A RESOLUTION PROVIDING FOR THE GRANTING OF' A PERMIT TO INSTALL
A COAL CHUTE ON THE EAST SIDE OF THIRD STRisET FOR THE USE OF THE
SMITH BUILDING.
BE IT RESOLVED BY THE BOARD OF CO:31ISSIONERS OF THE CITY
IOF PADUCAH, KENTUCKY:
SECTION 1.
Pursuant to re.;uest of J. P. Smith dated June 17th, 1036,
Viand in accordance with draft and schedule of plans and speci.ricatiors
permission subject to the conditions herein provided is granted to
allow the installation in the East sidewalk adjacent to the Smith
�lBuilding on 3rd Street between Broadway and Kentucky Avenue of an

opening through the sidewalk and the placing therein of a coal chute
for receiving coal and taking from said basement ashes. Said exca-
vation and the ip_stallation of coverings and supports thereat shall
be done in a good workmanlike manner and subject to the approval of
the City Engineer, and material used therein shall be good and apprope
(material, and said structure shall be so made as to avoid any and all
damage to the traveling public who are required to pass over said
coal chute or opening, and when said opening is in use for Placing
material in the same and taking ashes and other material therefrom,
is good and sufficient barrier shall be placed around the same so as o
(prevent accidents by falling into said opening, and all of said work
shall be done pursuant to and in accordance %'.ith the
plan which has
11been submitted with the request and application.

SECTION 2.
Before doing any work in said sidewalk or making any excavations
therein, the said applicant for permit shall execute a good and
(sufficient bond to the City of Paducah indemnifying it against any
and all loss or damages it may sustain or that may be occasioned by

Ithe presence of saidopening in said sidewalk, or the presence of said
coal chute or the use thereof. Said bond and undertaking to continul
in force so long as said opening or coal chute is maintained or used,l
(land to be approved asother bonds and obligations to the City of
Paducah. Provided, however, that at any time when the city of

Oaducah or any franchise holder of the City of Paducah desires or is
irequired to place any service pipes for water, gas or other purpose
I
(required to pass through said opening, said opening or coal chute
�shall be so moved or adjusted as to permit said service pipes or
other instrument of conveyance to be placed therein. It being the
purpose of this permission to grant unto the said applicant
permission to use said space subject to the superior rights of the City
of Paducah or any franchise holder to use the sale. place when its use
is necessary or required.
