HomeMy WebLinkAboutOrdinances Book 9, Page 475, No Ordinance NumberPage 475 AN ORDINANCE ASSESSING ALL OF THF PFOPFRTY 11ITHIN SF!'TFR ZONE 4A WITHIN THC CITY OF PADUCAH, KENTUCKY FOR T11E CO•FT OF CONETFUCTION OF STORM WATER AND SANITARY SEWERS THE SUM OF $0.02117724611 PFR SQUARE FOOT. qW P,rHEREAS, heretofore, to -writ; on the 9th day of July, 1928, the Board of Commissioners of the City of Paducah, Kentucky duly adopted an ordinance providing for the construction of.storm water and sanitary sewers in Sewer Zone 4A after having previously and. on the 18th day of June, 1928, adopted a resolution describing said Server Zone 4A, setting out in general terms the property subject to the payment of the cost of said sewer, and providing further that if the cost of said sewer shall msount to more than Two ($2.00) Dollars per abutting foot that then all of the property within said Berner zone or district should be deemed the property benefited by said sewer and said cost should be apportioned and assessed equally on all of said property and lots within said Sewer Zone 4A, mbich Sevier Zone 4A is therein in.said resolution and in said ordinance aforesaid bounded and described as follows, to -,it; "Beginning in the center line of 21st street in'the wrest boundary line of Zone No.4, Severer District No.3A, 207.75 ft'. south of the intersection of the center lines of 21st street and Jackson street, as located west of 21st street; thence parallel to and 207.75 ft. from the center line of Jackson street, approximately 1110.5 ft. to the center bf 24th street; thence at right angles and with the center line of 24th street, towards Jackson street 1.5 ft, or 206.25 ft, from the center of Jackson street; thence at right angles and parallel to Jackson street approximately 3750 ft. to the center of 31st street; thence norhtwardly with the center line of 31st street to the north line of the 126 acre tract of ?.F.Bradshaw and Eloise McDonald, approximately 549 ft; thence v:ith the north line of said tract westwardly 250 ft, to the east line df Schmaus Arcadia Addition; thence in a north- erly direction with the east line of Schmaus Arcadia Addition, approximately 90 ft, to the center of the 15 ft. alley on the south side of Schmaus Arcadia Addition; thence -with the center line of said 15 ft. alley, approximately 884 ft. to the center line of the 20 ft, alley running approximately north and south, as shown on the plat of,Schmaus Aread.ia Addition; thence at right angles, 7.5 ft. to the south line of _ the Schmaus Arcadia Addition; thence with the south line of the Schmaus Arcadia Addition and the north line of the property of Adam Hass heirs, anproximately 60 ft, to a point 185 ft. at right angle's from the center of the Paducah and Lovelaceville Road; thence parallel to and 185 ft. from the center'of the Paducah and Lovelaceville Road, approximately 940 ft, to the center of Beyer Avenue, as shovin on the Holland & Grassham Subdivision; thence with the center of Beyer Avenue to the center'6f the Paducah & Lovelaceville Road, a distance of spnroximately 186 ft.; thence at right angles to the center of the Paducah & Love laceville Road to a point in the property or Ed. D. Hannan, 185 ft. from the center line of the Paducah & Lovelaceville Road; thence parallel to the Paducah and Lovelaceville Road, approximate -,y 350 ft, to a point 190 ft'. at right angles from the center line of the Blandville Road, as shown on the plat of the Park Realty Co; thence parallel to and 190 ft, from the center line of the Blandville Road, approximately 1480 ft. to the dividing line of lots No.8 & 9 of the Given Campbell Subdivision, being the present city limit line; thence at right angles and in a southerly direction 520 ft, to•the intersection cf i the division line between lots No.40 and No.41, Block "W", Avondale Heights Addition; thence at right angles and.in an easterly direction with the division line of lots No.40 and No.41, Block "W" Avondale Heights Addition, 260 ft. to the east side of 34th street; thence in a southerly direction and riith the east line of 34th street to the intersection of the 15 ft. alley between Jefferson and Monroe streets, as shown on the plat of the colonial Heights Addition, a distance of anproximately 570 ft.; thence easti:­rdly with the center line of the above mentioned alley, 1193.5 ft. to the center line of 31st street; thence at right ankles to the south 8.25 ft, to the center line