WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky has heretofore on the 5th d.qy of August, 1929 adopted an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SIDEWALKS ON BOTH SIDES OF H_ARRISON STREET, FROM THE WEST PROPERTY LIN- OF FOURTH STREET TO THE EAST CURB LINE OF FIGRTH STRFFT; AND ON CLAY STRFFT, FPOM THE WEST PROPERTY LINF OF FOURTH STRFFT TO THE, RAST CURB LINF OF EIOHTF STRFFT; AND ON FIGHTH STRFFT, FROM THE NORTH PPQPPRTY LINE OF MADISON STRFFT TO THF FOTTTH CTJRB LINE OF PARK AVFNUE, IN "TF CITY OF PADUCAH, McCRACKEN COUNTY, KENTUCKY, TOGFTHFR '."KITH ALL NrCFFSAFY MANHOLFS, INTAKFS, CATCH BASTNS,� SEI. -'.IFR AND DRAIN PIPE, AND ATL NFCFFSARY ENGINEERING, ADVERTISING AND LEGAL AND CLFRICAL SERVICE IN COMNECTIO" THFRF111ITH AT THF: COST OF 'n F ABUTT ING PROPERTY OWNFRS AND PFOVIDTNG THAT SAME' MAY BE CONSTRUCTED UPON TFT TEN YEAR PAYMENT PLAN," and '" REAS, in accordance with said ordinance it is provided that the cost of construction of said sidewalk and driveways together with all necessary manholes, intakes, catch basins, drain tile and sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith and all other Page 501 work done thereunder be paid for by the nbutting property owners on both sides thereof, except that portion to be paid by the City of Paducah as recuired by law, and lVffFREAS, pursuant to said ordinance a contract was entered into on the ,da.y of 1929 between Yancy Brothers, Contractors, and the City of Paducah, Kentucky for the construction thereof, and '.'.'HERFAS, said contract has in all respects been comnleted I and the work thereunder finished and accented by the Board of Commissioners on the 3rd day of February, 1930, pursuant to notice duly given and inspection of said r�ork and the recommendation of necentance made therefor by the Commissioner of Public 1,7orks of the City of Paducah,' Kentucky, and pursuant to a motion made by 'said co!,missioner, which motion v,as duly adopted by the Board of Commissioners, NO7!,THr•RFFORR, BE IT ORDAINED BY THF BOARD OF COT.j11iISFIotiF)-S OF THF CITY OF PADUCAH, KENTUCKY: SECTION 1. That all of the property on both sides of Harrison Street, from the west property line of Fourth Street to the east curb line of Eighth Street; and on Clay Street, from the west property line of Fourth Street to the east curb line of Eighth Street; and on Eighth Street, from the north property line of Madison Street to the south curb line of Park Avenue, in the City of Paducah, McCracken County, Kentucky, as shown by the Engineer's Estimates, be, and the same is hereby assesses for the co^t of construction of concrete sidewalks and driveways, with all necessary manholes, intakes, catch 'basins, drain tile and sewer pipe, and n7.1 necessary engineering, advertising and legal and clerical service in connection therewith. All of said work has.been done under the ordinance and contract aforesaid and said assessment is as follows, to -wit: Cost of concrete sidewalk .............. $0.13 per so. ft. Cost of concrete driveways............; 0.20 per sq, ft. SECTION 2. That all of the funds derived from the assessment of said property nfores•id shall be used for the nurnose of Daying off the tax bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. Page 502 SECTION 3. That pursuant to Section 3101 of the nentucky Statutes, as amended and re-enacted and now in force, said assessments may be, at the option of the property owners, payable in cash within thirty days from the date of the passing of this ordinance, or in ten annual installments, pursuant to the provisions of said Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, and which may be paid on the ten year installment plan, as hereinbefore providrd for, the City of Paducah may issue and sell improvement bonds, and to secure the payment of w1nich bonds there is hereby nledged such taxes pn,l liens upon the property assessed herein for the pa7Tment of the principal and interest on such bonds, but said bonds shall not be sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said street as hereinbefore mentioned, and such bonds, if issued, shall beat interest and shall be rr.yable in accordance erith the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the General Assembly of the Commonwealth of Kentucky and now in force and effect. SECTION 5. This ordinance shall. take effect and be in force from and after its passage.
