WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky has heretofore on the 8th day of October, 1928 adopted an ordinance entitled, "AN 013DINANCE PPOVIPITIG FOR THE CONSTRUCTION OF CONCRETE CURB AND GUTTER ON BOTH SIDES OF NORTH THIRTEENTH STREET, FROM THE WEST PROPERTY LINE OF ATKINS AVENUE TO THE PRFSFNT CITY LIMIT LINE, 7`HICH LINE IS APPFOXIM�TF.LY 149 FIST '.`JEST OF TILE '.TEST PROPERTY LINF OF REED AVENUE, IN THE CITY OF PADUCAH, McCRACKEN COUNTY, KENTUCKY, !'.FITH ALL NECESSARY MANHOLES, INTAKFS, CATCH BASINS AND SEWER PIPE, AND ALL NECESSARY ENGINEERING, ADVERTISING AND LEGAL AND CLERICAL SERVICE IN CONNECTION THEREi?ITH AT `iHF COST OF THE ABUTTING PROPERTY O'TNERS AND PROVIPING TRAT SAME M1'.Y BF CONSTRUCTED UPON THF TEN YEAR PAYTAFNT PLAN," and 77HEREAS, in ac ordance with said ordinance it is provided that the cost of construction of said driveways, curb and gutter, together with all necessary manholes, intakes, catch basins, drain tile and serer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith and al'. work done thereunder be paid for by.the abutting property mn on both sides thereof, except that portion to be paid by the i of raducah as required by la" , and WHEREAS, pursuant to said ordinance, a contract was entered into on the --day of 1928, between J.M Page 419 Rouse Contracting Company; Contractors, and the City of Paducah, Kentucky for the construction thereof, and WHEREAS, said contract has in all respects been completed and the work thereunder finished and accepted by the Board of Commissioners of the City of Paducah on the 17th day of October, 1929, pursuant to notice duly given and inspection of said work and the recommendation of acceptance made therefor by the Commis sionor.of Public !forks of the City of Paducah, lentucky, and pursuant to a motion made by said Commissioner, which motion was duly adopted by the bard of Commission,rs, NOW, TA.PRFFORE, BE IT ORDAIiIED BY THE BOARD OF COMMI8"IONFRS OF TAR CITY OF PADUCAH, KENPUCKY: SECTION 1. That all of the property on both sides of North Thirteenth Street, from the west property line of Atkins Avenue'to the present city limit line, which line is approximately 149'feet west of the west property line of Reed Avenue; in the City of Paducah. McCracken County, Kentucky, as s -own by the Engineer:ts Estimates, be, and the same is here assessed for the cost of construction of concrete driveways, curb and gutter, with all necessary manholes, intakes, catch basins, drain tile and sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith. All of said work has been done under the ordinance and contract aforesaid and said assessment is as follows, to -wit: Concrete gutter............................$0.36 per lin, ft. Concrete driveways ...................... 0.21 per sq, ft. Concrete curb straight..... .... ........ 0.54 per lin, ft. Concrete curb curved........:. ... 0.60 per lin. ft. Cost of Expansion Joints..,$0°0088985526 per dollar construction cost Cost of Englq eetk.ng and Inspection .................80.0638379927 per dollar construction cost Cost of interest .......... .0.0196851459'per dollar'construction cost As shown by the Engineer's Estimates on file in the office of the Commissioner of Public Works, which estimates are adopted and msde part hereof. SECTION 2. That all of the funds derived from the assessment of said Property aforesaid shall be used for the purpose of paying off the tax bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the rtentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, a; amended and re-enacted and now in force, said assessments may be, at tl option of the property owners, payable in cash withiiT thirty days from the date of the passing and recording of this ordinance, or in ten annual installments, pursuant to the provisions of said Statutes. Page 420 SECTION 4. In order to provide a fund for the immeiate payment of the :ost of that portion of the special assessments herein provided 'or, an(.' which may be paid on the ten year installment plan, as iereinbefore provided for, the City of Paducah may issue and sell mprovement bonds, and to secure the payment of which bonds there s hereby pledged such taxes and liens upon the property assessed erein for the payment of the principal and interest on such bonds, ut said bonds shall not be sold for less than par, afld the proceeds hereof applied exclusively to payment for the improvement of said treet as brreinbefore mentioned, and such bonds, if issued, shall ear interest and shall be nayable in ac^,ordance with the provisions f Section 3101 of the Kentucky Statutes, as amended and re-enacted y the General Assembly of the Commonwealth of Kentucky and now in and effect. SECTION 5. This ordinance shall take effect and be in force from after its passage, record and publication.
