BE IT ORDAINED BY THE BOARD OF COMMIS,`.IONERS OF THE CITY
OF PALUC:IH, KE14T•UCKY:
SECTION 1.
That the driveway on Seventh Street, from the North curb
line of Husbands Street to the South curb linin od Caldwell Street, and
on Caldwell Street, from the Vilest curb line of Seventh Street to the East
curb line of Eighth Street, in the City of Paducah, Kentucky, with all
necessary manholes, intakes, catch basins and sewer pipe connections,.
and all necessary engineerin^, advertising and legal and clerical service
in connection therewith, be, and the same is hereby ordered to be
constructed and re -constructed with gravel, upon bids made therefor, and
all to be done in strict accordance with the plans, specifications,
;grades, widths, profiles and drawings of the Commissioner of Public Clorks
prepared by him for such-•urposes; all of c-hich are hereby adopted as a
part of this ordinance as fully as if embraced herein or attached heretc
.and made part hereof and marked "A" for more specific identification.
SECTION 2.
That said work shall be constructed under the direction
and supervision of the Commission( -r of Public Cdorks, and shall be
commenced at a time desi,.nated by contract for the performance of"said
work, and comnloted on or before eight months after the passage and
recording of tris ordinance.
SECTION 3.
II; That all the cost incident to said construction of said
`street, os provided in Section 1 hereof, shall be naid for wholly
by the property oi:cners and Property abutting or fronting thereon on both
sides of said street and to be apportioned to and assessed against the
property o!:•ners and nroperty abutting thereon on both sides of said
street accordin„ to Ube number of feet or abutting feet ttioreon, except
that the City of Paducah shall pay such portion of cost of construction
as required by law.
SECTION 4.
The contr-ctor awarded the contract for the :iork he?-ein
provided for shall be paid only from the funds arising from the ;special

Tax Bills and assessments against the property abutting the
improvement herein provided for, and in no other way, except that
the said contractor may be paid out of such bonds as may be issued,
in accordance •.ith the law of the City of Paducah and charter ditie
of the second class of the State of Kentucky, and for the payment
of which, said tax bills and assessments may be pledged by the said
City of Palucah; and in no event shall the said city of'Paducah be
liable to the contractor for the construction of any of the work
herein provided for, except the said City of Paducah shall be
liable to the said contractor for the excess of fifty (5050) per
cent of the value of any property assessed for the construction
of the work herein provided for.
SECTION 5.
The contractor awarded the contract herein provided for
shall be paid monthly by Improvement Warrants issued by the City
of Paducah upon estimates furnished by the Commissioner of Public
'.forks, to the extent of Sixty-five (65%) per cent of the value of
the work done or materials furnished by the contractor during the
progress of the work, and said Improvement Flarrants shall bear
interest at six (6,.) per cent from date of issual and shall be
issued by the Commissioner of Public Finance upon order of the
Board of Commissioners. Said Improvement Slarrants shall be
negotiable, and shall constitute a lien upon the local taxes to
be hereafter levied for such improvement, and shall be payable at
the office of the Commissioner of Public Finance, �^;ithout notice
to the holder thereof, upon completion and acceptance of the work
herein provided for, out of the first collection of such local
taxes, or out of the proceeds of any Improvement Bonds issued in
anticipation of such local taxes. The interest on such Imnrovement
'aa.rrants shall be estimated and assessed as a part of the cost of tt
improvement herein provided for.
SECTION 6.
The Mayor is hereby authorized and directed to execute
all written contracts and bonds with the successful bidder for the
construction of said improvement, as required by law.
SECTION 7.
Bids shall be received for the construction of said work
according to the plans and specifications made and provided there-
for by the Commissioner of Public "'orks and reported to the Board
of Commissioners at the next regular or called meeting, and award
the contract therefor to the lowest and best bidder, except that
the ri.ht is expressly reserved to reject any and all bids within
the discretion of the said Board. of Commissioners.
