so required. STICTION 6. Upon violation of any provision of this ordinance by any person, firm, company or corooration holding a license to engage in any business, occupation, profession, trade or calling, as herein provided, such license may be revoked by the Board of Commissioners. SECTION 7. Each person, firm, company or corporation, carrying on or conducting any business, trade, occupation, employment or profession, for which a license is required under the provisions of this ordinance, or any other ordinance not repealed by this ordinance, v✓here a fine has not been provided for, without first having obtained a license to carry on and conduct such business, trade, -occupation, employment or profession, shall be guilty of a misdemeanor; and upon conviction of_the Police Court of the City of Paducah, shall be fined not less than Five (X5.00) Dollars nor more than Twenty (x$20.00) Dollars, and eadh day that such business, trade, occupation, employment or profession is carried on without such license shall be'considered a separate offense. SECTION 8. Every person, firm, company or corporation, before engaging in any business, occupation, profession, trade or calling, hereinafter mentioned and described, shall pay the license tax hereinafter provided, and set opposite the name of the business, occupation, profession, trade or calling. Any person, firm or corporation engaged in the business•of soliciting, placing or writing any forms of insurance shall be deemed an agent, broker, or solicitor and shall pal the above license independent of any.and all -licenses or fees which may be paid by the Company or Companies represented by him or them. This does not include solicitors engaged by Insurance Companies writing industrial insruance in the City of Paducah, Kentucky. Insurance, Fire Insurance Company Every fire insurance company doing business in this City shall, on the 31st day of December in each year, or :within thirty days thereafter, return to the Commissioner of Public Finance for depsit, a statement, under oath, of all premiums received in this city during the year ending on the 31st day of December, and sbsll at the same time, pay into the City Treasury a tax of Two Dollars upon each One Hundred Dollars of said premiums so ascertained, less return premiums allowed on cancelled policies, and any fire insurance company doing also a Tornado, Wind or Cyclone business, shall include in the statement above referred to, the prewiums received for such business, and the same shall be included in the total business and the tax paid on same, as above set out; provided, h awever, that the minimum tax under this Section shall be Twenty Five Dollars. Any company failing or refusing for thirty days, to return the statement required under the oath of some principal officer or local agent, and to pay the tax herein required, shall forfeit Fifty Dollars for each offense. And the Board of. Commissioners may revoke the license of such Company A.iithout notice. Page 751 10.00 100.00 50.00 10.00 50.00 50.00 100.00 15.00 5.00 25.00 50.00 50.00 10.00 25.00 Page 752 Insurance, Mutual or Reciprocal Fire Insurance Companies Every Reciprocal Mutual and every other similar kind of insurance company, corporation, firm or :association, exchange or concern writing any insurance in the City of Paducah, Kentucky, and which has received premiums on risks written in said City, shall file a sworn statement either by the Manager or the President or Secretary of such insurance company, corporation, firm association, exchange or by the local resident agent thereof, shwoing the various lines written and declaring the net premiums received. Such sworn statement shall be made within thirty days after the 31st day of December in each year, to the Commissioner of Piiblid Finance of the City of Paducah, Kentucky, and•shall at the same time ppay into the City Treasury a tax of Sj 2,00 upon each $100.00 of said uremiums.so ascertained less returned premiums allowed on cancelled policies. The term premium as used herein shall include all payments in whatever form collected or paid, made or received for any character•of insurance of similar protection named in this ordinance. The minimum tax under this ordinance shall be ^ 25.00. Any Reciprocal Mutual Company, Corporation, firm, association, exchange or concern failing or refusing for thirty days to return the statement required to be filed as set out herein and failing topaythe tax required herein, shall forfeit 50.00 for each and every offense and the Board of Commissioners may revoke the license of such company, corporation, firm, association, exchange or concern without notice. Insurance, Mutual or Reciprocal Indemnity Companies 50.00 It shall be the duty of each Reciprocal, Mutual or Indemnity Company, firm or Corporation which has received premiums on risks in the City of Paducah, Kentucky, to file a sworn statement by the Manager or President or Secretary of such_company, corporation, firm association, exchange or concern or by the local resident agent thereof, showing the various lines written and setting out the net premiums received; such sworn statement shall be made within thirty days after the 31st day of December in each year to the Commissioner of Public Finance of the City of Paducah, Kentucky, and such statement shall be accompanied by the tax of 50.00. The term premium as used here shall include all payments in whatever form collected, paid or received. It shall be the duty of each person, firm, company or corporation, owning any dog or dogs, after paying the license tax herein required, to apply to -the Commissioner of Public Finance for a numbered dog tag, which tag shall be placed upon a collar or otherwise securely fastened about the neck of such dog or dogs. SECTION 10. No license herein provided for shall authorize or entitle any holder hereof to conduct any business, or to engage in any occupation profession, trade or calling, in any manner or at any time. in violation of any ordinance of the City of Paducah, or of any law of the State of Kentucky or of the United State. SECTION 11. If any person, firm company or corporation shall misrepresent any material fact as to the nature of business in his application for such license, or any other fact necessary or proper to determine the amount of the license tax to be charged or paid, such license so procured by reason of such misrepresentation may be revoked by the Board of Commissioners at any time. SECTION 12. All moneys derived from license taxes under the provisions of this ordinance shall be paid .to the City Treasury and olaced to the credit of the Gencral Revenue Fund of the City of Paducah, and shall be used and exuended in defraying the Pnge 757 current and incidental expenses of said City. SECTION 13. Should any section, or part of section or any provision of this ordinance be declared by the courts, for any reason, to be invalid, such decision shall not affect the validity of this ordinance as a whole, or any part thereof, other than the particular section or provision of the ordinance so held or declared to be invalid. SECTION 14. All ordinances and parts of ordinances which have been heretofore adopted in conflict herewith are, 'to the extent of such conflict, hereby repealed, but this ordinanpe shall not be construed as repealing any provision or provisions for .licenses or license fees or license taxes contained in any other existing ordinance or ordinances of the City of. Paducah, or'" providing for any license or the payment of any license fee on any business, trade, profession, or occupation not herein specifically provided for. SECTION 15.
