AN ORDINANCE ASSESSING ALL OF THE LOTS OR PARCELS OF
GROUND LOCATED IN STORM WATER SEFTER ZONE "B", HEREINAFTER DESCRIBED,
FOR THE COST OF COUSTRUCTION OF STORM WATER SXJERS,_ IN SAID 'LONE "B",
IN THE CITY OF PADUCAH, I0NTUCIa, AND PROVIDING THAT THE PAYIIENT OF
SUCH COST I.IAY BE MADE IN TEN ANNUAL IN$TALLIIENTS, BEING ONE EACH YEAR
FOR THE PERIOD OF TEN YEARS, UPON EXECUTION BY TIE PROPERTY O!7NE-RS OF
THE AGRnEP.IENT RE<?UIRED BY LAW.
o1HEREAS the General Council of the city of Paducah, on
the 12th day of October, 1926, duly adopted a resolution providing for
the construction of storm eater seviers in zones A and B. particularly
described, and thereafter, pursuant to such resolution, on the 15th
day of November, 1926 duly adopted an ordinance, entitled, "AN ORDINANCE
PROVIDE�FOR THE CONSTRUCTION OF STORM !TATER SE.'TERS IN ZOITES A AND B,
HEREINAFT R PARTICULARLY DESCRIBED, IN SANITARY SETTER DISTRICT #1, IN
THE CITY OF PADUCAH, KENTUCKY, AT THE COST OF THE PROPERTY 01:TNERS AND
PROPERTY LOCATED IN SAID ZONES, AND PROVIDING THAT SAID SETTERS SHALL
BE CONSTRUCTED IN ACCORDANCE WITH THE PROVISIONS OF THE TEN YEAR
PAYIS3NT PLAN, AND NAMING THE STREETS AND ALLEYS ALONG AND OVER IIHICH
SAID SE`.'iERS SHALL BE CONSTRUCTED, UND SETTING OUT IN GENERAL TERMS THE
PROPERTY BENEFITTED THEREBY AND SUBJECT TO THE PAYMENT OF THE COST OF
SAME"; and the amendment thereof duly adopted on the 8th day of December
1926, wherein it is provided, among other things, that storm water
sewers be constructed in zones A and B therein described by metes and
bounds, and hereinafter described, and wherein the streets and alleys
on and along vhich said sowers shall be constructed are named and I
designated in said storm water sevier zone 'W" as follows:
I
On Plashington Street from the '.est property line of 7th
Street to the center line of 9th Street; on 8th Street from the center
line of Washington Street to the center line of Clark Street.
On Clark Street from lour water mark on the Tennessee
River to the center line of 9th Street, said line crossing lst, 2nd,
3rd, 4th, 5th, 6th, 7th and 8th streets, and taking care of the
drainage of the storm water at each of said intersections.
On 2nd Street from the center line of Clark Street to the
center line of Ohio Street, crossing Adams Streets and Jackson Street
and to the center line of Ohio Street, and taking care of the drainage
at each of said intersections.
On Adams Street from the sewer in the center line of 2nd
Street to the center line of 9th Street, crossing 3rd, 4th, 5th, 6th,
7th and Sth Streets, and to the center line of 9th Street, and taking
care of the drainage of the storm water at each of said intersections.

On Jackson Street from the sewer in the center of 2nd
Street to the center line of 9th Street, crossing 3rd, 4th, 5th.,Gth,'
7th and 8th Streets, and to the center line of 9th Street, and taking
care of the drainage at each bf said intersections.
On Ohio Street from the sewer in the center line of 2nd
Street to the center line of 9th Street, crossing 3rd, 4th, 5th,
6th, 7th and 8th Streets, and to the center dine of 9th Street, and
taking care of the storm crater at each of said intersec':ions; and,

