VIHEREAS, The Board of Commissioners of the City of Paducal-
Kentucky, has heretofore, on the 24th day of April, 1928, adopted an
ordinance entitled, "AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF A
DRIVEi:'AY ON 14ADISON STREET FROM THE ':TEST PROPERTY LINE OF FIFTH STREET TO
THE EAST PROPERTY LINE OF EIGHTH STREET AND SIXTH STREET FROM THE NORTH
PROPERTY LINE OF MADISON STREET TO THE SOUTH PROPERTY LINE OF TRIMBLE
STREET AND ON SEVENTH STREET F1301-4 THE NORTH PROPERTY LINE OF MADISON
STREET TO THE SOUTH PROPERTY LINE OF CLAY STREET, IIT THE CITY OF PADUCAH,
MCCRACKEN COUNTY, T,1N1j1UCKY, 'KITH ALL NECESSARY CURBS, GUTTERS, MANHOLES,

C:IiEREAS, in accordance with said ordinance it is provided
that the cost of construction of said driveways, together with all
necessary curb, gutter, manholes, intakes, catch basins and sewer pipe
and all necessary engineering, advertising and legal csnd clerical service
in connection therewith be paid for by the abutting property owners on
both sides thereof, except that portion to be paid by ti -e City of Paducah
is required by law, and

WTIEREAS, Pursuant to said ordinance, a contract
was entered into on the day
between the Southern Roads Company, contractors, and the city of
Paducah, Iientucky for the construction thereof, and
I7-IEREAS, said contract has in all respects been
completed and the work th-reunder finished and accepted by the Board
Of Commissioners of the City of Paducah on the 27th day of August,
1928, pursuant to notice duly given and inspection of said work and
the recommendation of acceptance made therefor by the Commissioner
of Public ',forks of the City of Paducah, Kentucky, and pursuant to a
motion made by said Commissioner, which vlos duly adopted by the

SECTION 1.
That all of the Property on both sides of
Madison Street, from the hest property line of Fifth Street to the
East property line of Eighth Street, and on Sixth Street, from the
North property line of Madison Street to the South property line
of Trimble Street, and on Seventh Street from the North property
line of Madison Street to the South property line of Clay Street
in the pity of Paducah, 1tentucky, as shown by the Engine r+s
estimates, be, and the same is hereby assessed for 'the cost of
construction of an improved, or asphalt street e!ith all necessary
curb, gutter, Iaanholes, intakes, catch basins, sexier pipe and all
necessary engineering, advertising and legal and clerical service
in connection therewith. All of said ,,cork has been done under
the ordinance and contract aforesaid and said assessment is as
follows, to -wit;

ommissioner of Public Works, which estimates are adopted and made
art hereof.
SECTION 2.
That all of the funds derived from the assess-
°nt of said property aforesaid shall be used for the purpose of
kying off the tax bills issued against said property, or such bonds

as may be issued by the City of Paducah pursuant to Section 3101 of the
Kentucky Statutes.
SECTION 3.
That pursuant to Section 3101 of the Kentucky Statutes, as
amended and re-enacted and now in force, said assessments may be,
at the option of the property owners, payable in cash within thirty days �
from the date of the passing and recording of this ordinance, or ih ten
annual installments, pursuant to the provisions of said Statutes.
SECTION 4.
In order to provide a fund for the immediate payment of the
cost of that portion of the special assessments herein provided for, and
which may be paid on the ten year installment plan, as hereinbefore
provided for, the City�of Paducah may issue and sell improvement bonds,
and to secure the payment of which bonds, thdr8-1s hereby pledged -such
taxes and liens upon the property assessed herein for the payment of the
principal and interest on such bonds, but such bonds shall not be sold
for less than par, and the proceeds thereof applied exclusively to payment
for the improvement of said streets as hereinbefore mentioned, and such
bonds, if issued, shall bear interest and shall be payable in accordance
with the provisions of Section 3101 of the Kentucky Statutes, as amended
and re-enacted by the General Assembly of the Commonwealth of Kentucky
and now in force and effect.
SECTION 5.
This ordinance shall take effect and be in force from and
after its passage, record and publication:
