tractinS; Company heretofore on the 17th day of l.96-Ust, 1928 entered into
a contract ,vith the City of Paducah, Kentucky for the construction of
combined seiers in Sever Zone Fear "A" at a total estimated cost of
Three Hundred Fifty -Eight Thousand Sixty- rro and 78/100 (y 558,062.78)
Dollars, and executed bond rritl-h the Yaryland Casualty Comnany as surety
therein, by the terms of trhich said principal and surety covenanted
•::itll the City of Paducah to well and truly perform said contract and all
the conditions thereof; which contract and bond were duly accepted'and
approved by the City of Paducah, and
7 EIREAS, it is novi desired by said Contractor to substitut,
the Idat:ional Surety Company of New York, as surety in said bond by the
execution of a nevi bond to bear date of and to be effective as of the
date of the execution of said contract and bond aforesaid, and for the
purpose of relieving and releasing the L'nryland Casualty Company as suret,
in said original bond, and releasing it from all liability thereunder,

SECTION 1.
That the bond of I.J..erkle, doing business rs the I,lerkle
Contracting Corhpany, ,:lith the National Lurety Company of Hew York as
surety therein, which has this day. been tendered to the City of Paducah
to take the place of and to be substituted for a bond executed by the
said T.J.J.ierkle, doing businecs as the Verkle Gontracti.ng Company, under
date of August 17th, 1928, with the Maryland Casualty Company as surety
therein, which substituted bond bears date of August 17th, 1928, and
obligates the principal and surety therein to cause the said E.J.'+ierkle,
Ccin3 business as tl,e 1'erkle Contracting Company, to well andti'uly per-
form all of the covenants and conditions of the contract.on the ;part
of said principal, entered into with the City of Paducahon the 17th
day of Sugust, 1928, for the furnishing of materials and labor and
construct-ir><; a syctcm of combined sewers in ',ewcr '-one four "1:" in
accordance ith the detaileQ plans and specifications embraced in,
refcxred to rnd rinde a n:..rt• of said contract,-- be accepted and said
National Lurcty Company approved as surety in soid bond to be effective

as of the date of the si.,nin; of said contract and bond Aubust 17th
1028, and to be bound and to be liable for all of the undertakings
embraced in said oriCinal contract aforca•,id, and that upon the
adoption of this resolution and the si�nin thereof and putting same
into effect, as provided by laer, the said IdrtionalSurety CO!,
shall be and become and remain bound as surety of said contractor
aforesaid under the terms and conditions of said bond end contract,
-nd the Maryland Casualty Company as surety in said bond, be, and it
is hereby discharged and released as such surety from any and all
liability erhatsoever by reason of said original suretyship in said
bond.
SECTION 2.
This resolution shall take effect upon its passage.
