WHPRFAS, the Board of Commissioners of the City of PaducHh, Kentucky has heretofore on the 29th day of April, 1929 adopted an ordinance entitled, "AN ORDINANCE PPOVIDING FOR THE CONSTRUCTION AND RECONSTRUCTION OF THE DRIVI'1,FPAY ON BUCKNFF LANE ROAD, OR BPOAD'!AY ES{TFNDFD, FROM TFF FAST PPOPFRTY L•INF OF 32ND STRFFT TO THE FAST FFOPFRTY LINE OF VINF STRFFT, IN THTC' CITY OF PADUCAH, McCRACKFN :OUNTY,•KFNTUCKY, 17ITH ATI NFCEFSAFY CURBS, GUTTFRF, DRIVFtnpYS, 6P.NTIOTF'S, INTAKES, CATCH BASINS, SE^'!FR AND DI'AIN PIPE, AND ALL TFCESSAPY F.NGINF RING, ADVFRTIFING AND LFGAL AND CLFFICAL SERVICE [N CONNECTION TH'.�rPHI1H AT THE COST OF THF ABUTRING PFOPT'RTY 01."NFRS ,ND PROVIDING THAT SApr PRAY BF CONSTFUCTFD UPON TFF TFN YEAR PAYMENT 'LAN, " and WHEREAS, in accordance elith said ordinance it is provided hat the cost df construction of' said driveway, together with all ecessary curb, gutter, driveways, manholes, intakes, catch basins, Page 487 drain tile and sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith and all other work done thereunder be paid for by the abutting property owners on both sides thereof, except that portion to be paid. by the pity of Paducah as required by law, and WHEREAS, pursuant to said ordinance a contract was entered into on the day of 01929 between the Southern Roads Company, Contractors, and the City of Paducah, "�entucky for the construction thereof, and l9HEFFAS, said contract has in all respects been completed and the work thereunder finished and accepted by the Board of Com- missioners of the City of Paducah on the 16th day of Jamuary, 1930 Pursuant to notice duly given aad inspection of said work and the recommendation of acceptance made therefor by the Uommissioner of Public Works of the City of Paducah, Kentucky, and pursuant to a motion made by said Commissioner, which motion was duly adopted by the hoard Of Commissioners, NO'?, TlirFFFORE, BF. IT ORDAINED BY TIF BOARD OF COI/iMISt'IONrRS Ob' THE CITY CF PADUCAI', KFIFFUCKY: SECTION 1. That all of the property on both sides of Buckner Lane Road, or Broadway extended, from the east property line of 32nd Street to the east property line of Vine Street, in the/City of Paducah, McCracken County, Kentucky, as shown by the Engineer's Estimates, be, and the same is hereby assessed for the cost of construction of an improved or asphalt street with all necessary curb, gutter, driveways, manholes, intakes, catch basins, drain tile and sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith. All of said work has been done under the ordinance and contract aforesaid and said assessment is as follows, to -wit: Cost of paving and excavation, 40.35 abutting ft................9$5.051053283 per abutting ft. Page 488 SECTION 2. That all of the funds derived from the assessment of said property aforesaid shall be used for the purpose of paying off the tax bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky StatVtes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted and now in force, said assessments may be, at the option of the property owners, payable in cash within thirty days from the date of the passing of this ordin-�n ce, or in ten annual installments, pursuant to the provisions of said Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, and wl-ich may be paid on the ten year installment plan, as herein- before provided for, the City of Paducah may issue and sell improve- ment bonds, and to secure the payment of which bonds there is hereby pledged such taxes and liens upon the property assessed herein for the payment of the principal and interest on such bonds, but said bonds shall not be sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said street as hereinbefore mentioned, and such bonds, if issued, shall bear interes and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the i General Assembly of the Commonrealth of Kentucky and now in force and effect. SECTION 5. This ordinance shall take effect and be in force from and after its passage, record and publication.
