That the driveway on Buckner Lane Road, or Broadway Extended, from the East property line of 32nd -!�treet to the Fast property line of Vine Street, in the City of Paducah, i,icCracken County, Kentucky, with all necessary curbs, gutters, driveways, man- holes, intakes, catch basins, sevrer and drain pipe, and all necessary engineering, advertising and legal ^nd clerical service in connection therewith, be, and the same is hereby ordered to be constructed and reconstructed with asphalt, concrete, bitulithic, or other improved paving material as may be determined by the Board of Commissioners as the best and most economical material for the construction and reconstruction thereof, upon bids made therefor, and all to be done in strict accordance %^ith the plans, specifications, grades, widths, profiles and drawings of the Commissioner of Public !7orks, prep^red by him for such purposes, all of -hich are hereby adopted as a part of this ordincnce as fully as if embraced herein or attached hereto and made part hereof and marked "A" for more specific identification. SECTION 2. That said work shall be constructed under the direction and supervision of the Commissioner of Public ::'orks, and shall be commended at a time designated by contract for the performance of said work, and completed on or before eight months after the passage and i recording of this ordinance. SEM ION 3. That all the cost incident to said construction and reconstruction of said street, as provided. in Section 1 hereof, shall be paid for wholly,l?y the property ovmer.s and property abutting or fronting thereon on both sides of said street and to be apportioned to and assessed against the property oviners and property abutting onboth sides of s^id street according to tie number of feet or abuti:ing feet thereon, except that the City of Paducah shall Page 322 pay such portion of cost of construction as required by law. Provided that said improvement shall be made upon the ten year payment plan as provided in Sections 3101 and 3102 of the Eentucky Statutes. SECTION 4. Thi contractor awarded the •:fork herein provided for shall be paid only from the funds arising from the Epecinl lax Bills and assessments against the property abutting tre improvement herein provided for, and in no otter way, except that the said contractor may be paid out of such bonds issued in accordance v:ith the law of the City of Paducah and. charter cities of the recon' class of the State of Kentucky, and for the payment of ..inich, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable to the said Contractor for the excess of fifty (5(X0) per cent of the vaue of any property assessed for the construction of the e:ork herein provided for. STCTION 5. The contractor awarded the contract for the work herein provided for shall be paid monthly by improvement "­rrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public works, to the extent of sixty—five (651%) per cent of the value of the work done cr materials furnished by the contractor during the progress of the work, and :: aid Improveirent '.7arrants shall bear six (6 f ) per cent interest from date of issual ^nd shall be issued b;, the Commissioner of Public Finance upon order of the ;:card of Commissioners. Said Improvem Warrants shall be negotiable ••^nd shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable at the office of the 11ommissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the irork herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any Improvement ronds issued in anticipation of such local taxes. The interest on such Improvement 17arrants shall be estimated and assessed as i p•rt of the eo,•t of the improvement herein provided for. SECTION 6. The Mayor is hereby authorized and directed to execute all I written contracts and bonds with the successful bidders for the I construction of said improvement, as required by law. Bids shall be received for the construction of said )rk out of concrete, asphalt, bitulithic, or any other improved xving material according to plans and specifications made and rovided therefor by the Commissioner of Public '::orks and reported o the Board of Commissioners at the next regular or called meeting nd said t3oard of Commissioners ehnll determine the material with rich said street shall be constructed and award the contract t ere o the lowest and best bidder, except that the rigbt is expressly -eservecO, to reject any and all bids within the discretion of the Board of Commissioners. SECILION 8. This ordinance shall take effect and be in force ten lays after its passage'.
