BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY
OF PADUCAH, KENTUCKY:
SECTION 1.
That the hest side of Atkins Avenue, from the South curb line
Iof Thirteenth Street to the North curb lino of Fourteenth Street in the
City of Paducah, Kentucky, be, and the some is hereby ordered to be
improved by the construction thereon of concrete sidewalk; curb and
gutter, with all necessary driveways, manholes, intakes,.catch basins
and sewer pipe, and all necessary engineering, advertising and legal and
clerical service in connection therewith, upon bids made therefor, and al
to be done in strict accordance with the plans, specifications, widths,
grades, profiles and drawings in the office of the Commissioner of Public
forks and prepared by him for such purposes, all c£' which are hereby
adopted as a part of this ordinance as fully as if embraced herein or
attached hereto and made part hereof and marked "A" for more specific
identification.
SECTION 2.
That said work shall be constructed under the direction and
11 supervision of the Commissioner of Public Works, and shall be commenced
fiat a time designated by contract for the performance of said work, and i
completed on or before eight months after the passage and recording of this
,ordinance.
SECTION 3.
That all the cast incident to said construction of said street,
as provided in --ection 1 hereof, shall be paid for wholly by the
property oxnera and property abutting or fronting thoreon on the Went
'aide of said street and to be apportioned to and assessed against the
property own -re and property abutting thereon on the West side of said
street according to the number of feet or abutting feet thereon, except
t':at the ';ity of Padacah shall pay such portion of cost of construction as
required Ly law. Provided that ani,l improvement shall be made upon the
ten yenr payment plan as provided in �actiona 3101 and 3102 of the
Ftntu_`r:y Statutes.

for shall be paid only from the funds arising from the Special Tax
Bills and assessments against the property abutting the improvement :
herein provided for, and in no other way, except that said con-
tractor may be paid out of such bonds as may be issued, in accordance;
with the law of the City of Paducah and charter cities of the second
class of the State of Kentucky, and for the payment of which, said
tax bills and assessments may be pledged by the said City of Paducah;:
and in no event shall the said City of Paducah be liable to the
said contractor for the construction of any of the work herein pro-

L vided for, except the said City of Paducah shall be liable to said
contractor for the excess of fifty (50`$) per cent of the value of
!!any property assessed for the construction of the work herein pro-
vided for.
SECTION 5.
The contractor awarded the contract herein provided for
shall be paid monthly by Improvement 71arrants issued by the City
of Paducah upon estimates furnished by the Commissioner of Public
t7orlc3, to the extent of sixty-five (65b) per cent of the velus of
the r+ork done or materials furnished by the contractor during the
progress of the work, and said Improvement Flarrants shall bear six

(6,e) per cent interest from date of issual and shall be issued by the

Co..rmissioner of Public Finance upon order of the Board of Commission-
ers. Said Improvement Warrants shall be negotiable, and shall
constitute a lien upon the local taxes to be hereafter levied for
such improvement,and shall be payable at the office of the Com-
missioner of Public Finance, without notice to the holder thereof,

i upon completion and acceptance of the work herein provided for,
I� out of the first collection of such local taxes, or out of the
proceeds of the sale of any Improvwnent Bonds issued in anticipation
of such local taxes. The interest on such Improvement Warr;uits
shall be estimated and assessed as a part of the cost of the improve-
ment herein provVed for.
SECTION 6.
The t.fayor is hereby authorized and directed to execute all
written contracts and bends with the successful bidder for the
construction of said improvement, as required by law.
SECTION 7.

This ordinance zilmll take effect and be in force ton days
after its passage.