of the 25.5 ft. alley between Jefferson and Monroe Streets, as shown on the '"Jest End Improvement Co. plat; said S.W.corner of Zone 7 being 560 ft. west of the center line of 21st street; thence continuing along the'south line of Zone 7, and with the center line of said alley 560 ft. to the center line of 21st street; thence southwardly with the center line of 21st street to the center line of alley between Madison and Monroe Streets, a distance of 412.5 ft.; thence at right angles in a westerly direction along the center line of alley between Madison and Monroe streets, (the center line of said alley being the center line of the block between Monroe and Madison streets), to t#e center line of 25th street, being approximately 1570 ft.; thence at right -angles and in a southerly direction with the center line of 21st street to a point 207.75 ft. south of the intersection of Jackson Str,rt from t e west, and 21st street, the point of beginning, a distance of approximately 1320 ft." and WHEREAS, pursuant to said ordinance and. resolution it is provided that said sewers shall be constructed along, through, in and underneath the following streets, alleys and other ways within said Sewer Zone 4A, to -wit: On Madison Street, from the center line of 21st street to a point about 270 ft. west of the west property line of 27th street, approximately 2650 ft. . On Monroe Street, from the center line of 25th Street toa point about 270 ft. east of the east property line of 28th street, approximately 1075 ft. On 27th Street, from the center line of Madison Street to the center line of Monroe street, 412.5 ft; thence from the center line of Monroe Street to the center line of Kentucky Avenue, a distance of 1237.5 feet. i?m.�.: +.•:.�• s :.. _ - _ _ _'uta-. Page 477 On 26th Street, -from the center line of Ky. Avenue to the center line of Jackson Street, a distance of approximately 1735 ft. On Adams Street, from the center line of 24th Street to the center line of 28th street, a distance of approximately 1840 ft; thence north on 28th street about 120 ft, to the center line of Adams street, as' shown on the Fdgewood Addition; thence westwardly on Adams Street to the center line of 30th street, a distance of approximately 1120 ft. On Jefferson Street, from the center line of 25th street to the point between 32nd and 34th'streets -here Jefferson Street makes an angle and runs into 35th street, a distance of approxim tely 4150 ft; thence continuing west on 35th street to a point where the division line between lots No.23 & 24, Block "U", of Avondale Heights Subdivision would intersect the center line of 35th street, a distance of approximate= ly 1660 ft. On 34th Street, commencing at a point on the center line of 35th street 7 -here the center line of 34th street would intersect 35th street; thence northwardly on 34th street,to a point where the division - line between lots No.40 and 41, Block "W", Avondale Heights Subdivision, would intersect the center line of 34th street, a distance of approx- imately 680 ft. j On Broadway, from the center line of 25th street to the junction of Broadway and'the Paducah & Lovelaceville Road, a distance of approximately 3630 ft. On Buckner Lane Road, on Broadway extended, from the intersection of the Paducah R Lovelaceville Road to the center line of 39th street, as shown'on the Avondale Addition, a distance of approximately 2910 ft. On Kentucky f>:venue, from the center line of 25th street to the division line between the property of S.A.Fo,rler and the Shelton property, (which is as,far as Ky. Ave. is opened), a distance of approximately 1840 ft., and continuing on the center line of Kentucky Avenue through the property of Shelton into the property of Mrs Blanche Keiler to the center line of Nahm street, as shown on the plat of Mrs Keiler, (not recorded), which point is about 40 ft, to the west of the center line of 30th street, if extended, a distance of approximately 1040 ft. On Washington Street, from the center line of 25th street westwardly tazthe dividing line between the property of S.A.Fowler and Shelton heirs, (which is as far as the street is now opened), a distance of approximately 1840 ft.; thence continuing on.the center line of Washington street, if extended, through the property of Shelton heirs and into the property o-ned by Mrs Blanche Keiler to the center line of Nahm street, as shown on a plat of the Blanche Keiler property, (not recorded), a