AN ORDINANCE FURTHER REGULATING THE SALE, DISTRIBUTIOy
PRODUCTION AND HANDLING OF 'BILK IN THE CITY OF PADUCAH, AND
PROVIDING PENALTIES FOR VIOLATION THE3EOF
WHEREAS, the public health requires that milk and milk
r 4Af products be disease free, and the public interest requiring that

I all lawful means be resorted to to require said milk and milk
products to be disease free, -
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That in addition to all of the other provisions now in
effect regarding the manner of preparing milk for sale and orovidir
(contain. s therefor, it is now further required that all milk and
milk products sold or offered to be sold, except sales to pasteur-
izing plants and establishments by producers, shall be contained in
bottles, can packages and other containers of a type and quality
(now required by ordinance'o by law, and which bottles, cans,
packages or containers shall be plainly and indelibly marked with
the name of the owner of the dairy where said milk or milk products
are produced, and no person, firm or company shall sell milk in the
City of Paducah in a contains that carries the name or trade -mark
of any other dairyman, firm or company on such container.
SECTION 2,
I' In addition to and supplemental to the provisions of
law and existing ordinances regulating the sate of milk and milk
products in the city of Paducah, the following shall also be and
the same is hereby declared to be a part of the requirements, res-
trictions and regulations governing the handling, sale, and distri-
bution of milk and milk products in the City of Paducah:
No milk shall be sold in the City of Paducah except from
disease free herds of cattle or goats. Any and all cattle or goats
in any herd from which milk is taken ffor sale or offered in the City
of Paducah or distribution in said city, shall be' subject to the
Tfollowing requirements as to healt4 to such cattle in addition to
i�hat now required or prohibited bylaw or ordinances.
No milk from any herd containing any cow or cattle or
oats having or infected with Bang+s disease, infected udders, run-
,' ng sores, lumpy jaw, or other diseased condition that might con-
titute a danger to public health shall be sold, distributed or

offered for sale within tht, City of Paducah.
i I. No person, firm or company shall sell, offer to sell or
distribute milk in the City of Paducah until he'shall obtain and

present to the Health Officer a certificate from a licensed
veterinarian showing that all of the cattle or goats.in the herd
from which said milk is taken are free from Bang's disease, infect -
any
ed udders, running sores, lumpy jar, another diseased condition
that might constitute a danger to public health, which certificate
shall be in form satisfactory to said public health officer.
SECTION 3.
Pdhen any member of any herd is found to be diseased or
infected as here n described, said animal or animals so infected
or diseased shall immediately be removed from said herd and so
isolated from same as not to be in contact with it, and such

removed and isolated cows or cattle or goats shall not be placed
with any other cows or cattle or goats.
SECTION 8.
Any herd found to contain a cow or cattle or goats in-
fected with Bang's disease shall be tested every 60 days until
the owner or such herd can produce satisfactory certificate from a

I�licensed veterinarian_ to th.. fact that said herd is entirely free
from said disease. For the purpose of determining whether said
cows or cattle or goats in every such herd are qualified as pro-
vided in this ordinance for supplying milk to the City of Paducah
and its inhabitants, each and every memb r of such herd shall be

tested by physical examination at least every six (6) months by a
licensed veterinarian, who shall submit a satisfactory certificate
of such test to the Health Officer. After any herd has been tested
no other cow, cattle or goats or bull shall be added to or a11ovJed
to be with said herd until such cow, cattle or goats or bull has
been tested as herein provided.
SECTION 5.
The permit of any person, firm or company selling or
offering to sell or distribute milk or other dairy products in the
City of Paducah in violation of any of the provisions of this
ordinance, shall be revoked by the Health Officer, which revocation;
shall be made by giving notice in writing of such revocation by the

Health Officer.
Any person, firm or company selling or offering to sell
or distribute in the City of Paducah any milk or dairy products
after his permit so to sell or distribute has been revoked as
herein provided, shall be subject to a fire or not less than
($5.00) Dollars nor more than Fifty ($50.00) Dollars for each of-
fense, and each day said ordinance is so violated shall constitute
a separate offense.'

SECTION 6.
This ordinance shall be supplemental to all other
ordinances and regulations governing milk dealers and the sale
and distribution of milk and dairy products in the City of Paducah
but all herds required to be tested under the provisions of this
ordinance may be tested within sixty (60) days from the effective
date of this ordinance.
SECTION 7.
This ordinance shall be in full force and effect from
and after its adoption.
