HomeMy WebLinkAboutOrdinances Book 9, Page 1029, No Ordinance NumberPage 1029 T ^1 AN ORDINANCE AMENDING AN ORDINANCE ENTITLED, 'SAN ORDINANCE RELATING TO AND FURTHER REGULATING THE BUSINESS OF SELLING AT RETAIL WHISKEY, WINE, BEER AND OTHER ALCOHOLIC BEVERAGES IN THE CITY OF PADUCAH, AND PROVIDING FOR PENALTIES FOR VIOLATION THEREOF", WHICH WAS ADOPTED BY THE BOARD OF COMM-ISSIONS.RS OF THE CITY OF PADUCAH ON THE 2 -`RD DAY OF APRIL, 1936, AND AFTERWARDS AMENDED ON THE 25TH DAY OF APRIL 1936, BY REVISING, AMENDING, REPEALING AND RE -ORDAINING SECTIONS 1, 2 AND 3 THEREOF. BE IT ORDAINED BY THE BOARD OF COMIAISSION_RS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That an ordinance entitled, "AN ORDINANCE RELATING TO AND ('FURTHER REGULATING THE BUSINESS OF SELLING AT RETAIL WHISKEY, WINE, ,;BEER AND OTHER ALCOHOLIC KV RAGES IN THE CITY OF PADUCAH, AND PROVIDING PENALTI;_S FOR VIOLATION THEREOF", which was adopted by the Board of Commissioners of the City of Paducah on the 23rd day of April, 1936, and afterwards on the 25th day of April, 1936, amended by adding Section 1A, be amended, revised and re -ordained and that Sections 1, 2 and 3 thereof as so amended, revised and ire -ordained shall read as follows: TTSection ly The'sale of alcoholic and intoxicating liquor and bevcr nes being of'such nature as to require the exercise of Police i'ower in Controlling and regulating the same, it shall be Ilunlawful at all places within the City of Paducah, selling and offering for sale alcoholic and intoxicating beverages, to screen tbe`800rs or windows or to in anywise obstruct the view into such solaces of business from the outside, and no booths rrithin such (places of business shall be curtained, screened or concealed by jdoors, shutters, partitions or any other devices, or so constructed as to prevent in any way the unobstructed view in or to such places or booths; nor shall any person be permitted within such places of business who is under the age of 21 years, unless such minor is accompained by his or her parent or p rents, nor shall any minor or person under the age of 21 years be employed within, about or in connection with any place of business where intoxicating alcoholic liquor or beverages are sold by the drink. No intoxicating alcoholic liquor of any kind shall be sold between the hours of 12:00 o1clock mid. -night and 8:00 o1clock A.M. on the following day, nor shall any such sales be made on Ouddays. No beer or light wines of any kind shell be sold between the hours of 12:00 mid -night and 8:00 o'clock A.M. on the following day. Any person, firm, eompeny or corporation viol€tin- the provisions of this Section shall be guilty of e misdemeenor, and upon conviction thereof shall be fined in any amount not less thn °'10.00 nor more then i1C0.00 end any person so violetin.n said section shell also upon convic- tion in addition to such fine, may be imprisoned in the City Jail not exceeding 30 days in the discretion of the Court or the -jury trying; the case.'' �"Section 3) Any person, firm, company or corporation which may be authorized to sell any of the beverages mentioned end described in the foregoin3-two (2) sections, who permits, or himself enE=,ales in the use of profanity or disorderly conduct on the pre- mises where such business is bein- conducted, or who permits or engages in the drinkint of alcoholic liquor where a license for the i sale of alcoholic liquor by packe^e only is held, or who permits or enreFes in the drinking of intoxication liquor on premises where the sale of beer and lieht wines are authorized to be :old under licenses, shell be deemed guilty of a violation of tils section, +end shall be fined not less than '10.00 nor more than 100.00 or confined in the City Jeil not more than 30 days, or both so fined and imprisoned. All ordinc:nees in conflict herewith, are to the extent of such conflict hereby repealed. SECTI023.
