WHEREAS, the City of Paducah is preparing to take over by
purchase the privately owned water works of said City for the
purpose of operating the same by the City of Paducah; and
`NHEREAS, it has been found necessary that said water works
plant and properties and the income thereof be pledged to secure
the payment of said bonds to be issued for the purpose of raising
money with which to purchase said plant; and
'.'HFFEAS, it isj,desired that the management and operation
of said w.ster works shall be efficiently and impartially conducted
through a non-political management which may be separated from the
influence of local campaigns and local politics as far as the same
can possibly be done; and
`.r(HEFEAS, the vesting of such control and management in a
body to be known as Commission•.rs of :"later Works with full power
and authority to manage and control the same is deemed to be the
most effective means of carrying out this purpose, N011, THEREFORE,
BE IT ORDAINED BY THE BOARD OF CO1.1YISSIONURS
OF THE CITY OF PADUCAH, KENTUCKY:.
SECTION 1.
There is hereby created a board to be styled the
"Commissioners of Mater ilorks" to be composer' of three members, who,
together with their successors, shall be designated or appointed
by the ?4ayor s"abject to the ratification and approval of the Board
of Commissioners or other legislative body of said City. Members of
said Board of Water `Illorks Commissioners shall be deemed and are
hereby decalred to be employes and not officers of said City, and
none of them shall be removed from their position or employment
except for good and sufficient cause, and they shall each serve
as other employes operating under Civil Service in said City. Said
7ommissioners of Water Works shall each respectively receive Three
iundred ($300.00) Dollars per year as compensation for his services,
payable out of the income of said water works which may be assigned
to operating expenses, the same to be paid in equal monthly
Lnstallments. The Commissioners of 1"later •alorks shall each execute
a bond for the faithful performance -of duties in the sum of Five
Phoussnd ($5000.00) Dollars, the premium on such bond to be paid
is other operating expenses of said water works.'

SECTION 2.
Said Coimnissioners of !later works shall control and manage
the water works and water system of the City subject to the limitations
and requirements of this ordinance and of the laws of the State of
Kentucky. They shall have full power and authority to appoint and
remove all employes of said water works and to fix and allow the
compensation for such employes. Gaid Commissioners of ".Tater!'Works
shall have the right and are hereby given power and authority to do any
and all acts necessary or proper in the administration of said voter
works, except that in the lowerinZf or raising of rates for service said
Commissioners of !'later :'Works shall make their recommendations to the
Board of Comrissir-ners of said City, or other legislative body of said
City, and such rates so recommended shall not become effective until
same have been ratified by the legislative authority of said City.
Said Commissioners of 'Fater ':'Works sl!all cause all of the income and
revenues of said water workF to be segregated into the proper funds
provided in an ordinance ado,)ted simultaneously with the adoption
of this ordinance and providing for the Sssuance of bonds known as
Water Works Revenue Bonds for the purpose of purchasing and acquiring
said water works in the City of Paducah; and shall make and deliver
to the Mayor monthly reports in detail of all expenditures and of all
collections, and of the amount apportioned to each fund aforesaid,
and they shall have power and authority to select depositories and to
require such depositories' to execute bonds to secure the City and
said Commissioners of 'Plater 'Horks and the holders of any bonds issued
for the purpose of purchasing s*i d water works against any loss or
damage on amount of loss, defalcation or misapplication of said funds.
All of the funds collected and received in the operation of said water
works shall be deposited in said separate funds as herein provided,
and as provided in said ordinance providing for said water works bonds
aforesaid.
SECTION 3.
The accounts of snid water works and the records of said
Commissioners of Nater Works shall be audited and inspected once each
month by the Auditor of the City of Paducah and a report thereof made
to the Mayor, and all of the accounts, records and transactions of
said Commissioners of Water works, and all of the iecords and accol}nts
in connection with the operation of said water works shall be audited
by a certified public accountant once each year and a report thereof
filed with the Mayor of said City. The expense of making said annual
audit shall be charged to the Operation and Maintenance Ac ount of said
water works.

SECTION 4.
Said Commissioners of ;Nater Plorks shall have power and
authority to do any and all acts necessary and proper in the
management and operation of said water works, and to purchase
all supplies and cause all work necessary in connection therewith
to be done and paid for out of the funds available for that
purpose; they shall select all employes that may be necessary,
including a secretary or treasurer, who shall be the employe
charged ,^ith receiving and accounting for the funds and revenues
of said water works. Said secretary or treasurer shall not be a
member of said commission, but he shall be required to execute
a bond in the sum of Twenty Thousand ($20,000.00) Dollars to
secure the faithful accounting of all funds entrusted to him, which
bond shall be continued in force and effect, ancR the premium
thereon to be paid as other operating expenses, and upon the
cancellation or termination of any such bond the accounts of said
secretary or treasurer shall be closed and an accounting made
thereof. Payments of all accounts for Five ($5.00) Dollars or
more shall be by check, and all checks shall be drawn upon the
proper account and signed by said secretary or treasurer.
SECTION 5.
Two members of snid Board of Commissioners of !"rater ':forks
shall constitute a quorum for the transaction of business, but the
affirmative vote of two members shall be necessary to the
adoption of any motion, resolution or order or the approval of any
matter under consideration by said Board.
SECTION 6.
This ordinance shall be in force and effect ten days
after its passage.
