AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ()N BOTH SIDES OF WASHINGTON STREET, FROM THE EAST PROPERTY LINE OFIi7i STREET TO II THE EAST PROPERTY LINE OF 65TH STREET; 6TH STREET FROM THE.NORTH PRO- PERTY LINE OF WASHINGTON STREET TO THE NORTH PROPERTY LINE OF CLARK STREET, IN THE CITY OF PAEUCAH, KENTUCKY, 1'OR THE COST OF CONSTRUCTION OF A HARD SURFACE ROADWAY, CONSISTING OF A CONCRETE FOUNDATION PLITH A' SHEET ASPHALT TOP, 1,S SHO'."AI ON PLANS, TOGETHER '."LITH THE NECESSARY MA'!IIOLES, INTAKES, CATCH BASINS AND SEWER PIPE CONVECTIONS, EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PADUCAH, AND PROVIDING THAT SAID COST MAY BE PAID FOR IN TEN ANIMAL INSTALLMENTS IN COMPLIANCE WITII THE PROVISIONS OF THE KENTUCKY STATUTES APPLICABLE THERETO. WHEREAS, the General Council of the city of Paducah, Kentucky, has heretofore, to -wit; on the 19th day of August, 19261,adopted an ordinance, entitled, "AN ORDINANCE_-hZROVIDING FOR THE IMPROVEMENT OF WASHINGTON STREET, FROM THE EAST PROPERTY LINE OF�H STREET TO THE EAST PROPERTY LINE OF 6TH STREET; 6TH STREET FROM THE SOUTH PROPERTY LINE OF WASHINGTON STREET TO THE NORTH PROPERTY LINE OF CLARK STREET, IN THE CITY OF PADUCAH, KENYUGKY, BY THE CONSTRUCTION OF A HARD SUR- FACE ROADWAY, TOGETHER WITII ALL NECESSARY. MANHOLES, INTAKES, CATCH r� BASINS AND SEWER PIPE CONNECTIONS, IN ACCORDANCE 71'ITI THE PLANS AND SPECIFICATIONS PROVIDED THEREFOR BY THE CITY ENGINEER, AT THE COST OF THE ABUTTING PROPERTY OWNERS AND MCCRACKEN COUNTY, THE SAID Mc- CRACKEN COUNTY HAVING AGREED TO APPROPRIATE ITS PORTION OF SAID COST, !I AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION ASSESSABLE AGAINST THE PROPERTY OGJNERS MAY BE PAID IN ACCORDANCE PITH THE PROVISIONS OF THE TEN YEAR PAYMENT PLAIT. WHEREAS', it was provided in such ordinance that the cost of construction of a hard surface roadway, together with the necessary manholes, intakes, catch basins and sewer pipe connections be paid by the abutting property owners on both sides of said street, except that portion to be paid for by the City of Paducah as required by law; and, 'iLHEREAS, pursuant to said ordinance a contract was entered into on the Sth day of SEPT', 1926, between the D. J. Ryan Construction, Comnany, of Davenport, Iowa, and the City of Paducah, Kentucky, for the construction of same; and, WHEREAS, said contract has been completed and duly accepted by the General Council on the 1st day of August, 1927, pursuant to the recommendation of the Board of t'ublic P:'orks; NO1,7? THEREFORE: BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That all property on both sides of Washington Street, from No. 994. II the east property line of 7th Street to the east property line of 6th 4treet; 6th Street from the south property line of !:'ashington Street to the northproperty line of Cly Clark Street, in the City of Paducah, "entuck be, and the same is, hereby assessed for the cost of construction of a ithard surface roadway, consisting of a concreate foundaticn with a sheet asphalt top, as shown on plans, together with all necessary manholes, in- takes, catch basins and sewer pipe connections as follows, to -wit: l From the east property line of 7th Street to the east property line of 6th Street, paving per lineal foot........................5.2482251; From the south property line of Washington Street to the north property line of Clark Street, paving per lineal foot-------------X� 5.1416017; as particularly shown by the City Engineer's estimate of said cost, filed, and approved by the General Council of said City, and which will a i ppear j on file in the offices of the City Clerk and City Engineer, respectively,) and which are now referred to and made part hereof. i SECTION 2. That the funds derived Prc�n the assessment of said nronerty shall be used for the purpose of paying off theaax bills issued against said property, or such bonds as may be issued by the City of i Paducah, Kentucky, persuant to Section 3101 of the Kentucky Statutes. i I SECTION 3. 1 That pursuant to Section 3101 of the rientucky Statutes, said tax assessment may, at the option of the property owners, be payable in cash without interest within thirty days from the date of passage and publication of this ordinance, or in ten annual installments, provided j the property owners within thirty days enter into a written agreement With said City, in accordance with the provisions of said Section 3101 of the rientucky Statutes. SECTION 4. In order to provide the funds for the immediate payment of the cost of that portion of the special assessments herein provided for, which) may be paid on the ten year installment plan, as hereinabove provided, thel City of `aducah may issue and sell improvement bonds, and to secure the payment of such bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, but such bonds shall not be sold for less than par, and the proceeds derived j therefrom shall be applied exclusively to the payment of the cost of such construction as hereinabove provided; and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of I Section 3101 of the ltentucky Statutes. SECTION 5. This Ordinance shall take effect and be in force from and after its passage, approval and publication. j �- OP I ti, No. 995.
