BE IT ORDAINED E'Y THF BOARD OF COIi14IS`IO?IFPS OF THF CITY OF PADUCAH, 171iTUCKY: SECTION 1. That the alley lying between Broadway and Kentucky Avenue, from the West property line of 6th Street to the East property line of 7th Street in the City of Paducah, Kentucky, with all necessary curbs, gutters, driveways, manholes, intakes, catch basins, sewer and all necessary engineering, advertising and legal and clerical service in connection therewith, be, and the same is hereby ordered to be constructed and re -constructed ^ith concrete, upon bids made therefor, and all to be done in strict accordance with the plans, specifications, grades, widths, profiles, and drawings of the Commissioner of Public ';forks prepared by him for suet purposes, all of which are hereby adopted as a part of this ordinance as fully as if embraced herein or attrehed hereto and made part hereof and marked "A" for more specific identification. SECTION 2. That said work shall be constructed under the direction and supervision of the Commissioner of Public 'r"orks, and shall be commended at a time designated by contract for the performance of said work, and completed on or before eight months after the passage and recording of this ordinance. SECTION 3. That all the cott incident to said construction and re- construction of said alley, as provided in section 1 hereof, shall be paid for wholly by the property o7,ners and property abutting or fronting thereon on both sides of said alley and to be apportioned to and assessed against the property o^hers and property abutting on both sides of said alley according to the number of feet or abutting feet thereon,"ekeept that the City of Paducah shall pay such portion of cost of construction as required by law. Provided that said improvement shall be made uvon the ten year payment plan as provided in Sections 3101 and 3102 of the Kentucky Statutes. Page 300 SECTION 4. The contractor awarded the work herein provided for shall be paid only from the funds arising from the Special Tax Bills and assessments against the property abutting the improvement herein provided for, and in no other way, except that the said contractor may be paid out of such bonds issued in accordance sith the law of the City of Paducah and charter cities of the second class of the State of Kentucky, and for the payment of which, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be linfle to the said contractor for the excess or fifty (501%) per cent of the value of sny property assessed for the construction of the work herein pl i for. SECTION 5. The contractor awarded the contract for the work herein provide) for shall be paid monthly by Improvement Warrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public ':forks, to the extent of sixty-five (65%) per cent of the value of the work done or materials furnished by the contractor during the progress of the work, and said Improve,rnt "'arrants shall bear six' (6%) per cent interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners. Said Improvement Warrants shall be negotiable and shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of t work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any Improvem nt Bonds issued in anticipation of such local taxes. The interest on such Improvement Warrants shall be estimated and assessed as a part of the cost of the improvement herein )rovided for. SECTION 6. The Mayor is hereby authorized and directed to execute all written contracts and bonds with the successful bidder for the construction of said improvement, as required by law. SECTION ^. Bids shall be received for the construction of said work out of concrete according to pl-,.ns and specifications made and j provided therefor by the. Commissioner of Public '.'.'orks and reported to the board of Commissioners at the next regular or called meeting and the contract therefor awarded to the lo;,est and best bidder, except that the Page 301 is expressly reserved to reject any and n11 bids within the cretion of the Board of Commissioners: SECTION 8. This ordinance shall take effect and be in force ten after its passage.
