HomeMy WebLinkAboutOrdinances Book 9, Page 1008, No Ordinance NumberPage 1008 X AN ORDINANCE RELATING TO AND FURTHER REGULATING THE BUSINESS OF SELLING AT RETAIL WHISKEY, WINE, BEER AND OTHER ALCOHOLIC BEVERAGES IN THE CITY OF PADUCAH, AND PROVIDING PENALTIES( FOR VIOLATION THEREOF. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The sale of alcoholic and intoxicating liquor and beverages being of such nature as to require the exercise ofA Police power in controlling and regulating the same, it shall be unlawful atall places within the City of Paducah, selling and offering for sale alcoholic and intoxicating beverages, to screen the doors or windows or to in anywise obstruct the view into such i places of business from the outside, and no booths within such places of business shall be curtained, screened or concealed by ;doors, shutters, partitions or any other devices, or so constructed) as to prevent in any way the unobstructed view in or to such ,;places or booths; nor shall any person be permitted within such (places of business who is under the age of 21 years, unless such minor is accompained by his or her parent or parents, nor shall any !minor or person under the age of 21 years be employed within, about; or in connection with any place of business where intoxicating alcoholic liquor or beverages are sold by the drink. All persons selling intoxicating alcoholic liquor shall be required to close their place of business at mid -night of each night, and no such place of business shall be opened until 8: o'clock A.M. on the following day, and no sale shall be made therein between mid -night and 8:00 o'clock A.M. of the following day, nor shall any sale be made on Sundays. Any person, firm, company or corporation violating any of the provisions of this Section shall be guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than $10.00 nor more than $100.00, and any person so (violating said Section shall also upon conviction in addition to such fine, may be imprisoned in the City Jail not exceeding 30 daysi In the discretion of the Court or the Jury trying the ease. Any person, irm, company or corporation violating the provisions of this ection shall be guilty of a misdemeanor, and upon conviction hereof shall be fined in any amount not less than $10.00 nor more han $100.00, and any person so violating said Section shall also pon conviction in addition to such fine, may be imprisoned in the Lty Jail not exceeding 30 days in the discretion of the Court of ie Jury trying the case/ SECTION 3. Any person, firm, company or corporation which may be authorized to sell any of the beverages mentioned and described lin the foregoing two (2) sections, who permits, or himself engages in the use of profanity or disorderly conduct on the premises where Duch business is being conducted, or who permits or engages in the ranking of alcoholic liquor where a license for the sale of alcoholic liquor by package only is held, or who permits or engages in the drinking of intoxicating liquor on premises where the sale :)f beer and light wines are authorized to be sold under licenses, shall be deemed guilty of a violation of this section, and shall be fined not less than $10.00 nor more than $100.00 or confined in the :ity Jail not more than 30 days, or both so fined and imprisoned. SECTION 4. The holder or holders of any license to sell alcoholic _iquor or beer or light wines as contemplated under the provisions if this ordinance, and as provided for in the ordinances of the :ity of Paducah, and as permitted by the laws of the State of :entucky, who shall be convicted of a violation of any of the )rovisions of this ordinance, shall be conclusively presumed to have )een guilty of such conduct as to authorize the revocation of his, ;heirs or its licenses, and the judgment of such conviction shall be :onclusive proof of such violation, and the Board of Commissioners ,f said dity shall upon the presentation of such proof to them, e authorized to revoke the license of such violator. Any person, irm, company or corporation preceded against for revocation of icenses as herein provided, shall be given three (3) days notice f the time and place of said hearing, together with the statement n such notice of the cause of complaint upon which such revocation s based. Ao person, firm, company or corporation who has license Page 1010 to engage in business and has been found to be guilty of violation of any of the provisions of this ordinance shall again be granted any license to engage in such business in the City of Paducah for a period of five (5) years after the revocation of such license. SECTION 5. For the purpose df enabling the police officers of the City of Paducah to effectively carry into execution the provisions of this ordinance, all police officers and any employee of the City of Paducah having police powers, shall be permitted Ito enter, go through and inspect the premises of any and all persons holding licenses to sell any of the types or kinds of liquor or beverages described in this ordinance during the hours when such business may be open for the purpose of selling, and at any other times when said places of business are found to be open. SECTION 6. This ordinance shall be in full force and effect from and after its adoption.
