HomeMy WebLinkAboutOrdinances Book 9, Page 684, No Ordinance NumberPage 084 AN ORDINANCE DETERMINING THE FUNCTIONS OF DE", � PARTMENTS OF PUBLIC AFFAIRS, PUBLIC FINANCE, PUBLIC SAFETY, PUBL•ICI R'ORKS AND PUBLIC PROPERTY, AND PRESCRIBING THE DUTIES OF THE COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY, AND REPEALING THE ORDINANCE RECORDED JANUARY 10, 1922, AND PUBLISHED ON THE SAME DATE AND REPEALING AMENDMENT THERETO, RECORDED ON JANUARY 24th, 1922, AND PUBLISHED ON THE SAME DATE, AND ALL OTHER ORDINANCES V114ICH SHAY BE IN CONFLICT THEREWITH. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THF CITY OF PADUCAH, KENTUCKY: SECTION #1. That the executive and administrative powers, authority and duties of the members of the Board of Commissioners of Paducah are hereby distributed and assigned as hereinafter setforth. SECTION #2. The Mayor, as Commissioner of the Department of Public Affairs, shall perform all of the duties imposed upon him by law, and such other duties as may be conferred upon him by the Board of Commissioners, not inconsistent with the law. The following branches of the public service are hereby assigned to the Department of Public Affairs: Police Court, City Prosecuting Attorney, City Solicitor, Board of Park Commissioners, Pest House, All Public Health Service, including Board of Health.and City Health Officer, Meat and Milk Inspector, Sanitary Officer, and Sanitary Inspector, Incinerating Plant, City Physician and Assistant City Physician; and the position of City Physician and City Health Officer may be held by one and the same person, in the discretion I of the Board; and the offices of Sanitary Officer and Sanitary Inspector may be held by one and the same person; and may be required to function for any period of any year within the discretion of the Board. SECTON #3. The Commissioner of Public Finance shall have charge of all the fiscal accounts of the City, the collection and disbursement of all funds of the City, subject to the orders and directions of the Board of Commissioners. He shall cause accounts to be kept of all receipts and disbursements, and shall make monthly reports to the l Board of Commissioners of all financial transactions of the City. j He shall report on delinquencies, collections and disbursements of taxes, assessments, fees, and all moneys due, or to become Page 685 due to the City, together with such recommendations as he may deem advisable. He shall keep the Special Funds of the City, raised by Special assessments, or apportioned to special purposes in accounts separate from the General Funds of the City, and all funds, general or otherwise, shall be kept in the City Depository or Depositories, as designated and selected by the Board of Commissioners, and shall disburse said funds only in the manner provided by law, or by Ordinance. He shall have charge of, direct and appoint all clerks, agents and employees that may be necessary in the furtherance of the affairs of the Department of Public Finance. SECTION # 4. DEPARVAENT OF PUBLIC SAFETY The Department of Public Safety shall have charge of the following branches of public service of the City of Paducah: The Police Department, and all police officers, and all other employees connected with the Police Department,. unless specifically assigned by Ordinance to some other Department of the City; also shall have charge of the Fire Department, and all officers, firemen and employees, connected therewith, together with all the equipment, properties and utensils used by, or per- taining to the operation of said Police and Dire Departments, and the City Jail and Jailer, the Foreman of Chain Gang, or Chain Gang Boss, except when same are used for work upon the highways and thoroughfares of the City, then same is to be under Commissioner of Public Works. He shall have general superintendency over all the officers, agents and employees of his Department, and of all the equipment and paraphernalia used by or in connection with sai He shall have authority to establish rules for the Police and Fire Departments, and to assign men in said Departments to such duties as he may see fit from time to time. He shall have power and authority to prescribe the character and design of uniform to be worn by the mel of said Departments, and may require said so uniforms to be4worn by the men in said Departments. He shall make monthly reports to the Board of Commissioners as to the condition of his Departments. He shall have supervision and control over all miscellaneous charities and affiliated charities, and the administration and distribution of all funds and provisions for the support of the poor of the City of Paducah. Subject, however, to the supervisory power of the Board of Commissioners as a whole at any time such Board desires to exercise such power. a Page 686 SECTION # 5 DEPARTMENT OF PUBLIC VORKS The Commissioner of Public Works shall have charge of the following branches of public service; i All civil