HomeMy WebLinkAboutOrdinances Book 9, Page 647, No Resolution NumberPage 647 A RESOLUTION PREFERRING CHARGES OF MISCONDUCT IN THE PERFORMANCE OF THE DUTIES OF HIS OFFICE AGAINST ROSS RUTTER, C01'.MI SIONER Amok - (F PUBLIC FINANCE, AND FIXING A DATE FOR A BEARING OF' SUCH CHARGES, AND Wr I PROVIDING FOR THE EtTLOYMENT OF A STENOGRAPIiIC REPORTER FOR SAID HEARING, I AND PROVIDING FOR THE PROCURE14ENT AND ATTENDANCE OF WITNESSES FOR SAID HEARING. WHEREAS, by an audit of the records of the office of the Commissioner of Public Finance for the year 1930, made by an employed accountant, E.H. Cocke, it has developed that a shortage or deficit. existed in the accounts of said Commissioner of Public Finance, and that said audit was by reason thereof and at the request of said Commissioner of Public Finance, delayed until said Commissioner could make good said deficit or shortage, and WHEREAS, said commissioner, after some delay, is said to have deposited funds to cover said deficit or shortage so as to balance the accounts in his office for the year 1930, and l"•1HEPEAS, it is brought to the attention of the Mayor and members of the Board of Commissioners that the funds used in covering or absorbing said deficit or shortage were improperly taken from another fund or account in the office of said Commissioner of Public Finance, according to information furnished by said Commissioner of Public Finance, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF CO1VMISSIONERS OF THE CITY OF PAIXICAH, KEP]TUCKY: SECTION 1. That a charge of misconduct in the performance cf the duties of his office by the said Ross Rutter, Commissioner of Public Finance, because of the matters set out in the preamble hereto be now preferred against him, and that a public hearing of said charges be had befdre the Board of Commissioners sitting for said purpose in the Commissioners' Chamber in the City Hall in the City of Paducah at 10:00 o'clock in the forenoon on Thursday, August 13th 1931, at which hearing the said Commissioner of Public Finance, Ross Rutter, shall have the right to be represented by counsel and to have witnesses summoned in his behalf and required to testify. SECTION 2. For the purpose of affording both the City of Paducah and the said Commissioner of Public Finance ample opportunity for briaginl before said hearing witnesses whom they may desire to be introduced and to have testify, the Judge of the Police Court of said city is authorised and instructed to issue subpoenas for said witnesses and to require and compel the attendance of said witnesses at said hearing, and the Chief of Police and all police officers of said city are hereby authorized Page 648 Instructed and directed to execute any and all process for the )ringing of said witnesses before the Board of Commissioners at said searing, and the said Judge of said Police Court is further mthorized, directed and empowered to swear all such witnesses, or laid witnesses may be sworn by any Notary Public in the presence d' iaid'Board of Commissioners at said hearing. The Board of ;ommissioners will report their findings of fact and their conclusions i .hereupon and their reasons for their decision upon said hearing so hat the same may become a public record as provided by Taw. SECTION 3, After the adoption of this resolution a copy of same, igned by the Mayor, shall be delivered to the said Ross Rutter, and he adoption of said resolution by the Beard of Commissioners shall onstitu to notice to the said Ross Rutter, Commissioner of Public finance, of all of the matters contained herein. SECTION 4. This resolution shall be in full force and effect upon is adoption by the Board of Commissioners.
