COMMISSIONFR OF PUBLIC 190RKS, AND PROVIDING THAT SAID ASSESFMfNT MAY BE PAID IN TFN EQUAL INSTAT•7.•MFNTS, BFING ONF FACE YEAR FOP A P�rIOD OF TEN YEARS. 7HEREAS, the Board of Commissioners of the City of Paducah, Kentucky has heretofore on the 19th day of August, 1929 adopted an ordinance entitled, "AN ORDINANCE °POVIDING FOR THE CONSTRUCTION OF SIDEWPLKS, DRIVFriUYS, CURBS AND CUTTFRS ON CLARK STREET, FROM TRE i°JEST CURB LIME OF SIXTEENTH STREET TO THE EAST PROPFRTY LINE OF SEVFNTFFNTH STREET, IN THE CITY OF PADUCAH, McCRACKEN COUNTY, KENTUCKY, TOGETHER 'JJITH ALL NFCESSARY MANHOLES, INTAKES, CATCH BASINS, SEv1--R AND DRAIN PIPE, AND ALL NECFSSARY ENGINEERING, ADVERTIFING AND LEGAL AND CLERICAL SFRVICE IN COP`NECTION THCRRINITH AT THF COST OF THE ABUTTING PROPFRTY 07NERS SAND PROVIDING TEAT SAIF MAY BE CONSTRUCTED UPON THE TEN YEAR PAYMENT PLAN," and A'HFREAS, in accordance with said ordinance it is provided that the cost of construction of said sidewalks, driveti:ays, curb and gutter, togethrr with all necessary manholes intakes, cat6h basins, drain tile and sewer pipe, and all neces^ary engineering, advertising and legal and clerical service in connection therewith and all other work done thereunder be paid Hgr by the abutting proporty owners on both sides thereof, except trat portion to be paid by the City of Paducah as required! by law, and Page 518 I'MrREAS, nursuant to snid ordinance a contract was entered into on the 18th day of September, 1929 between J.M. Rouse Contracting Company, Contractors, and the City of Paducah, Kentucky for the construction thereof, and PJIIEREAS, said contract has in all rexpects been completed and the -ork thereunder finished and accepted by the Board of Commissioners of the City of Paducah on the 10th day of March, 1930, pursuant to notice duly given and inspection of said work and the recommendation of acceptance made therefor by the Commission of Public 'forks of the City of Paducah, Kentucky, and pursuant to a motion made r,y snid. That all of the prop -arty on both sides of Clark Street, from the west curb line of 16th Street to the east property line of 17th Street in the City of Paducah, McCracken County, Kentucky, as shown by the Engineer's Estimates, be, and the same is hereby assessed for the cost of construction of concrete sidewalk, driveways, curb and gutter cath all necessary manholes, intakes, catch basins, drain tile and sewer pipe, an:I all 7ecessory engineering, advertising and legal and clerical service in connection therewith. All of said crork has been done under the ordinance and contract aforesaid nn,? snid assessment is as follolim, to -wit: Cost of concrete sidewalk ............. :$0.16 re sn. ft. Cost of concrete gutter ............. :.. 0.36 per lin. ft. Cost of concrete driveways.............0.25 per so, ft. Cost of concrete curb straight......... 0.54 per lin: ft. Cost of concrete curb curved........... 0.60 per lin. ft. Cost of expansion joints ............... 0.01887155425 per dollar construction cost Cost of engineering and inspection..... 0.04832844574 per dollar construction cost Cost of interest ....................... 0.01649736070 per dollar construction cost Cost of extra work ..................... 0.01603284458 per dollar construction cost As shown by the Engineer's Estimates on file in the office of the Commissioner of Public works, which. estimates are adopted and made part hereof. SECTION 2. That nil of the funds derived from the assessment of said property aforesaid shall be used for the purpose of paying off the tax bills issued against said property, or such bonds as may be issued by the City of Pa'ucah pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursunnt to Section 3101 of the Kentucky -amu•-._•,�.:..-„_r..,•. .,. :_ . .W. Page 519 Statutes, as amended and re-enacted and now in force, said assessments may be, at the option of the property owners, payable in cash within thirty days from the date of the passing of this ordnance, or in ten annual installments, pursuant to the provisions of said Statutes. SECTION 4. In order to provide a fund for the immediate payment of the! cost of that portion of the special aspessments herein provided for, and which may be paid on the ten year installment plan, as hereinbefore provided for, the City of Paducah may issue and sell improvement bonds, and to secure the payment of which bonds there is hereby pledged such j taxes and liens unon the property assessed herein for the payment of the principal and interest on such bonds, but said bonds shall not be sold for less than par and the proceeds thereof anolied exclusively to payment, for the improvement of said street rs hereinbefore mentione,', and such bonds, if issued, shall, bear interest and shall be payable in accordance with the provisions or Section 3101 of the Kentucl,7 Statutes, as amended and re-enacted by the General Assembly of the Common—ealth of Kentucky and now in force and effect. SECTION 5. This ordinance shall take effect and be in force from and after its passage.
