That the 'following driveways in '•fallace Park Addition to the City of Paducah, to -wit: Maple Lane, from the '.lest property line of the Lovelaceville road to the South property line of Buckner Lane Road, or Bro^..dwny Extended; Forest Circle, from the Pest property line of Maple Lane to the Fast property line of Sycamore Drive; Sycamore Drive, from the Scuth property line of Buckner Lane Road, or Broadway extended, to the North property line of the blandville Road; Forest Circle, from the East property line of Sycamore Drive to the .;est property line of the Love- laceville hoad; 1:7911ne e Lane, from the Forth property line of Forest Circle to the South property line of Forest Circle; Cedar Lane, from the !'lest property line of '.7allace Lane to the South property line of Forest Circle; Clark Street Extended, from the :lest Droperty line of the Love- laceville Road to the East property line or 7allace Lane, in the City of Paducah, McCracken County, -Kentucky, ,,,rith all necessary curbs, gutters, driver.eys, manholes, intakes, catch b -sins, sewer and drain pipe, and all i necess,sy engineering, advertising and legal and clerical service in connection therewith, be, and the same is hereby ordered to be constructed and reconstructed with concrete, asphalt, bitul.ithic, or other improved paving material as may be determined by the board of Co=issioneas as the best and most economical material for the constr.zction and reconstruction Page 3?_5 thereof, upon bids made therefor, and all to be done in strict accordance ith the plans, specifications, grades, widths, profiles and drawings of the Commissioner of'Public C7orks, prepared by him for such purposes, all of which are hereby adopted as a part of this ordinance as fully as if embraced herein or attached hereto and made part hereof and marked "A" for more specific identification. SECTION 2. That said xork shall be constructed and reconstructed under the direction and supervision of the Commissioner of Public '.'forks, ^nd shall be commenced at a time designated by contract for the performance of said work, and completed on or before eight months after the passage and recording of this ordinance. SECTION 3. That all the cost incident to said construction and re- construction of said streets, as provided in Section 1 hereof, shall be paid for r]-olly by the property owners and property abutting or fronting thereon on both sides of said streets and to be apportioned to and assessed against the property owners and property abutting on both sides of said streets according to the. number of feet or abutting feet thereon. Provided that said improvement shall be made upon the ten year payment plan as provided in Sections 3101 and 3102 of the Kentucky Statutes. SECTION 4. The contractor a arded the work herein provided for shall be paid only from the funds arising from the Special Tax bills and assep�ments against the property abutting the improvement herein provided for, and in no other way, except that the said contractor may be paid out of such bonds issued in accordance r;ith the law of the pity of Paducah and charter cities of the second class of the State of Kentubky, snd for the payment of which, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable to the said Contractor for the excess of fifty (501/'.) per cent of the value of any property assessed for the con truction of the zrork herein provided for. SECTION 5. The contractor awarded the contrect for the work herein provided for shall be pail montlly by Improvement "!arrants issued by the City of Paducah unon estimates furnished by the Commissioner of Public 'ilorks, to the extent of sixty-five (65;n) per cent of the Page 326 value of the 7rork done or materials furnished by the contractor during the progress of the work, and said Improvement `J'arrnnts shall bear six (6�) per cent interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners Said Improvement 'Warrants shall be negotiable and shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upox-ipletion and acceptance of the work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The interest on such Improvement Warrants shall be estimated and assessed as a part of the cost of the improvement herein provided for. SECTION 6. The Mayor is hereby authorized and directed to execute all written contracts and bonds -ith the successful bidder for the construction of said improvement, ns required by law. SFCTION 7. Bids shall be received for the construction of paid work out of concrete, asphalt, bitulithic, or any other improved paving material according to plans and specifications made and provided therefor by the Commissioner of Public Works and reported to,the Board of Commissioners at the next regular or called meeting and said Board of Commissioners shall determine the material with shich said streets shall be constructed and award the contract therefor to the lowest and best bidder, except fibat the right is expressly reserved to reject any and all bids within the discretion of the Board of Commissioners. SECTION 8.
