ABUTTING UPON SAID IMPFOVEI;IF.I'T,' AS SHOWN BY TRE ENGINFEF1S ESTIMATES ON FILE IN THE OFFICE OF THE CO;' MISSIONER OF' PUBLIC lr.,ORKS, AND PROVIDING THAT SAID ASSEFSPrF.NT MAY BE PAID IN TEN EQUAL INSTALLIā€¢ENTS, BEING ONE EACH YEAR FOR A PFRIOL OE' TEN YEARS, WHEREAS, the Board of Commission=rs of the City of Paducah, Kentucky has heretofore on the 7th day of October, 1929 adopted an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SIDEWALK, DRIVFIi7AYS, CURB AND GUTTER ON 1.7ASHINGTON 8TRET-2, FROM THE WEST PROPERTY LINE OF SIXTEENTH STREET, TO THE EAST PROPERTY LINE OF SEVENTEENTH STREET, IN THE CITY OF PADUCAH, MCCRACKEN COUNTY,KENTUCKY, TOGETHER 1,7ITH ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS, SEl1iFR AND DRAIN PIPE, AND ALL NECESSARY ENGINEERING, ADVERTISING AND L -GAL AND CLERICAL SERVICE IN CONNECTION THFRE1,11ITH AT THF COST OF THE ABUTTING I PROP RTY U."INFRS AND PROVIDING TT'AT SAME MAY BE CONSTRUCTED UPON THE TEN YEAR PAYMENT PLAN," and WHEREAS, in accordance with said ordinance it is provided that the cost of construction of said concrete sidewalk, driveways,curb and gutter, together with all necessary manholes, intakes, catch basins, drain tile and sewer pipe, and all necessary engineering, advertising and legal -nd clerical service in connection therewith end all other work done thereunder be paid for by the abutting property owners on both sides thereof, except that portion to be paid by the City of Paducah as required by law, and ';WHEREAS, pursuant to said ordinance, a contract was entered Into on the day of 1929, between J.M.Rouse Contracting Page 612 Company, Contractors, and the City of Paducah, Kentucky for the construction thereof, and WHEREAS, said contract has In all respects been completed and the work thereunder finished and acceoted by the Board of Commissioners of the City of Paducah on the 11th day of October, 1930, pursuant to notice duly given and inspection of said work and the recommendation of acceptance made therefor by the Commissioner of Public Works of the City of Paducah, Kentucky, and pursuant to a motion made by said Commissioner, which motion was duly adopted by the Board of Commissioners, NOP,', TIF-RFFORE, BE IT ORDt,INFD 13Y THE BOARD OF COML7ISSIONERS OF THE CITY OF PADUCAH, IGNTUCKY: SECTION 1. That all of the property on both sides of Washington Street, from the west property line of 16th street to the east property line of 17th street, in the City of Paducah, McCracken County, Kentucky, as shown by the engineer's estimates, be, and the same is hereby assessed for the'cost of construction of concrete side- walk, driveways, curb and gutter, with all necessary manholes, intakes, catch basins, drain tile and sewer pipe, and all necessary engineering, advertising.and legal and clerical service in connection therewith; All of said work has been done under the ordinance and contract aforesaid and said assessment is as follows, to -wit: Cost of concrete sidewalk ............ $0.19 per sq, foot Cost of concrete gutter .............. 0.40 per lin. foot Cost of concrete driveways........... 0.30 per sq. foot Cost of concrete curb straight....... 0.55 per lin, foot Cost of concrete curb curved .......... 0.65 per lin, foot Cost of expansion joints ............. 0.01389607510 per dollar construction cost Cost of interest ..................... 0.02390338449 per dollar construction cost Cost of engineering and inspection... 0.05000000000 per dollar construction cost As shown by the engineer's estimates on file in the office of the Commissioner of Public Works, which estimates are adopted and made part hereof. SECTION 2. That all of the funds derived from the assessment of said property aforesaid shall be used for the purpose of paying off the tax bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. Page SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted and now in force, said assessments may be, at the option of the property owners, payable in cash tithin thirty days from the date of the passing of this ordinance, or in ten annual installments,, pursuant to the provisions of srlid statutes. SECTION 4. In order to provide a fund for the immediate payment of the i cost of that portion of the special assessments herein provided for, and Which may be paid on the ten year installment plan as hereinbefore provided for, the City of Paducah may issue and sell improvement bonds, and to secure t e payment of which bonds there is hereby pledged such taxes.and liens upon the property,assessed herein for the payment of the principal and interest on such bonds, but said bonds shall not be sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said street as hereinbefore mentioned, and such bonds, if issued, shall bear interest rand shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the General Assembly of .the Co^mon-ealth of Kentucky and now in force and Effect. SECTION 5. This ordinance shall take effect and be in force from and after its passage.