MEAS said storm water seerer zone "B" provided for in
said ordinances, is particularly described as follows:
Beginning at a point 173. 25 feet North of the -?forth
property line of "las ington Street and 173.25 feet !Vest of the
'.Vest property line of 9th Street, said point being the center of
the block lying -between ':ashington Street and Kentucky Avenue; thence
in an Easterly direction, and with a line, said line being the.
center of the block lying between •;lashington Street and Itentucky
Avenue, 1219.5 feet to a point 173.25 feet East of the East
property line of 7th Street, said point being the center of t'�e
block lying between 6th and 7th Strects and Kentucky Avenue and
!Vashington Street; thence in a Southerly direction along a line;
said line being the center of the block lying between 6th and 7th
Streets and ''-'ashington and Clark Streets; thence in an Easterly
direction along line, said line being the center of the block
lying between Washington Street and Clark Street, 1844.25 feet to
the center line of 2nd Street; thence in.a Southerly direction'
along the center line of 2nd Street 17.3.25 feet to the North
property line of Clark Street; thence along the North property line.
of Clark Street, if extended, in an Easterly direction a distance of.
approximately 670 feet to low water mark on the Ohio River,approx
imately 66 -feet to the South property line of Clark Street, if
extended; thence in a 'slesterly direction slong the South property
line of Clark Steeet,,if extended, approximately 660.feet to the
center line of 2nd Street; thence in a Southerly direction along.
the center line of 2nd Street 1541.25 feet to a point, said point
being 173.25 feet South,of the South property line of Ohio Street
and the center of the block lying between Tennessee and Ohio Streets;
thence in a Northerly direction along a line, said line being 173.25
feet `:Jest of the !Vest property line of 9th Street and parallel •
thereto 2193 feet to a point 173:25 feet North of the North property
line of-Vlashington Street and 173.25 feet West of the 'lest property
line of 9th Street to the point of beginning;
AND WHEREAS in -accordance with said ordinance, it was
provided that the cost of the construction of said sewer shall be
apportioned equally against the abutting property or parcels of
land according to the number of.feet abutting thereon, provided the
cost of same shall not exceed 5p2.00 per abutting foot. That in the

event the cost of said improvement shall exceed ;;2.00 per abbtting
foot along said streets whereon said seviers shall be constructed,
then such cost shall be apportioned against all of the lots or
parvels of land in said sewer zone so benefitted, in the proportion
that the area in square feet of such lots or parcels of land shall
bear tv the area in squarefeet of all the lots or parcels of
ground located in said zone; and, further, that the General Council
shall fix and assess the amount of tax to be levied upon each,of
said lints or parcels of land as required by law; and,
!JHET.EAS, pursuant to said ordinance, a contract was

entered into the 19th day of January, 1927, ( and re-oxecuted on I:iarch
18, 1927) between McKelvey Construction Company of St. Louis, Ito. and
the City of Paducah, Kentucky, for the construction of said sewers; and,
WHEREAS the cost of construction of said sewers as
against the property abutting thereon .gas in excess of {2.00 per abutting
foot, and therefore must be assessed against all the property in said
sewer zone upon an area basis as hereinabove mentioned; and,
i'IHEREAS said contract has been completed and duly
accepted by the Board of Cormissioners of the City of Paducah on the
10th day of January, 1928, pursuant to the recommendation of the Board
of Public Works of said city filed with the General Council on December
319 1927, while under the Councilmania Form of Government, and pursuant
to the recommendation of the Commissioner of Public Works, filed on this
the 10th day of January, 1928:

OF PADUCAH, KEIITUCKY:
SECTION 1.
That all the lots or parcels of ground located in said
storm water sewer zone "B", hereinabove described, be, and the same are
hereby assessed for the cost of construction of said sewer as followis:
Pon -abutting property, per squarefoot $0.025113882
Abutting.property, with Y branches only 0.0262581943
Abutting property, with house service connection 0.0324036733
as particularly shown by the estimate of said cost prepared and cer-
tified by the City Engineer in charge of and directing same, which has

been duly filed, approved and confirmed by the Board of Commissioners
of said City, and which report and estimate show all of the lots or
parcels of land assessed for such cost, and the amount of same, and is
now referred to and made part hereof, and will appear on file in the
office of the Commissioner of Public Works of said City.
SECTION 2.
That the funds derived from the assessment of said
property shall be used for the purpose of paying off the special tax
bills issued against said property, or such bonds as may be issued by
the City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky
Statutes.
SECTION 3.
That pursuant to Section 3101 of the Kentucky Statutes,
said tax assessment may, at tho option of the property owner be paid
in cash without interest within thirty days from the date of the
passage and publication of this ordinance, or in ten annual installment
provided the property owner shall before the expiration of said thirty
days enter into a written agreement with said city in accordance with t.

provisions of Section 3101 of the Itentucky Statutes.
SECTION 4.
In order to provide a fund for the immediate payment of tho
cost of that portion of the special assessments herein provided for,
representing the amount which the property ovrners have elected to pay,
on the installment plan, as hereinabove provided, the city of
Paducah may issue and sell improvement bonds, and to secure the
payment of said bonds, there is hereby pledged such taxes and liens
on the property assessed herein for the payment of principal and
interest, but such bonds shall not be sold for less than par, and
the proceeds derived t -o refrom shall be applied exclusively to the
payment of the cost of such construction as hereinabove provided;
i and such bonds, if issued, shall bear interest and shall be payable
in accordance with the provisions of Section 3101 of the Kentucky
Statutes.

II
This ordinance shall take effect and be in force from and
after its adoption, record and publication.