distance of approximately 1040 ft. On Clark Street, from the center line of 21st Street, t& the center line of 22nd street, apnroximately 310 ft; thence from the ce ter line of 24th street to the centcr line of 31st street, apnroxims.tely 3730 ft. On the Old Clinton Road from the center line of 21st street to the center line of 24th street, a distance of apnroximately 1110 ft. On Jeckson Street, from the center line of 21st street to the point of intersection of the center line of Jackson street and the center line of 21st, a distance of approximately 4850 ft. On 23rd Street, commencing where the south boundary line of Sewer Zone No.4 crossed 23rd Street; thence southwsrdly with the center line of 23rd street to the center line o,: the Old Clinton Road, apnroximately 430 feet; thence continuing on 23rd street (as shown on plat), scuth of the Old Clinton Road to the center line of Adams Street, approximately 250 ft. On 24th Street, commencing at the alley in the center line of the block between Washington and Clark Streets which point is also in the south line of Sewer Zone No.4; thence south with the center .line of 24th street to the center line of Adsmd Street, approximately 700 ft. i Commencing in the center line of 35th street, approximstelyl 450 ft, westwardly from the intersection of the center line of 34th and 35th streets; thence west^ardly to the center line of 36th street, approximately 560 feet; continuing thence to Friedman Avenue and thence on Friedman Avenue to the center line of the Buckner Lane Road, approximately 1350 ft.; thence continuing southwesterly up the creek through private property to the city limits, approximately 400 ft.; else on Friedman Avenue southeasterly from tre center line of 36th street IS Page 478 to within approximately 160 ft. of Broadway, or Buckner Lane Road, approximately 950 ft. On 36th Street, north-jardly from the center line of Friedman Avenue to the point where the division line between lots No.20 and 21, block "U", intersects the center line of 36th street, spprox- imately 840 feet. On Gregory Avenue, of Avondale Heights Subdivision, from the center line of 36th street to the center line of 38th street, approximately 750 ft. On 38th Street, From the center line of Friedman Avenue northwardly to the division line between lots No.31 and 32, Block "M", Avondale Heights Subdivision, approximately 1000 ft. On 39th Street, from the center line of Buckner Lane Road to the division line of lot No.24 and 25, Block "H", Avondale Heights Addition, approximately 900 ft. On Gregory Avenue, as shown on the Afton Heights Subdivision, from the intersection of 38th street and Friedman Avenue, eastwardly to the center line of Friedman Avenue, approximately 1380 ft. On Vine Street, from Buckner Lane Road to Gregory Avenue, approximately 540 ft. On Decker Court, from Buckner Lane Road to Gregory Avenue, approximately 515 ft. On the Paducah and Lovelaceville Poad, from its intersection with Broadway to the center of Beyer Avenue, as shown on t' -e Holland & Grassham Subdivision, approximately 2915 ft. On the Blandville Road, from its intersec-.ion �-ith the Love- l�ceville Road westwardly, to the' present city .limits, approximately 1840 ft. On Adams Street, as shown on Schmaus Arcadia Addition, from the center line of the Paducah & Lovelaceville Road, eastwardly to the center line of the alley on the east side of Schmaus Arcadia Addition, approximately 1050 ft.; thence northwardly along the center line of the above mentioned alley to the center line of an alley on the north side of Schmaus Arcadia Addition, approximately 180 ft.; thence in a northeasterly direction across private property and along the south side of the West End Improvement Co. Addition, to the center line of 31st street, approximately 330 ft. On 31st Street, from the center line of Broadway, southwardly to where the center line of 31st Street ,-oulr intersect the north line of the 126 -acre tract of land belonging to W.F.Bradshaw and Eloise McDonald, (said line being the center line of the old Clinton Road), approximately 1775 ft. On 22nd Street, from the center line of Adams Street to the center line of the old Clinton Road, approximately 300 ft. Commencing at the point where the division line between lots No. 74 and 75, Block No.3, of the Park Realty Co, Addition, if extended, would intersect the center line of Forest Circle; thence northwesterly along the line between lots 74 and 75, to the center line of Block No.3, 174 ft; thence soutbwestwardly along the center line of Block No.3, and parallel to Forest Circle, approximately 450 ft. On 30th Street; from the center line of Jefferson street, to thei center line of Broadway, approximately 413 ft. On ?