HomeMy WebLinkAboutOrdinances Book 9, Page 1070, No Ordinance NumberPage 1070 4 - AN AN ORDINANCE PRESCRIBING RULES AND REGULATIONS FOR THE POLICE DEPARTMENT OF THE CITY OF PADUCAH, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH BE IT ORDAINED BY THE BOARD OF COMMISSIONERS j OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. I The Chief of Police shall be the active executive head of the Police Department, but he shall be responsible to and subject to orders from the City Manager respecting the conduct and functioning of said department. He shall plan the work of the department and his orders to the other members of said depart- ment shall be strictly obeyed, and no appeal from any order or idirection of the Chief of Police shall be considered unless it is made in writing and addressed and delivered to the City Manager. ,It shall be the duty of the Chief of Police to report in writing !to the City Manager any failure, neglect or refusal on the part of any member of said department to use his best endeavor ro enforce (laws, perform his duties and to report violations of law to the ,''Chief. The City Manager shall be directly responsible to the Board of Commissioners for the efficient and orderly conduct of !the Police Department. It shall be his duty to prefer and present 'charges against any member of said department when cause or grounds therefor exist. It shall be the duty of the City Manager, or such Mother directing head, in event of a change of the form of governmcn i to deliver to the Chief of Police in writing, instructions for 'the operation and management of said department, and the Chief of Police shall have the right at any time to address a communication to the City Manager, or other directing head, asking for special instructions on any subject pertaining to the duties of the depart- ment, and it shall be the duty of said City Manager or other directing head►s duty to immediately give such instructions in I IIwriting. I SECTION 2. I The rank and position in the Police Department, d in the order of superiority shall be as follows: j lst. Chief 2nd. Assistant Chief 3rd. Chief of Detectives 4$h. Captains 5th. Patrolmen Grade 'All 6th. Patrolmen Grade uBn Page 1071 ( Qualifications for all men for the Police Department shall be as follows: The applicant must be the age required by statute. He must be able to exhibit a certificate showing his (graduation from high school. He must be a resident of the City of Paducah for the last three (3) years before his appointment. He (must be able to pass an IFA 1" physical examination and.furnish references from five (5) reputable citizens In addition to the causes for dismissal, suspension land demotion provided by law, all members of said Police.Department Ishall be subject to demotion, suspension and dismissal for the i causes hereinaft,r set out. IISECTION 3. All patrolmen now in the service as members of the +(Police Department, and all persons assigned to grades and positions I� herein defined at the present time, shall hold their respective Positions, and all patrolmen who have served continuously for one (1) year or more shall be classified as Grade ItAn patrolmen, all patrolmen now in the service who have served less than one (1) year shall be classified as Grade "BIT patrolmen. When those patrolmen now in the service and who have served less than one (1) year have completed a sufficient amount of continuous service with what they have already rendered to make one (1) year, they shall automatically go into Grade «An classification. All new appointments after the adoption of this ordinance shall be to Grade "BIT, and no one shall be promoted from Grade "B° to Grade"All as a patrolman until after he has served efficiently, faithfully and satisfactory continuously for two (2) years. Such patrolmen may then upon application to the City Manager be transferred from Grade "BIT to Grade 11A^, and if his service has been efficient, satisfacto- ry and faithful, and has been continuous for two (2) years, he shall thereupon be so transferred. All patrolmen who are appointed for temporary service and not for continuous service shall be classi- Pied as Grade "BIT patrolmen, and their services shall be for only such length of time as may be required for the special purpose for vhich they may be chosen. Grade "BIT patrolmen shall receive pay Lt the rate of 90% of the regular pay of Grade nAn patrolmen. SECTION 4. Members of the Police Department may be dismissed, emoted or suspended for any of the followinG causes II i Page 1072 1. Drinking beer, wine, w1iiskey or any other alcoholic or intoxicating liquor while on duty or while wearing any part of his uniform. 2. Being intoxicated either on or off duty. 3. Insubordination or disrespect to superior of- ficers, or refusal or failure to obey or execute any command or order given by a superior officer. 4. Loitering while on duty or while wearing any part of his uniform. 5. Conviction in any Court of a felony. 6. Attempting in any way to influence any persons vote in any election, or interferring with or obstructing the holding of any election or registration of voters. 7. Suffering his pay or salary to be garnished I three (3) times for a just debt for necessaries for himself or family contracted during his employment for the city. 8. Cowardice inefficient or neglect in the � y g p rform! ante of duty or disobedience of lawful orders of a superior officer. 9. Such mental, physical or educational incapacity Dr disability as renders him incapable of properly performing his iuty. 10. Abandonment of, without just cause, or failure I co support his family. 11. Any immoral habits, lascivious or improper .onduct not herein enumerated which would render him an unfit or Improper person for employment in the Police Department. 12. The acceptance of any gift or contribution of any kind from any person or persons which may be calculated to pledge such member of said Police Department under obligation to the :ontributor or anyone else. 13. The communication of information concerning the plans, activities or secrets of the Police Department, or the iivulging, giving out or disclosing of this name of any informer con- ,erning law violators to any person not a member of said department. Provided, however, that this provision would not apply should its application prevent cooperation with othLr departm_nts of the City Government through their duly constituted heads or with the law enforcement officers of any political sub -division of the Common- wealth or of the United States. 