71HEREAS, the Board of Commissioners of the City of
Paducah, Kentucky has heretofore on the 8th day of October, 1928 adopted
an ordinance entitled, "API ORDINANCE PROVIDING FOR THE CONSTRUCTION OF
SIDP7ALK, CURB AND GUTTER ON THE: "'F.ST SIDr OF ATKINS AVENUE, FROM THE
SOUTH CUPB LINT' OF THIRTFTNTH STR.ErT TO THE NORTH CURB LINE OF FOURTEENTH,
STPTFT IN THF CITY OF PADUCAH, MCCRACKFN rcUNTY, KENTUCKY, ':7ITH ALL
NECESSARY DRIVEt,'AYS, MANHOLES, INTAKES, CATCH BASINS AND SEPIER PIPE, AND
ALL NECESSARY FNGINEFP.ING, ADVERTISING AND LFGAL ANT CLERICAL SERVICE
IN CONNECTION TNFRrA'ITH AT THE COST OF THE ABUTTING PROPERTY O":'NFRS AND

'WHFREAS, in accordance with said ordinance it is provided
that the cost of construction of said sidewalk, curb, gutter, driveways
and all other work done thereunder be paid for by the abutting property
owners on the Vilest side of Atkins Avenue where asid work was done, except
that portion to be paid by the City of Paducah as required by 1pm and

CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That ..all of the property on the 3est side of Atkins
Avenue, from the South curb line of Thirteenth Street to the North
curb line of Fourteenth Street, be,.and the same is hereby assessed
for the cost of construction of concrete sidewalk, curb and gutter,
and all necessary driveways, manholes, intakes, catch basins and
sewer pipe and all necessary engineering, advertising and legal and
clerical service in connection therewith. All of said work has been
done under the ordinance and contract aforesaid and said assessment
is as follows, to -wit:
Concrete sidewalk $,0.16 per sq. ft.
Concrete gutter .36 per lin, ft.
Concrete driveways .21 per sq, ft.
4 cash iron pipe .21 per lin, ft:
Concrete curb straight :54 per lin, ft.
Concrete curb curved - 60 per lin. ft.

ks shown by the Engineer's Estimates on file in the office of the
30mmissioner of Public '.orks, which estimates are adopted and made
part hereof.
SECTION 2.
That all of the .funds derived from the assessment of said
property aforesaid shall be used for the purpose of paying off the
tax bills issued against said property, or such bonds as may be issue
by the City of Paducah pursuant to Section•3101 of the Kentucky
Statutes.
SECTION 3.
That pursuant to Section 3101 of the Kentucky Statutes,
as amended and re-enacted and now in force, said assessments may be,
at the option of the property owners, payable in cash ^nithin thirty
^ays from the date of the passing and recording of this ordinance,
ar in ten annual installments, pursuant to the provisions of said
itatutes.
SECTION 4.
In order to provide a fund for the immediate grayment of
the cost of that portion of the special assessments herein provided
for, and which may be paid on the ten year installment plan, as
hereinbefore provided for, the City of Paducah may issue and sell
Improvement Bonds, and to secure the payment of which bonds, there
is h,reby pledged such taxes and lien upon the property assessed

herein for the payment of the principal and interest on such bonds,`

but such bonds shall not be sold for less than par, and the proceeds
thereof applied exclusively to payment for the improvement of said
streets as hereinbefore mentioned, and such bonds, if issued, shall
i
bear interest and shall be payable in acnordanee with the provisions
of Section 3101 of the Kentucky Statutes, as amended and re-enacted
by the General Assembly of the Commomuealth of ientucky and now ir_
force and effect.
SECTION 5.
This ordinance shall take effect and be in force from
and after its passage, record and publication.
