V,MRrAS, there has been commenced in the
Mo Cracken Circ^.it Court an action by the State of Kentucky and
McCracken County to subject the properties of the ?later ,'forks of '
Paducah to claims for taxes, penalties and interest for the
year 1931; and,
NIM -REAS, Said Dilater Works were conveyed to
the City of Paducah under an arrangement and existing ordinances
by which the properties, management, control and supervision of
said Water Works, together with the collection and disbursment
of all moneys and income were entrusted to a board to be known as
Comriissionr-rs of `.'later ':forks; and said management is a sort of
quasi -corporation and being operated separately from the City
Government; and said litigation aforesaid can impose no liability
upon the City of Paducah or its income or revenues; and it is the
duty of the Commissioners of :'later Works to take care of the
properties and rights of the Cater Works, -
I, now, move that the Commissioners of Water
Corks be instructed and empowered to take all necessary steps in
the defense of said tax suit aforesaid, and to employ such
counsel or other assistance as may be necessary , in the defence
of said suit, and to pay for'same out of their regular revenue
helLd for operating expenses; but no part of'said expenses or fees
shall be charged against the City of Paducah, or payable out of
the City Revenue.