14. Entering any disorderly house except in the ischarge of duty. Page 1073 15. Using unnecessary force or brutality in making arrests or handling prisoners. 16. Using indecent, profane or obscene language while duty or while wearing any part of his uniform. 17. Being tardy or absent from any roll call or loitering unnecessarily at police headquarters. 18. Impoliteness or rudeness in dealing with the publi( or in performance of duty. 19. Slovenliness or untidyness in his person or uniforr or failure to wear the prescribed uniform while on duty. 20. Leaving his regular beat unless in the performance of duty, or upon order of the superior offices 21. Being absent from duty without proper p permission. Police Officers shall have permits from the Chief of Police or their superior officer temporarily on duty for any absence from their regular post or assignment, and no officer shall be off duty without permission properly granted to him, and any officer who shall absent himself from duty without such p rmission shall forfei his pay during the period of such absence, and be dismissed from the service. 22. Engaging in disputes or quarrels with another officer or officers while either or any of them are on duty, or using any indecent, obscene or profane names or language in addressing any officer or other person. 23. Smoking or chewing tobacco while on duty. II SECTION 5. Any member of said Police Department who shall be found guilty as now provided by law, on a hearing of charges for violation of the rules and regulations prescribed in the preceeding) section shall be demoted, suspended or dismissed from the service in the discretion of the Board of Commissioners. J SECTION 6. +� When a member of the Police Department id demoted by the Board of Commissioners from one grade or classification to a �i lower grade or classification, he shall have the same status as one appointed or promoted to such lower grade. A suspended member shall receive no pay during the time of his suspension unless he be acquitted of the charge or charges against him, and if so acquitted, he may be allowed pay for the time so suspended by order of the Board of Commissioners. Page 1074 SECTION 7. The Chief of Police shall designate duties to Imembers of the department so as to produce the greatest efficiency jin the service, his orders in such matters shall be explicitly complied with. SECTION 8. All members of the Police Department except Assistant Chief of Police and the detectives shall wear the s uniform, wh:.ch shall be the same as worn by members of the depart- ment and which shall consist of a standard uniform cap, standard i navy blue coat and trousers, black shoes, standard blue shirt, ,black tie and Sam Brown belt. The above shall constitute the li standard winter uniform. The standard summer uniform shall con- Isist of the above with the exception of the uniform coat, and with a the further exception of a standard cap, part of which may be made r of white material and such other modifications in weight and ;quality as may be deemed to the best interest of the department and ,the comfort and convenience of the members thereof, and to be de- termined by the Chief of Police with the approval of the City Manager. The insignia to be worn designating the respective department is as follows: iFor the Chief of Police three (3) gold stripes on the left cuff. Captains two (2) gold stripes on the left cuff. (Lieutenants one (1) gold stripe on the left cuff. Sergeants one (1) red stripe on the left cuff. The collar of all uniform coats shall have the letters P.P.D. iembroidered thereon in gold colored silk. Uniform buttons shall be of goldish tint with the letters P.P.D. pressed in said buttons. SECTION 9. All members of the Police Department shall every six (6) months be required to stand a physical examination, said examination to be made by the City Physician without charge to the members of the department, and if such physical condition exists that renders said member of the department incapacitated for duty, the and provided that he has been in the service for more thanta:o (2) year probation period, the Board of Commissione:-s shall have the right to grant to said member a leave of absence for not longer than six (6) months, said member shall be entitled to services of the City Physician without charge. All patrolmen added to the department from and after the passage of this ordinance shall be on probation for a p::riod of two years, and shall be eubject to Page 1075 dismissal from the service for causes satisfactory to the Board of Commissioners. SECTION 10. No member shall use the automotive equipment of the Police Department except in the performance of duty; and no member i shall drive said equipment at an excessive rate of speed, except in pursuit of law violators. Every member shall strictly observe all traffic laws, ordinances and regulations of the City except in (cases of real emergency when the public interest or safety requires it. Each member using said automotive equipment shall use every 1iprecautiojj to preserve the same in good order and good appearance. iAnd if any injury or damage results -to said equipment so in charge ,of a memb-r by his negligence or improper use thereof, he shall be ('held responsible to the City for such damage or injury. SECTION 11. Any and all awards, fees and donations of any kind collected by members of the Police Department shall be delivered to the Chief of Police who shall forthwith turn same over to the Treasurer of the City of Paducah to be deposited to the credit of the Police and Firemen's Pension Fund. SECTION 12. All ordinances and parts of ordinances in conflict herewith, are to the extent of such conflict hereby repealed, and the provisions of this ordinance are hereby declared to be severable, and if any provision hereof shall be found or declared be invalid, such decision or invalidity shall not affect the re- maining provisions of this ordinance, it being the intention of the Board oa Commissioners to enact each and every provision con- tained herein separately and irrespective of any other provision. SECTION 13. This ordinance shall be in full force and effect from and after its adoption.