engineering to be done for, or in connection i with the work of the City and all Departments pertaining to public work and improvements, including the construction or reconstruction of streets, public ways, sidewalks, sewer, bridges, viaducts, conduits and all public structures, except i public buildinjs, which is reserved to the Board as a whole; the cleaning of all streets, alleys, highways, and all repairs, maintenance and upkeep of any such properL-y, the inspection of all work done, or improvements made, either by Ordinance or under contract; the enforcement of all laws, or Ordinances relatt.ng to billboards, or other unsightly or objectionable buildings., or structures upon, or adjacent to the streets or highways of the City, and all. buildings and structures involving the possibility of fire hazard to be left under the control of the Commissioner of Public Safety, or those appointed by him, j SECTION # 6 / DEPARTMENT,OF PUBLIC PROPERTY The Commissioner of Public Property shall have charge and supervision of the following branches of public service: The procuring and placing of all insurance upon all City property, and the maintenance and upkeep and cleaning of all public buildings of the City, except insofar as said building: are cleaned or maintained or kept by such other Departments of the City, as herein or by Ordinance they are given supervision or' control thereof. He shall have charge and control of the City Scales, City Cemetery and all employees thereof, including the Sexton, the City Wharf and Wharf Master, and all employees of I the City Hall, not oi.herwise assigned to some other Department; the Market House and Market Master, and all employees of said i Market House; he shall have charge and control of the City Lighting Plant, and all superintendence and direction of all agents and employees of such Lighting Plant, and shall have control of the City Hospital and of the Carnegie Library, and all employees thereof, subject to any supervision of Board of i Commissioners which may at any time be enacted. Page 687 SECTION # 7 The Board of Commissioners shall have the right and authority to select, designate and appoint the City Depository, or Depositories for any and all funds of the City. And any fund. -or funds of the City may at the will of: the Board of Commissioners be divided among the said depositories In a manner to be determined by said Board. SECTION # 8 Into the hands of the Board of Commissioners as a whole shall be placed the right to select and control, as it sees fit, the Tax Commissioner or Assessor, and the Auditor of the City, and all of the machinery of the tax assessment shall remain in the hands of the Board as a whole to act on, select and determine as they see fit. Also the selection of the City Clerk shall be made by the entire Board, as also there shall remain under the control of the entireiBoard the selection of the Back Tax Collector. SECTION 9 All other Departments and branches of service not expressly assigned herein to any particular department of the City Government, and all duties, pourers and authorities not herein expressly vested, and not otherwise by law vested in any particu- lar or separate department of the Governement, are hereby expressly reserved to and invested in the Board of Commissioners as a Board. SECTION # 10 The Commissioners of each Department shall have the power and authority to employ from time to time such labor as may be necessary for .the proper performance of the duties of such Department, provided that the employment of such labor shall be reported by such Commissioner to the Board of Commissioners at their next regular meeting, with wages to be paid, and the Board of Commissioners shall have power to ratify such employment, or to order a discontinuance thereof at any 1 time. The Commissioner of each Department shall likewise have the right and authority to discharge any employee so employed by him from time to time; and shall also have authority to suspend, without pay, any employee, officer or agent under his Depart -rent, according to law, but such discharge or suspension shall be reported to the Board of Commissioners at the next- regular meet-.[ Ing thereof, and said Board of Commissioners may ratify the N A Page 688 action of said Commissioner, or may refuse to ratify same in their discretion. SECTION # 11 The Board of Commissioners may make qnd establish from time to time such rules and regulations as they deem expedient and necessary for the regulation and control of each of the Departments herein, and the employees of each Department. SECTION // 12 All Ordinances, resolutions and motions in conflict with this Ordinance, or with any part thereof, and all parts of Ordinances, resolutions and motions in conflice with this Ordinance, or any part hereof, are hereby and to the extent of such conflict repealed. SECTION.# 13 This Ordinance shall take effect and be in force from and after its passage,record and publiention.
