SECTION 1.
That both sides of Seventh Street, from the North property
line of Husbands Street to the South curb line of Callaell Street,
and on both sides of Caldwell Street, from the 'West property line of
Seventh Street to the East curb line of Eighth Street in the City
of Paducah, Kentucky, be, and the same is hereby ordered to be
improved by the construction thereon of concrete curb and gutter,
manholes, intakes and catch basins and the placii-, of all drain tile,
seaer pipe and other work necessary, including engineering,
advertising and legal and clerical service in connection therewith,
upon bids made therefor, and all to be done in strict accordance
^ith the plans, specifications, widths, grades, profiles and
drawings in the office of the Commissioner of Public '.•forks and
prepared by him for such Durposes, all of which are hereby
adopted as a part of this ordinance as fully as if embraced herein
for attached hereto and made part hereof and marked "A" for more
specific identi"ication.
SECTION 2.
That said work shall be constructed under the direction
and supervision of the ConLnissioner of Public '-!orks, and shall be
coimenced at a time designated by contract for the performance of
said •:,ork, cnd completed on or before eight months after the
pascage and recording of this ordinance;
SECTION 3.
That all the cost incident to said constriction of said
street, ^s provided in Section 1 hereof, shall be paid for wholly
by the property ormers and property abutting or fronting thereon
on both sides of said street and to be apportioned to and assessed
a„ainst the property ovaners and property abutting thereon on both i
sides of said street ac-:ording to the number of feet or abutting feet

thereon, except that the City of Paducah shall pay such portion of cost
of construction as required by law.
SECTION 4:
The contractor awarded the contract for the work herein'
provided for shall be paid only from the funds arising from the Special
Tax Bills and assessments against the property abutting the improvement j
her, -in provided for, and in no other way, except that said contractor
may be paid our of such bonds as may be issued, in accordance with the
law of the City of Paducah and charter cities of the second class
of the State of Kentucky, and for the payment of which, said tax bills
and assessments may be pledged by the said City of Paducah; and in no
event shall the said City of Paducah be liable to the contractor for the
construction of any of: the work herein provided for, except the said
City of Paducah shall be liable to said contractor for the excess of
fifty (500) per cent of the value of any property assessed for the
construction of the arork herein provided for.
SECTION 5.
The contractor awarded the contract herein provided for
shall be paid monthly by Improvement 17arrants issued by the City of
Paducah upon estimates furnished by the Commissioner of Public Works -i
to the extent of sixty-five (650) per cent of the value of the work
done or materials furnished by the contractor during the progress of the
.cork, and said Improvement Warrants shall bear six (60) per cent
interest from date of issual and shall be issued by the Commissioner of
Public Finance u^on order of the Board of Commissioners. Said Improve-
ment:'7arrants shall be negotiable, and shall constitute a lien upon the
local taxes to be hereafter levied for such improvement, and shall be
payable at the office of the Commissioner of Public Finance, without
notice to the holder thereof, upon completion and acceptance of the work
herein nrovided for, out of the first collection of such local taxes,
or out of the proceeds of the sale of any Improvement Bonds issued in
anticipation of such local taxes. The interest on such Improvement .
;larrants shall be estimated and assessed as a part of the cost of the:
,improvement herein provided for.
SECTIOU 6.
The i,,ayor is hereby authorized and directed to execute
all vrritten controcts and bonds with the successful bidder for the
construction of srid improvement, as required by law.
SECTION 7.
Bids s'^,all be received for the construction of said
work according to the plans and specifications made and nrovided therefor
by the Commissioner of Public '.'Works, and reported to the Board of.
Cornissioners at the next reLrular or called meeting and the contract

therefor waarded to the lowest and best bidder, except that the
is reserved to reject any and all bids ithin the discretion of
the snid Board of Colfinissloners,:
SECTION 8.
This ordinance shall take effect snd be in force
ton days aft r its passage.
