AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF A DRIVEWAY
ON UEFFERSON STREET FROM THE WEST PROPERTY LINE OF 'TWENTY FIFTH
STREET TO THE EAST PROPERTY LINE OF THIRTY SECOND STREET, IN THE
CITY OF PADUCAH,/McCRACKEN,COUNTY, KENTUCKY) 'IIITH ALL NECESSARY
CURBS, GUTTERS, MANHOLES, INTAKES, CATCH BASINS AND SEWER PIPE
AND ALL NECESSARY ENGINEERING AND ADVERTISING AND LEGAL AND
CLERICAL SERVICE IN CONNECTION THEREWITH AT THE COST OF THE ABUTTING
PROPERTY OWNERS AND PROVIDING TIIAT SAME MAY BE CONSTRUCTED UPON THE
TEN YEAR PAYMENT PLAN.
BE IT ORDAINED BY THE BOARDOF COMMISSIONERS OF THE CITY
OF PADUCAH, KENTUCKY:
SECTION I„
That the driveway on Jdfferson Street from the West
property line of Twenty Fifth Street to the East property line of
Thirty Second Btreet, in the City of Paducah, Kentucky, with all
necessary curbs, gutters, manholes, intakes, catch basins, drain
tile and sewer pipe and all necessary engineering, advertising and
legal and clerical service in connection therewith, be and the same
is hereby ordered to be constructed and re -constructed with concrete
asphalt, bitulithic, or other improved paving material as may be
determined by the Board of Commissioners as the best and most
economical material for the construction thereof, upon bids made
therefor, and all to be done in strict accordance with the plans,
specificatifns, grades, widths, profiles and drawings of the
Commissioner of Public Works prepared by him for such purposes, all
of which are hereby adopted as a part of this ordinance as fully
as if embraced herein or attached hereto and made part hereof and
marked "A" for more specific identification.
SECTION 2.
That said work shall be constructed under the direction ani
supervision of the Commissioner of Public 'Works, and shall be
commenced at a time designated by contract for the performance of
said work, and completed on or before eight months after the
passage and recording of this ordinance.
SECTION 3:
That all the cost incident to said construction of said
street, as provided in Section 1 hereof, shall be paid for wholly
by t -e property owners and property abutting or fronting thereon
on both sides of said street and to be apportioned to and assessed
against the property owners and property abutting thereon on both
sides of said street according to the number of feet or abutting
feet tbereof, except that the City of Paducah shall pay such portion
of cost of construction as required by law.

SECTION 4.
The contractor awarded the contract for the work herein
provided for shall be paid only from the funds arising from the Special
Tax Bills and assessments against the Property abutting the improvement
herein provided for, and in no other way, except that the said contractor
may be paid out of such bonds as may be issued, in accordance with the law
of the City of Paducah and charter cities of the second class of the
State of Kentucky, and for the payment of which, said tax bills and
assessments may be pledged by the said City of Paducah; and in no event
shall the said City of Paducah be liable to the contractor for the
construction of any of the work herein provided for, except the said City
of Paducah shall be liable to the said contractor for the excess of fifty
(50%) per cent of the value of any property assessed for the construction
of the work herein provided fore
SECTION 5';
Th'e contractor awarded the contract herein,provided for shall
be paid monthly by Improvement 'ilarrants issued by the City of Paducah -
upon estimates furnished by the Commissioner of Public '-;forks, to the
extent of six_tyafive (65%) per cent of the value of the work done or
materials furnished by the contractor during the progress of said work,
and said Improvement Warrants shall bear interest at the rate of six
(6%) per cent from date of issual and shall he issued by the Commissioner
of Public Finance upon order of the Board of Commissioners. Said
Improvement Warrants shall be negotiable, and shall constitute a lien
upon t.ie local taxes to he hereafter levied for such improvement, and
shall be payable at the office of the Commissioner of Public Finance,
i,Athout notice to the holder thereof, upon completion and acceptance of
the work herein provided for, out of the first collection of such local
taxes, or out of the proceeds.of the sale of any Improvement Bonds issued
in anticipation of such local taxes. The interest on such Improvement
Warrants shall be estimated and assessed as a part of the cost of the
Improvement herein provided for.
SECTION 6.
The Mayor is hereby authorized and directed to execute all
written contracts and bonds with the successful bidder for the construct—
ion.of said improvement, as required by law.
SECTION 7.
Bids ahall be received for the construction of said work
out of concrete, asphalt, bitulithic, or any other improved paving
material according to the plans and specifications made and provided
therefor by the Commissioner of Public %Yorks and reported to the Board
of Commissioners at the next regular or called meeting and said Board

of Commissioners shall determine the material with which said
street shall be constructed and award the o6ntract therefor to the
lowest and best bidder, except that the right is expressly reserved
to reject any and all bids, within the discretion of said Board of
Commissioners.
SECTION 8.
This ordinance shall take effect and be in force 10 days
after its padsage.
