OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That the driveway on 4th Street from the South property
line of Madison Street to the South property line of Clay Street; and
on 5th Street from the South property line of Madison Street to ti -e
South property line of Clay Street; and on Madison Street from the West
property line of 4th Street to the East property line of 5th Street;
and on Harrison Street from the Vest property line of 4th Street to the
East property line of 8th Street, except the intersections at 5th and
Harrison Streets, 6th and Harrison Streets, and 7th and Harrison Streets;
and on Clay Street from the East property line of 4th Street to the
`.lest property line of 9th Street, except the intersection at 6th and
Clay Streets, in the City of Paducah, Kentucky, with all necessary curbs,
gutters, driveways, manholes, intakes, catch basins, sewer and drain
pipe, and all necessary engineerinP, advertising Pnd legal and clerical
service in connection therewith, be, and tle same is hereby ordered to
be constructed and reconstructed with concrete,jasohalt, bitulithic, �
or other improved paving material as may be determined by the Board of
Commissioners as the best and most economical material for the construct
ion and reconstruction thereof, upon bids made therefor, and all to be
done in strict accordance with the plans, specifications, grades, widths,
profiles and drawings of the Commissioner of Public 1,7orks prepared
by him for such purposes, all of ahich are hereby adopted as a part of
this ordinance as fully as if embraced herein or attached hereto and

ade part hereof and marked "A" for more specific identification.
SECTION 2.
That said work shall be constructed under the direction
and supervision of the Commissioner of Public 'forks, and shall be
commenced at a time designated by contract for the performance of
said work; and completed on or before eight months after the
passage and recording of this ordinance.
SECTION 3.
That all the cost incident to said construction and re-
onstruction of said streets, as provided in Section 1 hereof, shall
e paid for wholly by the property o -:m ers and property abutting
r fronting thereon on both sides of said streets and to be apportion -i
d to and assessed against the property o,^ners and property abutting
n both sides of said streets according to the number of feet or
butting feet thereon, except that the City of Paducah shall pay
uch portion of cost of construction as aequired b`= law. Provided
hat said improvement shall be made upon the ten year payment plan
s provided in Sections 3101 and 3102 of the Kentucky Statutes.
SECTION 4.
The contractor awarded the work herein provided for shall
e paid only from the funds arising from the Special Tax Bills and
ssessments against the property abutting the improvement herein
rovided for, and in no other way, except that the said contractor
ay be paid out of such bonds issued in accordance �Ath the law of
he City of Paducah and charter cities of the second class of the
tate of Kentucky, and for the payment of which, said tax bills and
ssessments mny be pledged by the said City of Paducah; and in no
vent shall th, s• -id City of Paducah be liable to the Contractor
or the construction of any of the work herein provided for, except
he said City of Paducah shall be liable to the said Contractor for
he excess of fifty (50%) per cent of the value of any property
ssessed for the construction of the work herein provided for.
SECTION 5.
The Contractor awarded the contract for the work herein
rovided for shall be paid monthly by Improvement ti'larrants issued
i,y the City of Paducah upon estimates furnished by the Commissioner
pf Public Works, to the extent of sixty-five (65%) per cent of the
Iralue of the work done or materials furnished by the contractor
ii -ring the progress of the work, and said Improvement Warrants shall
ear six (6a) per cent interest from date of issual and shall be
ssued by the Commissioner of Public Finance upon order of the Board
f Commissioners. Said Improvement War?ants shall be negotiable and
hall constitute a lien upon the local taxes to be hereafter levied
or such improvement, and shall be payable at the office of the

Commissioner of Public Finance, without notice to the holder thereof,
upon completion and acceptance of the work herein provided for, out of
the first collection of such local taxes, or out of the proceeds of the
sale of any Improvement Bonds i^sued in anticipation of such local taxes.
The interest on such Improve,^ent 'larrants shall be estimated and assessed
as a part of the cost of the improvement herein provided for.
SECTION 6.
The Mayor is hereby authorized and directed to
execute all written contracts and bonds :.,ith the successful bidder for
the construction of said. improvement, as required by lacy.
SECTION 7.
Bids shall be received for the construction of said
work out of concrete, asphalt, bitulithic, or any other improved paving
material according to plans and specifications made and provided therefor
by the Commissioner of Public norks and reported to the Foard of
Commissioners at the next regular or called meeting and said Board of
Commissioners shall cetei•mine the material with which said streets shall
be constructed and award the contract trerefor to the loi,:est and best
bidder, except that the right is expressly reserved to reject any and all
bids within the discretion of the i oard of Commissioners.
SECTION 8.
This ordinance shall take effect and be in force ten
days after its passage.