_1st Street, from a point about 190 ft, north of the center line of Clark St. to a point about 200 ft, south of the center line of Adams St., approximately 890 ft, and WHTFFAS, nurauant to said ordinance, a contract As duly entered into between the City of Pa?ucah and F•J.Merkle, doing business as T"erkle Contracting Company, on the lPth day of August, 1928, for the construction of said sewers, and 17HEFFAS, said contract has been completed and said sewers duly accept•d by the Board of Commissioners of the City of Paducah on the 17th day of January, 1930, nur:uant to the recommendation of the Commissioner of Public F^forks, and of?er due notice of the time and place of the inspection and acceptance thereof, together with the estimated cost of said sewers as aforesaid, and said contract having been completed in all respects as required by said ordinance add by the contract, and notice of the time and place of inspection and acceptance of said sewers having been duly published in the official newspaper of the City of Paducah more than ten days before the date of such inspection, and the Board dl' Commissioners of said city having concurred in the recommendation of the Commissioner of Public 1,9orks, and having duly accented said sewers in all respects as required and contemDlated by said contract and by daid ordinance, and having instructed the City Solicitor to bring in an ordinance assessing the cost of said sewers against all tle property within said Sewer Zone 4A, NOW, TIIFP.EFORE, BF IT ORDAINED BY THE BOARD OF COMMISFIONFRS OF THE CITY OF PAI;UCAH, KENTUCKY: SECTION 1. That a7.1 of the lots or parcels of ground located in Sewer Zone 4A within the City of Paducah, Kentucky, as described in the preamble to this ordinance, be, and the same are hereby assessed for the ost of construction of said storm water and sanitary sewers within said Sewer Zone 4A as follows: Cost of construction of said sewers per so, ft..,I0.OP117729611 4s particularly shown by the estimate of said cost prepared and certified Page 480 by the Commissioner of Public ',forks, and the engineer in charge' ' I of and directing said work, which has been duly filed, approved and confirmed by the Board of Commissioners of said city, and which report and estimate show all of the lots and parcels of land assessed for such cost and the amount of same, and is now referred to and made a hart hereof as fully and completely as if copied herein, and .,ibich estimate of said cost an,' certificate is no,. -i on file in the office of the Commissioner of Public '%forks of said city. SECTION 2. The funds derived from the assessment of said property shall be used for the purpose of paying off the special tax bills I issued against said property, or such bonds as may be issued by the City of Paducah, Kentucky pursuant to Section 3101 of the Kentucky Statutes. I SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted and nosr in force, said assessments may be, at the option of the property oxm ers, payable in cash erithin thirty (30) days from the date of the passing of this ordinance, or in ten annual installments, pursuant to the provisions of said Statutes, provided the property olrners shall, before the expiration of said thirty (30) days after the accentance of said ,•cork and the adoption of this ordinance assessing the cost thereof, enter into written agreements with said city in accordance .rith the provisions of said Section 3101 of said Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, representing the amount -hick the property owners have elected to pay on the installment plan as herein provided, the City of Paducah may issue and sell Improvement Bonds, and to secure the payment of which bonds there is hereby pledged such taxes and liens upon the property assessed herein for the payment of the principal and interest on such bonds, but said bonds shall not be sold for less than par, and the proceeds derived therefrom shall be applied exclusively to the payment of the cost of such construction as hereinabove provided, and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the General Assembly of the Commonwealth of Kentucky and nowin force and effect.
