STRUCTION OF SAID STREET BY GRADING AND GRAVELING, AND PROVIDING

ENGINEERING BE CHARGEABLE TO AND ASSESSED AGAINST THE PROPERTY
RECEIVING THE BENEFIT OF SAME, AS SHOWN BY THE ENGINEERIS ESTILATE
AND ON FILF IN THE OFFICE OF THE COMMISSIONER OF PUBLIC WORKS,
AND PROVIDING THAT SAID ASSESSMENT MAY BE PAID IN TEN EQUAL INSTALL-
tMITS, BEING OTTE EACH YEAR FOR A PERIOD OF TEN YEARS:
WHEREAS, the General Council of the City of Paducah,
Kentucky, has heretofore, to -wit: on the day of 1926,
adopted an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE
IMPROWMENT OF CLARK STREET FROM THE EAST PROPERTY LINE OF 19TH
STREET TO THE 7/EST PROPERTY LINE OF 17TH STREET, AND THENCE ON
CLARK STREET FROV THE EAST PROPFP.TY LINE OF 17TH STREET TO THE WEST
PROPERTY LINE OF THE NE'.' STREET THAT IS BEING BUILT BY THE ILLINOIS
CENTRAL RBILROAD COMPANY', IN THE CITY OF PADUCAH, KL•NTUCKY, BY
GRADING AND GRAVELING OF'SAME, TOGETHER 1.7ITH ALL NECESSARY LMITHOTyES,
INTAKES, CATCH, BASINS AND SE71P PIPE CONNECTIONS, IN ACCORDANCE

And also adopted an ordinance on the day of

25TH STREET, IN IRR CITY OF PADUCAH, KENTUCKY,BY GRADING AND GRAVFLING
OF S0.ME, TOGETHFR ':',ITA ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS
AND 5:7, -LR PIPE CONVECTIONS, IN ACCORDANCE "ITH THE PL".NS AND `PECIP'ICATIG✓
NS PROVIDED THER?FOR BY THE CITY ENGINEER, AT THE COST Or THE ABUTTING
PROPERTY O'"iTERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY

and
WHEREAS, in accordance with said ordinances, it was provided
that the cost of the construction of seid street be paid for by the
abutting property owners on both sides thereof, except that portion to
be paid by the City of Paducah, as required by law; and
MERFAS, pursuant to said -ordinances a contract was entered
into on the dny of 1926, between E.L Foss, Con-
tractor, and the City of Paducah, Kentucky, for the construction thereof:
and
77HERLAS, said contract has in all respects been completed
and the work thereof finished and accepted by the Board of Commissioners
of the City of Paducah, Kentudky on the 25th day of April, 1928, pur-
suant to the recommendation made therefor by the Commissioner of Public
Works of the City of Paducah, Kentucky, and pursuant to a motion made
by said Commissioner, which motion was duly adopted by the BOard of
Co-missioners; NMI, THEREFORE,
BE IT ORDAINED BY THE BOARD OF COLU,TISSIOITERS OF THE CITY
OF PADUCAH, KENTUCKY:
SECTION 1.
That all of the property on both sides of Clark Street,
from the East. property line of 19th Street to the 'Uest property line
of 17th Street, and from the East property lino of 17th Street to the
::est property line of the I.C.R.R. Street; and on Jackson Street, from
th^ East line of 7ltenore Addition to the East line of 25th Street;
and on 22nd Street, from the Oouth property line of Kentucky Avenue
to the 'tort, property lino of Joshington Street, in the City of Paducah,
Kentucky, be and the same is hereby assessed for the cost of construct-
ic•n of a- Id otreeto the sun of, gravel construction, 39 feet in width

SECTION 2.
That all of the funds derived from the assessment of said
property aforesaid shall be used for the: purpose of 'paying off the
tax bills issued against said property, or such bonds as may be
Issued by the City of Paducah pursuant to Section 3101 of the
Kentucky Statutes'.
SECTION 3.
That pursuant to Section 3161 of the Kentucky Statutes, as
amended and re-enacted and now in force, said assessments may be,
at the option of the property owners, payable in cash within thirty.
'days from the date of the passing and recording of this ordinance,
or in ton annual installments, pursuant to the provisions of said
Statutes.
7 SECTION 4.
In order to provide a fund for the immediate payment of
the cost of that portion of the special assessments herein pro-
.ided for, and which may be paid on the ten year installment plan,
as hereinbefore provided for, the City of Paducah may issue and sell
improvement bonds, and to secure the payment of which bonds, there
is hereby pledged such taxes and liens upon the property assessed
herein for the payment of the principal and interest on such bonds,
but such bonds shall not be sold for less than par, and the pro -
coeds thereof applied exclusively to payment for the improvement
of said streets as hereinbefore mentioned, and such bonds, if issued
shall bear interest, and shall be payable In accordance with the
J9J9J9' provisions of Section 3101 of the "entucky Statutes, as amended and
re-enacted by the General Assembly of the Commonwealth of Kentucky
and now in force and effect.

SECTION 5.
This ordinance shall take effect and be in force from and
after its oasssge, record and rublicati6n.
