WHEREAS, the Board of Co-missioners of the City of Paducah, (Kentucky has heretofore on the 16th day of September, 1929 adopted an ordinance entitled, "AN OPrINANCF PPOVIDING FOP THF CONSTRUCTION OF SIDPWALKS, DFIV71"SAYS, CURBS AND OUTTFRS ON TIP7 wFST SIDE OF TWENTIETH STRFFT, FROM THF SOUTH CUPB LINE OF JACKSON STREIT TO TITF JUNCTION OF TWENTIETH STREET AND WEEFLFF AVENUE: AND ON THE SOUTH SIDE OF ",ITFT LFR AVENUE, FROM THF JUNCTION OF T".BN'? IETH S"RFFT ANI` "'HFFL'PR AVFNUF TO THF WEST PR OPFRTY LINE OF "C" STREET, IN THE CITY OF PADUCAH, McCRACKEN COUNTY, KENTUCKY, TOGETHER WITH ALL NFCFSSAPY MANHOLES, INTAKFS, CATCH BASINS, SEWER AND DRAIN PIPE., AND ALL NFCF`'FAFY-NPIUFFRING, ADVFPTISING AND LEGAL AND CLERICAL SERVICE IN CONNECTION TITrRF'.?ITH AT THF COST OF I THE ABUTTING PFOPFRTY OWNFPS A.ND PPOVIDING THAT SAME MAY BE CONSTRUCTED UPON THE TFT( YEAR PAYMENT PLAN," and WHFPFAS, in accordance With said ordinance it is provided that the coFt of construction of said sidewalk, together with all necess curb, gutter, driveways, manholes, intakes, catch basins, drain tile and (sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith and all other work done there - funder be paid for by the abutting property owners on said streets, except that portion to be paid by the City of Paducah as required by law, and WHERFAS, pursuant to scid ordinance a contract was entered into on the_,_ day of _,__1929 between the J.M. Page 498 Rouse Contracting Company, Contractors, and the City of Paducah, Kentucky for the construction thereof, and 1+7HUFAS, said' contract has in all respects been completed and the work thereunder finished and accepted by the Board of Commissioners on the 3rd day of February, 1930, pursuant to notice duly given and inspection of said work and the recommendation of acceptance made therefor by the Commissioner of Public Torks of the City of Paducah, Kentucky, and pursuant to a motion made by said Commissioner, which motion was duly adopted by the Board of Commissioners, NOW, TTIFFEFORE, BF IT ORDAINED BY THE BOARD OF CO".".'IS TOITTRS OF TRF- CITY OF PADUCAH, KENTUCKY; SECTION 1. That all of +he property on the "'est side of 20th Street, from the south curb line of Jackson Street to the ,function of 20th Street and Wheeler Avenue; and on the south side of I;lheeler Avenue, from the junction of 20th Str-Ft and t8heeler Avenue to the west property line of "C" Street, in the City of Paducah, McCracken County, Kentucky, as shown by the Engineer's EstiT'ntes, be, and the same is hereby assessed for the cost, or' construction of concrete sidewalk, curb, gutter and driveways, with all necessary manholes, intakes, catch basins, drain tile and sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith. All of said work has been done under the ordinance and contract aforesaid and said assessment is as follows, to -wit; Cost of Concrete sidewalk ........ :.$"0.18 per sq, ft. I SECTION 2. That all of the funds derived from the assessment of said ,roperty aforesaid shall be used for the purpose o" paying off the ax bills issued against said property, or such t,onds as may be issue y the City of Paducah pursuant 1:0 Section 3101 of the Kentucky tatutes. Page 499 SFCTION 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted and now in force, slid assessments may be, at the Option of the property or•ners, payable. in cash ithin thirty days from the date of the passim; of'this ordinance, or in ten annual installments, pursuant to the provisions of said Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the speci1 assessments herein provided for, and which may be paid on the ten.year installment plan, as hereinbefore provided for, the City of Paducah may issue and sell improvement bonds, and to secure the napment of which bonds there is hereby pledged such taxes and liens upon the property assessed herein for the payment of the principal and interest on such bonds, but said bonds shall not be sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said street as hereinbefore mentioned, and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the General Assembly of the Commons-ealth of Kentucky and now in force and effect. SECTION 0. This ordinance shall take effect and be in force from and after its passage.
