COURT HOUSE PROPFRTY OF MCCRACKE:N COUNTY, KENTUCKY SHALL BE PAID OUT OF AN APPROPRIATION MADE FOR SUCH PURPOSE BY 11F FISCAL COURT OF MCCPACKEN COUNTY ON THF 1ST DAY Ol'' JULY, 1930. BF IT OPDAIFFD BY TIF BOARD OV W'VIEFIONFPS OP 1FF CITY OF PADUCAH, KFNTUCKY: SECTION 1. That the driveway on South Seventh street, from the north property line of Washington street to the south property line of Clark street, in the City of Paducah, Kentucky, mith all necessary manholes, intakes, catch basins, drain tile and sewer pipe and all necessary engineering, advertising and legal and clerical service in connection therewith, be, and the same is hereby ordered to be constructed and reconstructed with concrete, asphalt, bitulithic, or other improved paving material as may be determined by the Board of CoMrrissioners as the best and most economical materi for the construction thereof, upon bids made therefor, and all to be clone in strict accordance with the plans, specifications, grades, widths, profiles and drawings of the Commissioner of Public 7orks prepared by him for such purposes: all of which are hereby adopted as a part of this ordinance as fully as if embraced herein or att,ched hereto and made part hereof and marked "A" for more specific identification. SECTION 2. That said work shall be constructed under the supervision'and direction of the Commissioner of Public !'forks, and shall be commenced at a time designated by contract for the performance of said work and completed on or before eight months after the passage and recording of this ordinance. SECTION 3. That all the cost incident to said construction of said street, as provided in Section 1 hereof, shall be paid for wholly by the property of^niers ane' property abutting or .fronting Page 569 thereon on both sides of said street and to be apportioned to and assessed ngninst the property owners and property abutting thereon on both sides of sFid street according to the nrimber of feet or abutting feet thereon, except that the City of Paducah shall pay such portion of cost of construction as reouired by law. And provided Further thnt so ' much of the cost of said improvement as shall be apportioned to the Court I ]souse property of IcCracken County shall be pnid out of the appropriation I I made by the Fiscal Court of "cCracken County, Kentucky July 1, 1930 and not otherwise. SECTION 4. The contractor awarded the contract for the .,!ork herein provided for shall be paid only from the funds arising from the special tax bills and assessments against the property abutting the improvement herein provided for,'and in no other way, except that the said contractor may be paid out of such bonds as may be issued, in accordance ::,ith the law of the City of Pnducah and charter cities of the second class of the state of Kentucky, and for the payment of which, said tax bills and assessments mey be pledged by the said City of Paducah; and in no event shall th(- said City of Paducah be liable to the contractor for the construch.ion of any of the cork herein provided for, except the said City of Paducah shall be liable to the said contractor for the excess of fifty (50%) per cent of the value of any property n::sessed for the construction of the work herein provided for. SECTION 5. The contractor awarded the contract herein provided for shall be paid monthly by Improvement Warrants issued by the City of Paducah unon estimates furnished by the Commissioner of Public Works, to the extent of silty -five (65%) per cent of the value of the work dohe or materials furnished by the contractor during the progress of the work, and said Improvement '.'Warrants shall bear six (65) per cent interest from date of iss,ial and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners. Said Improvement ''rarrants shall be negotiable, and shall constitute a lien upon the local tones to be hereafter levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the work herein provided for, out of the first collection of such ].coal tnxes, or out of the proceeds of the sale of any Improvement bonds issued in anticipation of such local taxes. The interest on such Improvement',S'rrrants shall t estimated and assessed as a pnrt of the cost of the improvement herein provided for. Page 570 SECTION 6. The Mayor is hereby authorized and directed to execute all written contracts qnd bonds r ith the successful bidder for the construction of said improvement as required by lave. SECTION 7. Bids shall be received for the construction of said work out of concrete, nsphalt, bitulitb ic, or any other improved paving ipaterial according to plans and specifications made and provided therefor by the Co-missioner of Public Works and reported to the Board of Commissioners at the next regular or called meeting and said Board of Commissioners shall determine the material with which said street shall be constructed and award the contract therefor to the lowest and best bidder, except that the right is expressly reserved to reject any and all bids, within the discretion of said Board of Commissioners. SECTION 8. This ordinance shall take effect and be in force 10 days rafter its passage.
